Hamilton nt,GAwv?u, t3•14W'D Assistant Director SUBJECT: Comments on Section 401 Water Quality Certification for Section 404 Nationwide Permit Requests (DEM ID:92600- 92605), Indigo Plantation, Southport, Brunswick County. Biologists on the North Carolina Wildlife Resources Commission (NCWRC) staff have reviewed the applications listed and are familiar with habitat values of the project area. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). Based upon information provided, it is our opinion that Section 401 Water Quality Certification cannot be issued without impacts to fish and wildlife. Owners Graham, Wise, Burgess, Benford et al, and Barnes are requesting 401 certification under NWP 18 to fill and construct homes on 6 lots of the Indigo Plantation subdivision. All of the lots have been identified as 404 wetlands. The NCWRC is concerned with the cumulative impacts that continued development and the subsequent destruction of wetland resources have within the project area. From a site visit conducted on November 25, 1992, it is evident that previous construction in and adjacent to Indigo Plantation has negatively impacted the entire wetland community. It is NCWRC policy to oppose proposals directly or indirectly resulting in further degredation of wetlands or aquatic resources. Proposals advocation filling of wetlands or productive aquatic habitat for the purpose of creating high ground.for development is highly detrimental to those resources and any required permit authorization will receive a recommendation for denial unless the project has significant public benefits and all wetlands or aquatic habitat impacts are fully mitigated. On January 16 and April 2, 1992, you met onsite with Mr. Tom Morgan, Brunswick Surveying; Mr. Rob Moul, Land Management Group; and Mr. Rudolf Schiener and Mr. Ernest Jahnke of my staff. Again, on November 2, 1992, you and Mr. Rob Moul met onsite with Mr. Jahnke to determine U.S. Army Corps of Engineers' (USACE) regulatory jurisdiction relative to the provisions of Section 404 of the Clean Water Act on portions of the Indigo Plantation residential development located adjacent to the Atlantic Intracoastal Waterway, Dutchman Creek, and Cottage Creek in Southport, Brunswick County, North Carolina. This letter supersedes the information (except the data sheets) contained in our letter dated June 11, 1992 and refers to the final plat dated August, 1992, of the surveyed 404 wetland line on this property. Unless otherwise indicated, jurisdiction decisions have been made in accordance with the criteria set forth in the 111987 Corps of Engineers Wetlands Delineation Manual" and may be relied upon for a period of 3 years from the date of this letter. If development activity has not been completed by that date, these determinations may be subject to re-review under the regulatory conditions and wetland manual criteria effective at that time. Department of the Army permit authorization must be obtained prior to placing fill material in Federally regulated wetlands. Below is a summary of the field determinations and our regulatory positions as discussed in the follow-up meeting in the District office on the afternoon of January 16, 1992, between Mr. Morgan, representing Indigo Plantation, Ms. Brooke Lamson, Assistant District Counsel, Mr. Schiener, Mr. Jahnke, and me: a. Area 4 (bounded on the west by Indigo Plantation Road and on the south by Cottage Creek Road) - as stated in our letter of August 28, 1984, the wetlands in this area were considered isolated and will be eligible for Nationwide Permit No. 26 authorization of fill discharges until August 14, 1992, pursuant to Regulatory Guidance Letter 90-6 (copy enclosed). This applies only to the described area, as explained to Mr. Morgan; it does not affect jurisdictional calls, including adjacency determinations, on other areas of the property. In this respect, Mr. Morgan is pursuing permit approval where necessary on behalf of the property owners. -2- The surveyed line accurately reflects the location of the wetland-high ground interface on Lots Nos. 42, 43, 44, 45, 49, 50, and 51. b. Parcel B, survey points from line 501 westward to line 313 with closure continuing from points 3857 ascending through 3869 west to survey point 272 - this section was preliminarily approved in late 1988 by Mr. Jahnke accompanied by Mr. Morgan. (Please note that the plat incorrectly states that this line was approved in 1984.) The surveyed line (with mutually agreed-upon adjustments between points 3857 to 3859) accurately represents the wetland-high ground interface in this area. C. We accept the December, 1984, 404 wetland line between points 272 and L536 on Lots Nos. 29, the common area, 30, and 31 until August 14, 1992. This line had been given our verbal approval and lot configurations were changed on that basis. d. Spartina Court - Based on our April 11, 1988, letter, there are no wetlands above the tidal marsh line for Lots Nos. 75, 76, 77, 78, and 79. This determination will be valid until August 14, 1992. e. Lots Nos. 81 and 82 - survey points from 1697 ascending through 1703 accurately reflect the wetland high-ground interface in this area. .f. Lots Nos. 83 through 91 inclusive from survey point 1668 ascending through 1694 - the survey line accurately reflects the wetland-high ground interface in this area. g. Parcel D - the survey line accurately reflects the location of the wetland-high ground interface between survey points 1596 ascending through 1612 west. Our position is that these wetlands in Parcel D are adjacent. h. We accept the surveyed 1987 Manual line delineated in January 1992 and April 1992 as the 404 wetland line between survey point AA (Lot No. 28) and west to survey point CF (Lot No. 12). i. The surveyed line around the freshwater pond in the common area between Lots Nos. 8 and 9, accurately represents the 404 wetland-high ground interface between survey points Z1 and Z24 (with closure). Our determination is that this wetland is isolated. j. The survey of the limits of the Carolina Bay in the area of Lots Nos. 46, 47, 48, 51, 52, and the common area from points 240 through 265 and continuing to point 3979 ascending to 4025 with closure acurately reflects the limits of 404 wetlands of this isolated area. -3- k. We accept the surveyed 1987 Manual line verified in April, 1992, from survey points 20 (line 385) through 52 (line 415). (Please note that this verification occurred in April, not January as indicated on the plat.) To summarize, the August 1992 survey plat of the wetland delineation accurately reflects the limits of the USACE regulatory jurisdiction on the Indigo Plantation property with the exception of the lots discussed in paragraphs a., c., and d. above. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits (NWP). Authorization, pursuant to Section 10 of the Rivers and Harbors Act and Section 404 of the Clean Water Act, was provided for discharges of dredged or fill material into all waters of the United States under Nationwide Permit No. 18 (NWP 18) provided: a. The discharge does not exceed 25 cubic yards; b. The discharge will not cause the loss of more than 1/10 acre of a special aquatic site, including wetlands. For the purposes of this NWP, the acreage limitation includes the filled area plus special aquatic sites that are adversely affected by flooding and special aquatic sites that are drained so that they would no longer be a water of the United States as a result of the project; c. If the discharge exceeds 10 cubic yards or the discharge is in a special aquatic site, including wetlands, the permittee notifies the District Engineer in accordance with the "Notification" general condition. For discharges in special aquatic sites, including wetlands, the notification must also include a delineation of affected special aquatic sites, including wetlands' and; d. The discharge, including all attendant features, both temporary and permanent, is part of a single and complete project and is not placed for the purpose of stream diversion. ;?-, -2- For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists NWP's. Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was provided under Nationwide Permit No. 14 (NWP 14) for fills for roads crossing waters of the United states (including wetlands and other special aquatic sites) provided: a. The width of the fill is limited to the minimum necessary for the actual crossing; b. The fill placed in waters of the United States is limited to a filled area of no more than 1/3 acre. Furthermore, no more than a total of 200 linear feet of the fill for the roadway can occur in special aquatic sites, including wetlands; c. The crossing is culverted, bridged or otherwise designed to prevent the restriction of, and to withstand, expected highflows and the movement of aquatic organisms; d. The crossing, including all attendant features, both temporary and permanent, is part of a single and complete project for crossing of a water of the United States; and e. For fills in special aquatic sites, including wetlands, the permittee notifies the District Engineer in accordance with the "Notification" general condition. Your work is authorized by this NWP provided it is accomplished in strict accordance with the enclosed conditions. This NWP does not relieve you of the responsibility to obtain any required State or local approval. If during the 2 years, the NWP authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the NWP authorization, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the NWP will remain authorized provided the activity is completed within 12 months of the date of the NWP's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization. Professional staff biologists with the North Carolina Wildlife Resources Commission (NCWRC) have reviewed the subject Permit Application and are familiar with habitat values associated with the proposed project area. An on- site investigation was conducted on June 18, 1992 for the purpose of further assessing construction impacts on fisheries, wildlife, and wetland resources. These comments are provided in accordance with provisions.of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.), the Clean Water Act of 1977 (as amended), and North Carolina General Statutes (G.S. 113-131 et seq.). The applicants, Mr. and Mrs. Richard Booth, are requesting permit authorization to place fill material in 404 wetlands adjacent to the Atlantic Intracoastal Waterway (AIWW) on their property at Indigo Plantation, Southport, NC. The proposed work is to provide high ground for construction of a home and driveway access. Dominant vegetation at the proposed project site includes: black needlerush (Juncus roemerianus), wax myrtle (Myrica cerifera), catbriar (Smilax bona-nox), red bay (Persea borbonia), eastern red cedar (Juniperus virginiana), and American holly (Ilex opaca). We have determined the proposed project is inconsistent with NCWRC Policies and Guidelines for Wetlands and Aquatic Habitat Conservation. It is NCWRC policy to oppose proposals directly or indirectly resulting in further degradation of wetlands or aquatic resources. Proposals advocating filling of wetlands or productive aquatic habitat for the purpose of creating high ground for development are opposed by the NCWRC and any required permit authorization will receive a recommendation for denial unless the proposed project has significant public benefits, and, all wetlands or aquatic habitat impacts are fully mitigated. We would concur with issuing a permit for the proposed project provided the following modifications are implemented; (1) All construction activity take place outside the CAMA AEC wetlands area. (2) No heavy equipment should be allowed to operate within any wetlands associated with the AIWW nor should any fill material be placed in the CAMA AEC wetlands area. (3) Silt fences should be erected prior to construction to prevent sediment reentry into adjacent waters and to prevent any adverse impacts to the water quality and fisheries resources of the AIWW and the adjacent wetlands. The applicants in this case are not proposing to cross a water of the United States, rather they are proposing to construct a driveway to the interior of a lot, all of which has been determined to be jurisdictional wetlands. The applicants are also proposing to use Nationwide Permit #18 and spread 25 cubic yards of fill material over 3,245 sq. ft., resulting in fill approximately 2" deep. With the water table at or near the surface as it is on this site 2" of fill material will not be sufficient to render the site a non-wetland. Charlie Hollis has also stated that the applicants propose to pour a concrete slab under the pile supported house. It would appear that such an activity would require an individual permit from the COE (exceedance of 25 cubic yards). The applicants are proposing to fill approximately 4,350 sq. ft. of adjacent 404 wetlands to allow the construction of a house and driveway on a lot that is entirely Coastal and 401 Wetlands. Such a proposal would remove the existing uses that these wetlands provide. The consultant for the applicant has also indicated the probability of similar requests on eight more lots at Indigo Plantation. It is for these reasons, as well as our objection to the use of Nationwide Permits for this project, that this Office recommends denial of the 401 Certification and CAMA Permit. These lots are not useable unless cleared and 1/10 acre is filled . The project has been reviewed to determine impacts to water quality. The following comments have been provided. As with the Richard and Cathy Booth project (92364), this Office objects' to the use of Nationwide 18 for these six projects. The placement of 25 cubic yards of fill material over a 4,356 sq. ft.' area would result in fill, approximately 1.8 inches deep. With the water table at or near the 'surface, this would not be sufficient depth to render the site a non-wetland. To be consistent with fill activities on similar lots at Indigo, these lots would require 1-3 feet of fill material to make the lots buildable. It is doubtful that impacts to these lots will be limited to 1/10 acre. It is likely to assume that the entire lots will be cleared, graded and planted with lawn grasses, thereby completely eliminating the existing uses that these wetlands currently provide.
