Also reference your October 6, 1992 application to construct three additional ponds in wetlands on thisr same rt property and your November 4, 1992 meeting with Mr. McLendon on y r Pe y located on the west""side of NC 210, approximately 1.0 mile north of S.R. 1502, Bladen County, North Carolina. Also present during this meeting was Mr. Ken Averitte of the North Carolina Division of Environmental Management. As you agreed during the November 1992 meeting, one pond will be re- located to high ground on the north-east side of the existing pond. You also agreed that the width of the spoil bank on each side of all three ponds would not exceed 20 feet in width. All additional spoil will be deposited on adjacent high ground. You should note,that this permit does not authorize the construction of any ditches or roads i? connection with this project. Your proposed impact of 1.44 acres of jurisdictional wetlands is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions.,;, _:Please be aware that this authorization does not relieve you of the responsibility to obtain any required State or local approval. As discussed on November 4, 1992, individual North Carolina Water Quality Certification will be required prior to the initiation of any work on this property. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters provided: a, the discharge does not cause the loss of more.-than 10 acres of waters of the United States; ,' -2- b. the permittee notifies the District Engineer if the discharge would cause the loss of waters of the United States greater than one acre in accordance with the "Notification" general condition. For discharges in special aquatic-sites, including wetlands, the notification must also include a delineation of affected specific aquatic sites, including wetlands; and c. the discharge, including all attendant features, both temporary and permanent, is part of a single and complete project. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization., If during the 2 years, the nationwide permit authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit will remain authorized provided the'activity is completed within 12 months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization. A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 26. The permitted fill is near the Hwy. 210 side of the property. Catfish ponds are not to be drained to surface waters without prior DEM approval. " Assistant Director cf DATE: October 27, 1992 SUBJECT: Division of Environmental Management 401 Water Quality Certification Review for Mr. Joe Syfrett, Jr., Pond Construction, Bladen/Cumberland County line off NC 210 HWY, North Carolina. The North Carolina Wildlife Resources Commission (NCWRC) has completed a review of the proposed project and evaluated possible impacts on fisheries, wildlife, and wetland resources in the project area. A site inspection was conducted on October 21, 1992. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.), Section 401-b of the Clean Water Act of 1977 (as amended), and North Carolina General Statutes (G.S. 113- 131 et seq.). Mr. Joe Syfrett, Jr. is requesting permit authorization to construct 3 ponds, each 35 feet x 300 feet, in 404 wetlands on his property in Bladen County near Elizabethtown. The ponds will be used for aquacultural purposes. Mr. Syfrett justifies the proposed pond construction and concomitant loss of Carolina Bay wetlands on the fact that "the higher water table in the area would insure that the ponds would not dry up during the summer dry season" and that it "would mean less soil would have to be removed to reach the water table". After careful review of the application, there is some confusion regarding question #11. The application states that 3 ponds, each 35 feet x 300 feet with a total impact of 0.72 acres, will be constructed at the proposed site. However, question #11 IMO TO: John Dorney Page 2 October 27, 1992 states that a total of 3 acres of wetlands will be excavated during the project. Either additional, unidentified work is planned or there has been some mistake concerning computation of the total acreage of wetlands to be impacted by the project. This discrepancy should be clarified before proceeding further with the application. We also feel Mr. Syfrett should be informed that ponds constructed near or in Carolina Bay habitat suffer from very poor water quality, primarily in the form of low pH water. Ponds receiving runoff from this habitat type usually have a pH somewhere between 3 and 4, which is very acidic and not conducive to fish production. Mr. Syfrett may want to consider relocating the ponds in another area which does not receive drainage from a Carolina Bay. Based on the loss of an unknown acreage of Carolina Bay wetlands and associated potential impacts to wildlife resources, we recommend that water quality certification for the proposed project be denied. However, if certification is not withheld, then we recommend that all spoil material be deposited outside wetlands.
