Upon review of your request for water Quality Certification
to place fill material in 0.37 acres of wetlands for
drainage ditch construction only located at SR 1510 in Brunswick
County, we have determined that the proposed fill can be covered
by General Water Quality Certification No. 2671 issued January
21, 1992. A copy of the General Certification is attached. This
Certification may be used in qualifying for coverage under Corps
of Engineers' Nationwide Permit No. 26. Any fill for residential
construction must receive separate approval from DEM.

The project has been reviewed to determine impacts to water
quality. The following comments have been provided.
Conversations with the Corps of Engineers indicate the area
proposed to be used for residences would be upland. It is also
my understanding that a Nationwide Permit has already been issued
for this project for three acres of disturbance.
1. The project will require a 401 Water Quality Certification.
2. The project complies with the General 401 Water Quality
Certification No. 2671 for Headwater Wetlands.
This office has no objection to the project as proposed.

SUBJECT: Comments on Section 401 Water Quality Certification
for Section 404 Nationwide Permit Requests (DEM ID:
92-17)
Biologists on the North Carolina Wildlife Resources
Commission staff have reviewed the permit application listed and
we are familiar with habitat values of the project area. Our
comments are provided in accordance with provisons of the Fish
and Wildlife Coordination Act (48 Stat. 401, as amended; 16
U.S.C. 661-667d).
Based upon information provided, it is our opinion that
Section 401 Water Quality Certification cannot be issued without
significant impacts to fish and wildlife.
Ellen Gailes of Route 2 Box 387, Bolivia, NC 28422 is
requesting a permit for continuation of a ditch to drain land for
the purpose of development. The ditching and subsequent draining
of water into a nearby swamp (i.e. off-site) will impact the
entire drainage pattern of the surrounding area and its
associated habitats. We recommend that a careful analysis of
impacts to surrounding wetlands associated with this project be
evaluated.
In the event that this project is authorized, we recommend
that the ditching be utilized to hold and drain lands on site,
but that no discharges of water into nearby swamps or associated
tributaries be allowed.
We appreciate the opportunity to review and comment on this
project. If we can provide further assistance, please call on

On March 2, 1992, I received an application from you for a
401 Water Quality Certification for your project entitled Ellen
Gailes at Bolivia in Brunswick County. Our existing regulations
(15A NCAC 2H .0501 (a)) require that all applicants for 401
Certifications submit seven complete copies of 401 Applications.
These copies must be supplied by the Division of Environmental
Management to various state and Federal agencies as specified in
the same regulations. Having copies available for simultaneous
review by other agencies will reduce the overall processing time
for your permit application. In the past, we have not enforced
this requirement and have seen processing time slowed
significantly.
Therefore, please send six additional copies of your 401
Certification application so we can initiate the comprehensive
review required by our rules. I am unable to do this copying
since there are numerous applications with this problem and our
regulations state that the applicant must supply these copies.

On March 10, 1992, I received a letter from the Corps of
Engineers advising that your project entitled Brunswick County
Operation Services and Maintenance Garage at Bolivia in Brunswick
County qualified for Nationwide Permit 26. Please be advised
that this General Permit is not valid until a 401 Water Quality
Certificate is issued by the State of North Carolina.
Our existing regulations (15A NCAC 2H .0501(a)) require that
all applicants for 401. Certifications submit seven complete
copies of 401 Applications. These copies must be supplied by the
Division of Environmental Management to various state and federal
agencies.
Therefore, please complete the attached form and send six
additional copies (a total of seven copies) of your 401
Certification application so we can initiate the comprehensive
review required by our rules. If you have any questions, please

Dear Mr. Bryant:
On January 31, 1992, M reddie Hickman, B unswick County Operation
Services and Maintenance Garage, f Schiener and Mr. Ernest Jahnke
of my staff visited your properties and adjacent properties to determine Corps
of Engineers regulatory jurisdiction in connection with the proposed
excavation of approximately 1,000 feet of new drainage ditch above the
headwaters-of Long Branch north of S.R. 1510 just east of U.S.Highway 17 south
of Bolivia, Brunswick County, North Carolina.
Mr. Hickman was unable to determine the exact extent of the proposed
ditch. Based on Mr. Hickman's description, we have estimated that
approximately cres of bo_ttomland hardwood swamp will be drained by this
activity. -
Mr. Jahnke then.met with your agent, Ms. Helen Gayles, at the Brunswick
County Health Department offices and explained the need to notify the District
Engineer of your intent to utilize the authorization to perform the work
pursuant to Nationwide Permit No. 26. She was given a pre-discharge
notification form and requested to contact Mr. Jim Gregson, North Carolina
Division of Coastal Management, to obtain the necessary water quality
certification for submission with the notification.
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization can be
provided, pursuant to Section 404 of the Clean Water Act, for discharges of
dredged or fill material into headwaters and isolated waters provided:
a. The discharge does not result in the loss of more than l acre of
waters of the United States; or
b. The permittee notifies the District Engineer if the discharge would
cause the loss of waters of the United States greater than one acre but less
than 10 acres with minimal adverse impacts to the aquatic environment in
accordance with the "Notification" general condition. For discharges in

specific aquatic sites, including wetlands, the notification must also include
a delineation of affected specific aquatic sites, including wetlands; and
c. The discharge, including all attendant features, both temporary and
permanent, is part of a single and complete project...
Upon review, your work may be authorized under paragraphs b. and c. above.
Prior to submitting the notification you should obtain Sectionn 401 Water
Quality Certification from the North Carolina Division of Environmental
Management (DEM). For more information, please call Mr. Jim Gregson, DEM, at
telephone [phone]. Processing will take up to 30 days upon receipt of
your request.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the NWP authorization is reissued without modification or the activity
complies with any subsequent modification of the NWP authorization. If during
the 2 years, the NWP permit authorization expires or is suspended or revoked,
or is modified, such that the activity would no longer comply with the terms
and conditions of the NWP permit, activities which have commenced (i.e., are
under construction) or are under contract to commence in reliance upon the NWP
will remain authorized provided the activity is completed within 12 months of
the date of the NWP's expiration, modification or revocation, unless.
discretionary authority has been exercised on a case-by-cgse basis to modify,
suspend, or revoke the authorization.

Thank you for your letter of March 2, 1992, concerning the above
project.
To complete the review of this project we need additional
information. Please send photographs (Polaroid type photographs
are fine) showing the site and adjacent property. These
photographs should be keyed to a site plan showing the project
location in relation to the surrounding buildings and roads. We
compared the site marked on the map included with your project
papers to the USGS topographic quad map of Castle Hayne. The
quad map includes several buildings in the project area. We will
continue our review upon receipt of this information.
There are no known archaeological sites within the proposed
project area. Based on our present knowledge of the area, it is
unlikely that any archaeological resources which may be eligible
for inclusion in the National Register of Historic Places will be
affected by the project construction. We, therefore, recommend
that no archaeological investigation be conducted in connection
with this project.
The above comments are made pursuant to Section 106 of the
National Historic Preservation Act of 1966 and the Advisory
Council on Historic Preservation's Regulations for Compliance
with Section 106, codified at 36 CFR Part 800.
