Ramsey Page two 9. PROJECT DESCRIPTION The project is located on the oceanfront of Bald Head Island at 1091 Sandspur Trail. Bald Head Island is a coastal barrier island located south of Fort Fisher and Corn Cake Inlet and north of the mouth of the Cape Fear River in Brunswick County. The island is accessed by private ferry from Southport. The waters of the Atlantic Ocean are classified SB by the N.C. Division of Environmental Management. The applicant owns six (6) continuous lots on Sandspur Trail, however, the project area consists only of Lot 1091, on which the applicant maintains his residence. The lot exhibits typical beach dune vegetation including sea oats, smilax, and yucca. An approximate four (4) foot erosion escarpment serves as the frontal dune on the ocean side of the project site. The erosion escarpment is remnant from hurricane Hugo in 1989, at which time, Division personnel reviewed the site for relocation, at the request of a previous owner, for qualification under the Upton/Jones Amendment of the Federal Emergency Management Act. At that time, the property did not meet the 25 feet criteria to qualify for Upton - Jones funding, as the erosion escarpment was located 36 to 38 feet from the structure's foundation, and the original escarpment was a nearly vertical 8-9 foot drop. The normal high tide was located 25 - 30 feet waterward of the erosion escarpment except during subsequent storm tides over the last two years which have eroded the escarpment an additional 3 feet since 1989. The escarpment was last measured by Division staff at 33 feet from the house foundation pilings on December 10, 1991. There are no primary dunes and no continuous dune system along the beach in this area of Bald Head Island. Phase I of the U.S. Army Corps of Engineers, Wilmington Harbor - Ocean Bar Channels Project, was completed in December 1991. The project had proposed the deposition of approximately 390,000 cubic yards of dredge spoil sands, 80 feet wide and 6 feet deep, along approximately 3,000 linear feet of the south beach at Bald Head Island. The resulting beach profile in front of the applicant's property was approximately 4.5 feet of sand deposition at the old escarpment line gradually sloping to below MLW. The old escarpment line is currently located approximately thirty-three (33) feet from the foundation of the residential structure. However, as a result of the recent beach renourishment project, mean high water has been pushed approximately 92 feet waterward of the old erosion escarpment line. The long-term annual erosion rate is 3 feet per year and the 100 year storm recession line is projected at 270 feet landward of the present shoreline. 4 Harvey G. Ramsey Page three 9. PROJECT DESCRIPTION - CONT. The applicant proposes to construct a sandbag bulkhead 100 feet long, 15 feet wide and 8 feet high along the base of the remnant erosion escarpment on the ocean side of his property. The application lists that the individual polyester sandbags would be 6 feet wide and 10 feet long. Given the proposed configuation of the sandbags, it is unclear how the applicant would maintain the proposed 15' project width. The base of the revetment would be buried approximately 3 feet below the present grade and would consist of two layers of sandbags, each three sandbags wide. The following layer would be stepped back to two sandbags, then a single row of sandbags would constitute the top layer resulting in a right angle triangle configuration. Ten (10) pilings would be installed, ten feet on center to secure the bulkhead on the ocean side. The applicant proposes to fill the sandbags by pumping sand from below mean low water, and then cover the entire structure by bulldozing sand from the beach. 10. ANTICIPATED IMPACTS The proposed project would disturb a total area of approximately 13,500 square feet of unvegetated (11,000 s.f.) and intertidal (2,500 s.f.) beach. There would be some short-term turbidity associated with the filling of sandbags with sand pumped from below MLW, as well as with the beach bulldozing activity. However no long-term adverse impacts of the ground disturbance are anticipated, as long as the beach bulldozing activity is limited to a timeframe outside of the seaturtle nesting and hatching season. The proposed sandbag bulkhead would consume approximately 1500 square feet of public trust area of the beach. Additionally, in the event of wave overwash during a storm, the structure would prevent the regression of waves. The trapped water would channel toward the open-ended design of the bulkhead creating accelerated erosion toward both ends of structure. Also, there is a significant body of scientific evidence that indicates a potential for adverse erosion-associated impacts to the beach profile and/or adjacent property as a result of the installation of oceanfront shoreline hardening structures. Should the applicant not remove the structure as proposed, in the event it becomes exposed or if adjacent shoreline erosion exceeds the landward position of the structure, these impacts would become evident. DAVIS rr? ? ? i?2 MAJOR CAMA PERMIT APPLICATION nrISI r2 F The enclosed permit application is sgbor&&d)`A?6 GLMEJ consideration under Subchapter 7H of the regulations adopted for the Coastal Management Program, and specifically 7H .0308(a)(1). .0308(a)(1)(A) states that alternative approaches to beach nourishment and relocation "will be allowed where the applicant can show that such measures are necessary to provide adequate protection." Beach nourishment, a preferred alternative, has recently been completed in front of the subject property. However, due to the extremely dynamic nature of Bald Head Island, the beach nourishment program is considered to have a very short life, and, in fact, may not survive a single major storm event. .0308(a)(1)(B) states that "Erosion controll structures which cause significant adverse impacts on the value and enjoyment of adjacent properties or public access to and use of the ocean beach are prohibited." As more fully set out herein, the enclosed application will neither cause significant adverse impacts on the value and enjoyment of adjacent properties, nor will it significantly impact public access to and use of the ocean beach. Therefore, the application is consistent with the use standards included in Subchapter 7H. North Carolina General Statute 113.A-120 requires that a permit issue absent specific findings outlined in that statute; the permit applicant believes that no such findings can legitimately be made, and thus a permit should issue. In order to ensure compliance with .0308(a)(1)(B), the proposed structure will be located well above mean highwater mark, and will be constructed so as to minimize any impact on the public beach strand. In addition, the proposed structure is not designed for permanent bulkheading purposes, but rather is proposed to impede storm surges or other accelerated erosion of a temporary nature, in order to protect the applicant's valuable property and improvements for a sufficient time to allow natural or artificial beach stabilization after such an event, so that, within a short period of time after such an event, the structure will again be covered, and will have no long term substantial impact on adjoining properties. It might also be noted that the immediately adjoining properties are owned by the applicant, and that, to the knowledge of the applicant, no other proximate property owners have any objection to the proposed structure. r - 2 - To ensure that there is not substantial adverse impact f rom the structure, the applicant is prepared, as a permit condition, to cause the structure to be removed, at applicant's expense, a reasonable time after the happening of such -a storm event, if in fact there is not natural or artificial beach renourishment to cover the structure, and to re-establish the beach strand. In order to ensure compliance, the applicant will post a cash bond with the department in an amount equal to 125% of the estimated cost of removal of the structure. I would urge that you examine carefully the data that has been compiled concerning the causes of erosion along the area of Bald Head Island within which is located the applicant's property. I believe that the severe erosion that has occurred within the last ten years has been demonstrated to be related to the manmade maintenance and expansion of the offshore shipping channel; this channel has created very unusual conditions at Bald Head, warranting unusual responses. It is the belief of the applicant that this application is consistent with all rules and regulations of the commission. However, if it is the position of the commission that no such structure may be permitted under the rules, regardless of a finding of no adverse impact to adjacent properties or public access, it is requested that the permit application be quickly denied, with this reason stated for denial. There is no point in a prolonged permit evaluation if in fact it is the position of the commission that the rules, notwithstanding the language thereof and notwithstanding any specific findings as to impact, prohibit a structure such as that requested. Absent such a prompt denial, the applicant will assume that it is the position of the staff and the commission that a full review of the permit application will be made with the understanding that a permit may issue if in fact no finding is made under Section 113A-120 of the North Carolina General Statutes, and if there is found to be no significant adverse impact on the value and enjoyment of adjacent properties or public access to and use of the ocean beach. Project Summary The applicant proposes to construct an oceanfront sandbag bulkhead 100 feet long and 15 feet wide to protect his property on Bald Head Island in Brunswick County. Harvey G. Ramsey Page two 9. PROJECT DESCRIPTION The project is located on the oceanfront of Bald Head Island at 1091 Sandspur Trail. Bald Head Island is a coastal barrier island located south of Fort Fisher and Corn Cake Inlet and north of the mouth of the Cape Fear River in Brunswick County. The island is accessed by private ferry from Southport. The waters of the Atlantic Ocean are classified SB by the N.C. Division of Environmental Management. The applicant owns six (6) continuous lots on Sandspur Trail, however, the project area consists only of Lot 1091, on which the applicant maintains his residence. The lot exhibits typical beach dune vegetation including sea oats, smilax, and yucca. An approximate four (4) foot erosion escarpment serves as the frontal dune on the ocean side of the project site. The erosion escarpment is remnant from hurricane Hugo in 1989, at which time, Division personnel reviewed the site for relocation, at the request of a previous owner, for qualification under the Upton/Jones Amendment of the Federal Emergency Management Act. At that time, the property did not meet the 25 feet criteria to qualify for Upton - Jones funding, as the erosion escarpment was located 36 to 38 feet from the structure's foundation, and the original escarpment was a nearly vertical 8-9 foot drop. The normal high tide was located 25 - 30 feet waterward of the erosion escarpment except during subsequent storm tides over the last two years which have eroded the escarpment an additional 3 feet since 1989. The escarpment was last measured by Division staff at 33 feet from the house foundation pilings on December 10, 1991. There are no primary dunes and no continuous dune system along the beach in this area of Bald Head Island. Phase I of the U.S. Army Corps of Engineers, Wilmington Harbor - Ocean Bar Channels Project, was completed in December 1991. The project had proposed the deposition of approximately 390,000 cubic yards of dredge spoil sands, 80 feet wide and 6 feet deep, along approximately 3,000 linear feet of the south beach at Bald Head Island. The resulting beach profile in front of the applicant's property was approximately 4.5 feet of sand deposition at the old escarpment line gradually sloping to below MLW. The old escarpment line is currently located approximately thirty-three (33) feet from the foundation of the residential structure. However, as a result of the recent beach renourishment project, mean high water has been pushed approximately 92 feet waterward of the old erosion escarpment line. The long-term annual erosion rate is 3 feet per year and the 100 year storm recession line is projected at 270 feet landward of the present shoreline. vs*. a 40 / Harvey G. Ramsey Page three 9. PROJECT DESCRIPTION - CONT. The applicant proposes to construct a sandbag bulkhead 100 feet long, 15 feet wide and 8 feet high along the base of the remnant erosion escarpment on the ocean side of his property. The application lists that the individual polyester sandbags would be 6 feet wide and 10 feet long. Given the proposed configuation of the sandbags, it is unclear how the applicant would maintain the proposed 15' project width. The base of the revetment would be buried approximately 3 feet below the present grade and would consist of two layers of sandbags, each three sandbags wide. The following layer would be stepped back to two sandbags, then a single row of sandbags would constitute the top layer resulting in a right angle triangle configuration. Ten (10) pilings would be installed, ten feet on center to secure the bulkhead on the ocean side. The applicant proposes to fill the sandbags by pumping sand from below mean low water, and then cover the entire structure by bulldozing sand from the beach. 10. ANTICIPATED IMPACTS The proposed project would disturb a total area of approximately 13,500 square feet of unvegetated (11,000 s.f.) and intertidal (2,500 s.f.) beach. There would be some short-term turbidity associated with the filling of sandbags with sand pumped from below MLW, as well as with the beach bulldozing activity. However no long-term adverse impacts of the ground disturbance are anticipated, as long as the beach bulldozing activity is limited to a timeframe outside of the seaturtle nesting and hatching season. The proposed sandbag bulkhead would consume approximately 1500 square feet of public trust area of the beach. Additionally, in the event of wave overwash during a storm, the structure would prevent the regression of waves. The trapped water would channel toward the open-ended design of the bulkhead creating accelerated erosion toward both ends of structure. Also, there is a significant body of scientific evidence that indicates a potential for adverse erosion-associated impacts to the beach profile and/or adjacent property as a result of the installation of oceanfront shoreline hardening structures. Should the applicant not remove the structure as proposed, in the event it becomes exposed or if adjacent shoreline erosion exceeds the landward position of the structure, these impacts would become evident.
