Frink 3 Frink Street Ocean Isle"Beach, North Carolina 28469 Subject: Certification of Compliance with Stormwater Regulations Stormwater Project No.920725 Seatrail Plantation; Frink Patio Homes Brunswick County Dear Mr. Frink: The Wilmington Regional Office received the Stormwater Submittal for the Frink Patio Homes at Seatrail Plantation on July 31, 1992, with final information on October 20, 1992. Based on our review of the project plans and specifications, including deed restrictions (copy attached) which limit the built-upon area to 3500. square feet for each of the 47 numbered lots, we have determined that the project complies with the Stormwater Regulations set forth in- Title`. 15A NCAC 2H.1003 (a) - (3) . Any modification of the plans submitted to this Office or further development of this site will require an additional Stormwater Submittal/Modification and approval prior to initiation of construction. Modifications include but are not limited to; project name changes, transfer of ownership, redesign of built-upon surfaces, addition of built-upon surfaces, redesign or further subdivision of the project area. This Certification- shall be effective from the date of issuance until rescinded. The project shall be constructed and maintained in accordance with the plans and specifications approved by the Wilmington Regional Office. This Certification does not supersede any other permit or approval. The developer is responsible for obtaining any and all permits and approval necessary for the development of this project.. Dear Mr. Frink: The NC Division of Coastal Management has reviewed the above referenced application for a Nationwide Permit dated 12/01/92 pursuant to Section 307 of the Coastal Zone Management Act of 1972 as amended. Based upon our review, we have determined that the proposed activity is consistent with the North Carolina Coastal Management Program provided the following conditions are met. 1. The activity described in the above application qualifies to receive one of the Nationwide Permits described in 33 CFR Part 330 with the exception of numbers 17, 21, 24, and 34 which were found inconsistent with the North Carolina Coastal Management Program. 2. A 401 Water Quality Certification is received, where required, from the NC Division of Environmental Management. Hamilton WRC Assistant Director DATE: February 7, 1993 SUBJECT: Division of Environmental Management 401 Water Quality Certification Review for Mr. John D. Frink, Pond and Access Road Construction, Ocean Isle Beach, Brunswick County, North Carolina. The North Carolina Wildlife Resources Commission (NCWRC) staff has completed a review of the proposed project and evaluated possible impacts on fisheries, wildlife, and wetland resources in the project area. A site inspection was conducted on January 22, 1993. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.), Section 401-b of the Clean Water Act of 1977 (as amended), and North Carolina General Statutes (G.S. 113-131 et seq.). Mr. John D. Frink is requesting permit authorization to construct a 1.66 acre pond and an access road in 404 wetlands adjacent to an unnamed tributary to Calabash Creek in Brunswick County near Ocean Isle Beach. The road will provide access to an area which will be developed into 47 residential lots. The purpose of the project is to construct a housing subdivision which will be known as "Frink Patio Homes". Pond construction is solely for aesthetic reasons. The project area consists of a 6-8 ft ditch in wooded 'wetlands and is considered a 11404" jurisdictional area by the -U.S. Army Corps of Engineers. These wetlands provide numerous 'functions which benefit the public as well as fish and wildlife. These functions include retention and purification of storm water runoff and providing valuable habitat for numerous species of 0 MEMO TO: John Dorney Page 2 February 7, 1993 fish and wildlife. These wetlands play a major role in the overall biological productivity of adjacent waters. We have determined the proposed project is inconsistent with our Policies and Guidelines for Conservation of Wetlands and Aquatic Habitat and based on the loss of approximately 3 acres of 404 wetlands, recommend that water quality certification for the proposed project be denied. In addition, we believe that this project is inconsistent with the Environmental Protection Agency's Section 404(b)(1) guidelines in that the proposed project does not constitute a water dependent activity. Also, during our site visit, our biologist observed that an access road had already been bulldozed through the area and fill material placed in the vicinity of the ditch crossing. We therefore recommend that all fill material be removed and that the affected wetlands be fully restored. Finally, if certification is not withheld, then we recommend that all spoil material be deposited outside wetlands.
