GENERAL CERTIFICATION FOR PROJECTS ELIGIBLE
FOR CORPS OF ENGINEERS NATIONWIDE PERMIT NUMBER 26 (HEADWATERS
AND ISOLATED WETLANDS)
This General Certification is issued in conformity with the
requirements of Section 401, Public Laws 92-500 and 95-217 of the
United States and subject to the North Carolina Division of Envi-
ronmental Management Regulations in 15A NCAC 2H, Section .0500
and 15A NCAC 2B .0109 and .0201 for the discharge of fill mate-
rial to navigable waters and adjacent wetland areas which are
above the headwaters or to wetland areas that are not a part of
the surface tributary system to interstate waters or navigable
waters of the United States (i.e., isolated wetlands) as
described in 33 CFR 330 Appendix A (B) (26) of the Corps of Engi-
neers regulations (i.e., Nationwide Permit No. 26).The category
of activities shall include any fill activity in these headwaters
and isolated wetland and water areas where the activity does not
result in the loss or substantial modification of 10 acres or
more of waters of the United States, including wetlands. This
Certification replaces Water Quality Certification Number 2176
issued on November 5, 1987.
The State of North Carolina certifies that the specified
category of activity will not violate Sections 301, 302, 303, 306
and 307 of the Public Laws 92-500 and 95-217 if conducted in
accordance with the conditions hereinafter set forth.
Conditions of Certification:
1. Proposed fill or substantial modification of greater than
one-third of an acre of such waters, including wetlands,
requires a written concurrence from the Division of Envi-
ronmental Management.
2. Proposed fill or substantial modification of equal to or
less than one-third of an acre of such waters, including
wetlands, does not. require written concurrence from the
Division of Environmental Management.
3. Proposed fill of greater than one acre in SA, trout,
HQW, ORW, WS-I and WS-II watersheds requires public
notice and an individual 401 Certification from the Divi-
sion of Environmental Management;
4. That established sediment and erosion control practices
are utilized to prevent violations of the appropriate
turbidity water quality standard (50 NTUs in streams and
rivers not designated as trout waters by DEM; 25 NTUs in
all saltwater classes, and all lakes and reservoirs; 10
NTUs in trout waters);
5. That additional site-specific conditions may be added to
projects with greater than one-third of an acre impact
which are proposed under this Certification in order to
ensure compliance with all applicable water quality and
effluent standards;
6. Concurrence from DEM this Certification applies to an
individual project shall expire three years from the date

Dear Mr. Dorney:
You are aware of the Burlington City Schools project for their new elementary
school as it relates to some "wetlands" crossings and fill at the subject
site. As a part of,the various approvals, the Burlington City Schools received
a Special Use Permit from the City of Burlington for construction of the
project. One of the conditions of the special use permit was that the
Burlington City Schools install an 8 ft. high fence along their entire western
property line.
After approval, there were some concerns raised by us and the Burlington City
Schools regarding this fence crossing the previously identified wetlands in
that area and the possible impact of the clearing and crossing relating to this
installation. The City of Burlington Planning Staff has indicated that if
there are some environmental concerns for not crossing the wetlands with the
fence, they would consider recommending that the fence stop at the wetlands
along the western property line.
I would request that you review this matter and advise me if you have a concern
relating to this condition of the Special Use Permit. Your early response
would be most appreciated.

8. PROJECT SUMIVIARY: The applicant proposes to construct a single family
residence on his property located adjacent to the AIWW. The majority of the lot has
been designated as Corps jurisdiction. The project is located within an ORW AEC.

9. PROJECT DESCRIPTION
The project consists of a single family lot located within Golden Acres Subdivision.
The AIWW is located adjacent to the property. The lot measures approximately 105'
wide at the road and is approximately 310' long. As stated above, the majority of the
lot has been designated as Corps of Engineers "404" wetlands. Adjacent to the AIWW
the property is vegetated with mixed coastal high marsh fringed with smooth
cordgrass. There is a mound of relic fill material which measures approximately 60'
long x 20' wide located within these wetlands. There is a ditch located along the
eastern property line which allows the wetland area to extend toward the existing
road. The adjacent waters are classified as SA and g_rg men to shellfishing. The
waters =r designated as a primary nursery area(PNA).
The applicant is proposing to construct a residence with driveway on the property.
The drive will be approximately 75' long x 12' wide. The house will be
approximately 30' x 30'. In order to compensate for the marginal wetlands which will
be impacted the applicant is proposing to remove the 60' x 20' fill area and will
truck the material to an approved high ground site.
10. ANTICIPATED IMPACTS
Provided that the structures are constructed as proposed and that the fill is removed as
indicated no significant adverse impacts are anticipated. The proposed project will
create approximately 1830 sf of built upon surface within the ORW AEC.

The Application provides adequate assurance that the
discharge of fill material into the waters of wetlands near the
AIWW in conjunction with the proposed lot fill in Onslow County
will not result in a violation of applicable Water Quality
Standards and discharge guidelines. Therefore, the State of
North Carolina certifies that this activity will not violate
Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if
conducted in accordance with the application and conditions
hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner as
to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the Stream is 25 NTU's or less are
not considered significant).
2. That the 60' x 20' dirt mound to be removed be
graded to the elevation of the adjacent salt marsh
and stabilized to prevent erosion.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the
above conditions are made conditions of the Federal Permit.

Dear Dr. Wright:
I am respectfully asking for your urgent attention to the circumstances surrounding
the building of the new elementary school. We need approval to immediately proceed with
the clearing and grading of property in order to erect a new school which will accommodate
over 600 students. This is a very important health and safety issue, because the existing
sixty-one-year-old school building has some serious problems associated with its continued
use with children. Three months ago a large portion of ceiling fell in on a kindergarten
classroom only 10 minutes after the 25 children had departed. We have other safety
concerns associated with the structure, including vastly overcrowded conditions.
The only immediate delay in the construction of the new school is the approval of
the use of a small portion of the new school property identified as wetlands.
As school superintendent, I respectfully request a very prompt response to our
problem. The issue of timing is very important in the construction schedule.

Dear Mr. Sinclair:
Please reference the meeting of March 5, 1992, between Mr. John Thomas of
my staff and Mr. Nelson Paul of Environmental Consultants & Permit Specialists
(consultant for site) onsite of the proposed new elementary school site
located off Davis and Harriet Streets adjacent to unnamed tributaries of
Little Alamance Creek, Burlington, Alamance County, North Carolina. The
purpose of the site visit was to discuss plans for the aforementioned project,
and review wetland jurisdiction delineations for the site. This letter also
confirms the June 5, 1992, wetlands survey verification of the aforementioned
wetland delineation review.
Based upon previous onsite inspections and review of the aforementioned
survey, we recognize this surveyed alignment to be the limits of our
regulatory jurisdiction on the property. Unless there is a change in the law
or our published regulations, this determination of the limits of wetlands may
be relied upon for a period not to exceed 3 years.
The site visit of March 5, 1992 revealed the proposed site is adjacent to
two unnamed/above headwaters tributaries of Little Alamance Creek. Reference
is also made to your letter of May 22, 1992, where you requested Department of
the Army authorization to discharge fill (PDN application) within these
aforementioned delineated jurisdictional wetlands. The review of the request
indicates you propose adverse modification to approximately 1.96 acres of
Section 404 jurisdictional waters of the United States.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits.
Authorization was provided, pursuant to Section 404 of the Clean Water Act,
for discharges of dredged or fill material into headwaters and isolated waters
provided:
a. The discharge does not cause the loss of more than 10 acres of waters
of the United States;

b. The permittee notifies the District Engineer if the discharge would
cause the,loss of waters of the United States greater than one acre in
accordance with the "Notification" general condition. For discharges in
special aquatic sites, including wetlands, the notification must also include
a delineation of affected specific aquatic sites, including wetlands; and
c. The discharge, including all attendant features, both temporary and
permanent, is part of a single and complete project.
Your proposed work, involving adverse modification to 1.96 acres of waters
of the United States located above the headwaters of the aforementioned
tributary, is authorized by nationwide permit (NWP) provided it is
accomplished in strict accordance with the enclosed conditions. Please be
aware that this authorization does not relieve you of the responsibility to
obtain any other required or local approval. You should contact Mr. John
Dorney, North Carolina Division of Environmental Management, (919) 733-5083,
to obtain the necessary Section 401, Water Quality Certification prior to
starting work.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the NWP authorization is reissued without modification or the activity
complies with any subsequent modification of the NWP authorization. If during
the 2 years, the NWP authorization expires or is suspended or revoked, or is
modified, such that the activity would no longer comply with the terms and
conditions of the NWP authorization, activities which have commenced (i.e.,
are under construction) or are under contract to commence in reliance upon the
NWP will remain authorized provided the activity is completed within 12 months
of the date of the NWP's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,
suspend, or revoke the authorization.
Please be reminded that no excavated or fill materials may be placed in
any waters or wetland areas without prior Federal permit authorization. Please
contact this office for any further proposed impacts in any water or wetland
areas subject to Department of the Army permitting authority.
