Upon review of your request for Water Quality Certification
to place fill material in 400 square feet of water for
boat ramp construction located at Batchelor Bay subdivision in
Bertie County, we have determined that the proposed fill can be
covered by General Water Quality Certification No. 2663 issued
January 21, 1992. A copy of the General Certification is
attached. This Certification may be used in qualifying for
coverage under Corps of Engineers' Nationwide Permit No. 36. An
additional condition is that 401 Certification must be obtained
form the Division of Environmental Management for any activity
authorized by the U.S. Army Corps of Engineers under Nationwide
Permit 14 or 26 (greater than one-third of an acre).

8. PROJECT SUMMARY: The applicant is proRgsing to develop a 22.0 acre, 30 lot,
subdivision adjacent to Batchelor Bay in Bertie County.

Environmental setting
The applicant owns a 217.5 acre tract of land in the Merry Hill community, east
of NC 45 and adjacent to the Albemarle Sound in Bertie County. The majority of
the property is being used for agricultural practices, mainly row crops. A
portion of the property consists of a large wetland system (Morgan Swamp) which
enters the property near the eastern property line. The wetland system is
vegetated with cypress, various species of gums and other wetland adapted trees.
Upland wooded areas vegetated by various species of oaks and other hardwood trees
were present on much of the property between the agricultural fields and wooded
swamp. The majority of these areas have been timbered within the past year in
preparation of the subdivision development. The applicants property extends
approximately 1,800' along Bachelor Bay. The shoreline at the normal water line
(NWL) varies from ±8.0' to ±20.0' in elevation. Most of the area is covered by
natural vegetation which has somewhat retarded erosion. Most of the area at the
top of the bluffs from the edge extending landward at some locations up to ±100'
was vegetated by hardwood forest. This area has also been timbered in
preparation of the subdivision development.
Project proposal
The applicant is proposing the following:
1) The development of a 22 acre subdivision on the property. The entire
development other than the access road from NC 45 will be located within
an area ±600' landward of the NWL along the ±1800' of shoreline of
Bachelor Bay. Thirty (30) lots will be developed for single family
residences. No multifamily units will be developed. Each residence will
be served by a septic tank sewage disposal system, however a community
potable water system is to be installed for the entire development.
Details on that system are presently being finalized.
2) A portion of the lot preparation for the development will consist of
extensive removal of the high bluffs at the NWL. Lot No.'s 4, 5, 6, 7, 8,
9 and portions of 10 and 11 will require the removal of the bank from 40'
to 60' northwardly to achieve a desired 5:1 slope. Also it will be
necessary to remove some of the bank on Lots 12 thru 15 but with much less
severity as the previously mentioned lots. Lots 1 thru 3 will require
slight stumping and grading. The applicant hopes to achieve a 5:1 slope
along the entire shoreline when the grading is completed. No bulkheads
are proposed at this time. Erosion will be controlled by silt fences,
mulching and seeding. All of this shoreline sloping is shown on attached
plots.
3) A portion of the property adjacent to Morgan Swamp has been established by
the applicant as a corgi€3uuni y lot, on which will be located a concrete
boatramp which will hcve:a w.dth of 16.0' and a total length of 42.0' of
which 25.0' will exterld ne'cad the NWL. A 4.0' wide by 29'.6" pier will
be located on each side of the ramp. 25.0' of the pier will extend beyond
the NWL. A groin the same length of the piers will be attached to the
piers in an attempt to keep sand off of the ramp. A gravel access road
will provide access to the ramp. Also a ±230.0' long by ±60.0' wide
gravel turn area will also be provided. Silt fences will be placed
between the disturbed areas and Morgan Swamp.
Environmental impacts
Environmental impacts will be as follows:
1) Upland wildlife habitat has either already been modified or will be
further modified as the subdivision is developed.
2) No wetland vegetation will be excavated or filled. No development is
proposed within the Morgan Swamp system.
3) Severe erosion potential is present during the sloping of the bluffs if
proper sedimentation and erosion control measures are not adheared to.
This erosion could result in fill being deposited beyond the NWL of
Bachelor Bay.
4) Approximately 4.8 cubic yards of fill (concrete) will be placed beyond the
NWL of Bachelor Bay as a result of boatramp construction. Also ±460 cubic
yards of material will be excavated near or beyond the NWL as a result of
sloping the area for the boatramp placement.
5) Two small areas of wetlands have been authorized to be filled under COE
Nationwide Permits No. 14 and 26 in the area of the access road which
extends from NC 45 to the development.

U.S. Army Corps of Engineers regarding that agency's

of plat requirements and it must be sufficiently detailed
to guide agency personnel unfamiliar with the area to the
site. Include county road (SR) numbers, landmarks, and
the like.

Shore Line Excavation
Not all sections along the shore line will
require extensive removel of steep banks. Lots
1, 2 and 3 will primarily require stumping and
grading only. Lots 4, 5, 6, 79 8, 9, and parts
of 10 and 11'. will require removel of the steep
bank from 40 to 60 feet northwardly to acheive
a 5 to 1 slope. It will probably be necessary
to remove some of the bEnk along lots 12 through
15 but with much less severity as lots 4 through
12. This section can primarily be stumped and
graded to acheive the desired slope.
Upon the completion of each section or
lot the graded area will be fertilized and seed-
ed according to the attached prescription by the
S.C.S. office.

mark for the length of the disturbance.

8. PROJECT SUMMARY: The applicant is pro op_sing to develop a 22.0 acre, 30 lot,
subdivision adjacent to Batchelor Bay in Bertie County.
tviromental setting
The applicant owns a 217.5 acre tract of land in the Merry Hill community, east
of NC 45 and adjacent to the Albemarle Sound in Bertie County. The majority of
the property is being used for agricultural practices, mainly row crops. A
portion of the property consists of a large wetland system (Morgan Swamp) which
enters the property near the eastern property line. The wetland system is
vegetated with cypress, various species of gums and other wetland adapted trees.
Upland wooded areas vegetated by various species of oaks and other hardwood trees
were present on much of the property between the agricultural fields and wooded
swamp. The majority of these areas have been timbered within the past year in
preparation of the subdivision development. The applicants property extends
approximately 1,800' along Bachelor Bay. The shoreline at the normal water line
(NWL) varies from ±8.0' to ±20.0' in elevation. Most of the area is covered by
natural vegetation which has somewhat retarded erosion. Most of the area at the
top of the bluffs from the edge extending landward at some locations up to ±100'
was vegetated by hardwood forest. This area has also been timbered in
preparation of the subdivision development.
Project proposal
The applicant is proposing the following:
1) The development of a 22 acre subdivision on the property. The entire.
development other than the access road from NC 45 will be located within
an area ±600' landward of the NWL along the ±1800' of shoreline of
Bachelor Bay. Thirty (30) lots will be developed for single family
residences. No multifamily units will be developed. Each residence will
be served by a septic tank sewage disposal system, however a community
potable water system is to be installed for the entire development.
Details on that system are presently being finalized.
2) A portion of the lot preparation for the development will consist of
extensive removal of the high bluffs at the NWL. Lot No.'s 4, 5, 6, 7, 8,
9 and portions of 10 and 11 will require the removal of the bank from 40'
to 60' northwardly to achieve a desired 5:1 slope. Also it will be
necessary to remove some of the bank on Lots 12 thru 15 but with much less
severity as the previously mentioned lots. Lots 1 thru 3 will require
slight stumping and grading. The applicant hopes to achieve a 5:1 slope
along the entire shoreline when the grading is completed. No bulkheads
are proposed at this time. Erosion will be controlled by silt fences,
mulching and seeding. All of this shoreline sloping is shown on attached
plots.
3) A portion of the property adjacent to Morgan Swamp has been established by
the applicant as a community lot, on which will be located a concrete
boatramp which will have a width of 16.0' and a total length of 42.0' of
which 25.0' will extend beyond the NWL. A 4.0' wide by 29'.6" pier will
be located on each side of the ramp. 25.0' of the pier will extend beyond
the NWL. A groin the same length of the piers will be attached to the
piers in an attempt to keep sand off of the ramp. A gravel access road
will provide access to the ramp. Also a ±230.0' long by ±60.0' wide
gravel turn area will also be provided. Silt fences will be placed
between the disturbed areas and Morgan Swamp.
nvironmental impacts

Environmental impacts will be as follows:
1) Upland wildlife habitat has either already been modified or will be
further modified as the subdivision is developed.
2) No wetland vegetation will be excavated or filled. No development is
proposed within the Morgan Swamp system.
3) Severe erosion potential is present during the sloping of the bluffs if
proper sedimentation and erosion control measures are not adheared to.
This erosion could result in fill being deposited beyond the NWL of
Bachelor Bay.
4) Approximately 4.8 cubic yards of fill (concrete) will be placed beyond the
NWL of Bachelor Bay as a result of boatramp construction. Also ±460 cubic
yards of material will be excavated near or beyond the NWL as a result of
sloping the area for the boatramp placement.
5) Two small areas of wetlands have been authorized to be filled under COE
Nationwide Permits No. 14 and 26 in the area of the access road which
extends from NC 45 to the development.

Shore Line Excavation
Not all sections along the shore line will
require extensive removel of steep banks. Lots
1, 2 and 3 will primarily require stumping and
grading only. Lots 4, 51 6, 7, 8, 9, and parts
of 10 and 11 will require removel of the steep
bank from 40 to 60 feet northwardly to acheive
a 5 to 1 slope. It will probably be necessary
to remove some of the bunk along lots 12 through
15 but with much less severity as lots 4 through
12. This section can primarily be stumped and
graded. to acheive the desired slope.
Upon the completion,of each section or
lot the graded area will be fertilized and seed-
ed according to the attached prescription by the
S.C.S. office.
The silt fence will be established and
maintained along and just above the high water
mark for the entire length of the disturbance.

not-be used.
c. No attempt will be made by the permittee to prevent the full and free
use by the public of all navigable waters at or adjacent to the authorized
work. Use of the permitted activity must not interfere with the public's
right to free navigation on all navigable waters of the United States.
d. The .permittee will maintain the authorized work in good condition and
in conformance with the terms and conditions of this permit., The permittee is
not relieved of this requirement if he abandons the permitted activity without
having it transfered to a third party.

boatramp facility with pier and jetty on Albemarle Sound, Batchelor Bay, Merry
Hill, Bertie County, North Carolina. Your receipt of this letter verifies
your acceptance of a valid request for certification in accordance with
Section 325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification may be required under the provisions of Section 401 of the same
law. A Department of the Army permit will not be granted until the
certification has been obtained or waived.
In accordance with our administrative regulations, 60 days after receipt
of a request for certification is a reasonable time for State action.
Therefore, if you have not acted on the request by July 20, 1992, the District
Engineer will deem that waiver has occurred.

old existing road bed had created a small darn holding water in a gurn 'wet-
land -- To entrap this water and to maintain it's present level a 12"

Shore Line Excavation
Not all sections along the shore line will
require extensive removel of steep banks. Lots
1, 2 and 3 will primarily require stumping and
grading only. Lots 4, 5, 69 7, 8, 9, and parts
of 10 and 11'. will require removel of the steep
bank from 40 to 60 feet northwardly to acheive
a 5 to 1 slope. It will probably be necessary
to remove some of the bank along lots 12 through
15 but with much less severity as lots 4 through
12. This section can primarily be stumped and
graded to acheive the desired slope.
Upon the completion.of each section or
lot the graded area will be fertilized and seed-
ed according to the attached prescription by the
S.C.S. office.
The silt fence will be established and
maintained along and just above the high water
mark for the entire length of the disturbance.

8. PROJECT SUMMARY: The applicant is proposing, to develop a 22.0 acre, 30 lot,
subdivision adjacent to Batchelor Bay in Bertie County.
Environmental setting

The applicant owns a 217.5 acre tract of land in the Merry Hill community, east
of NC 45 and adjacent to the Albemarle Sound in Bertie County. The majority of
the property is being used for agricultural practices, mainly row crops. A
portion of the property consists of a large wetland system (Morgan Swamp) which
enters the property near the eastern property line. The wetland system is
vegetated with cypress, various species of gums and other wetland adapted trees.
Upland wooded areas vegetated by various species of oaks and other hardwood trees
were present on much of the property between the agricultural fields and wooded
swamp. The majority of these areas have been timbered within the past year in
preparation of the subdivision development. The applicants property extends
approximately 1,800' along Bachelor Bay. The shoreline at the normal water line
(NWL) varies from ±8.0' to ±20.0' in elevation. Most of the area is covered by
natural vegetation which has somewhat retarded erosion. Most of the area at the
top of the bluffs from the edge extending landward at some locations up to ±100'
was vegetated by hardwood forest. This area has also been timbered in
preparation of the subdivision development.
Project proposal
The applicant is proposing the following:
1) The development of a 22 acre subdivision on the property. The entire
development other than the access road from NC 45 will be located within
an area ±600' landward of the NWL along the ±1800' of shoreline of
Bachelor Bay. Thirty (30) lots will be developed for single family
residences. No multifamily units will be developed. Each residence will
be served by a septic tank sewage disposal system, however a community
potable water system is to be installed for the entire development.
Details on that system are presently being finalized.
2) A portion of the lot preparation for the development will consist of
extensive removal of the high bluffs at the NWL. Lot No.'s 4, 5, 6, 7, 8,
9 and portions of 10 and 11 will require the removal of the bank from 40'
to 60' northwardly to achieve a desired 5:1 slope. Also it will be
necessary to remove some of the bank on Lots 12 thru 15 but with much less
severity as the previously mentioned lots. Lots l thru 3 will require
slight stumping and grading. The applicant hopes to achieve a 5:1 slope
along the entire shoreline when the grading is completed. No bulkheads
are proposed at this time. Erosion will be controlled by silt fences,
mulching and seeding. All of this shoreline sloping is shown on attached
plots.
3) A portion of the property adjacent to Morgan Swamp has been established by
the applicant as a community lot, on which will be located a concrete
boatramp which will have a width of 16.0' and a total length of 42.0' of
which 25.0' will extend beyond the NWL. A 4.0' wide by 29'.6" pier will
be located on each side of the ramp. 25.0' of the pier will extend beyond
the NWL. A groin the same length of the piers will be attached to the
piers in an attempt to keep sand off of the ramp. A gravel access road
will provide access to the ramp. Also a ±230.0' long by ±60.0' wide
gravel turn area will also be provided. Silt fences will be placed
between the disturbed areas and Morgan Swamp.
Environmental impacts

Environmental impacts will be as follows:
1) Upland wildlife habitat has either already been modified or will be
further modified as the subdivision is developed.
2) No wetland vegetation will be excavated or filled. No development is
proposed within the Morgan Swamp system.
3) Severe erosion potential is present during the sloping of the bluffs if
proper sedimentation and erosion control measures are not adheared to.
This erosion could result in fill being deposited beyond the NWL of
Bachelor Bay.
4) Approximately 4.8 cubic yards of fill (concrete) will be placed beyond the
NWL of Bachelor Bay as a result of boatramp construction. Also ±460 cubic
yards of material will be excavated near or beyond the NWL as a result of
sloping the area for the boatramp placement.
5) Two small areas of wetlands have been authorized to be filled under COE
Nationwide Permits No. 14 and 26 in the area of the access road which
extends from NC 45 to the development.

Shore Line Excavation
Not all sections along the shore line will
require extensive removel of steep banks. Lots
1, 2 and 3 will primarily require stumping and
grading only. Lots ¢, 59 69 79 81 9, and parts
of 10 and 11 will require removel of the steep
bank from ¢0 to 60 feet northwardly to acheive
a 5 to 1 slope. It will probably be necessary
to remove some of the bank along lots 12 through
15 but with much less severity as lots ¢ through
12. This section can primarily be stumped and
graded. to acheive the desired slope.
Upon the completion.of each section or
lot the graded area will be.f ertilized and seed-
ed according to the attached prescription by the
S.C.S. office.
The silt fence will be established and
maintained along and just above the high water
mark for the entire length of the disturbance.

construct a boatramp facility with pier and jetty on Albemarle Sound,
Batchelor Bay, Merry Hill, Bertie County, North Carolina.

provisions and objectives of general permit No. CESAW-C080-N-000-0291.
Therefore, you may commence construction activity in strict accordance with
applicable State authorization and the enclosed plan. Failure to comply with
the State authorization or conditions of the general permit could result in
civil and/or administrative penalties.
If any change in your work is required because of unforeseen or altered
conditions or for any other reason, plans revised to show the change must be
sent promptly to this office and the North Carolina Division of Coastal
Management prior to performing any such change or alteration. Such action is
necessary as revised plans must be reviewed and the authorization modified.
