A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 26. Habitat Conservation Program DATE: May 12, 1992 SUBJECT: Comments on Section 401 Water Quality Certification for Section 404 Nationwide Permit Requests (DEM ID: 92-17) Biologists on the North Carolina Wildlife Resources Commission staff have reviewed the permit application listed and we are familiar with habitat values of the project area. Our comments are provided in accordance with provisons of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). Based upon information provided, it is our opinion that Section 401 Water Quality Certification cannot be issued without significant impacts to fish and wildlife. Ellen Gailes of Route 2 Box 387, Bolivia, NC 28422 is requesting a permit for continuation of a ditch to drain land for the purpose of development. The ditching and subsequent draining of water into a nearby swamp (i.e. off-site) will impact the entire drainage pattern of the surrounding area and its associated habitats. We recommend that a careful analysis of impacts to surrounding wetlands associated with this project be evaluated. In the event that this project is authorized, we recommend that the ditching be utilized to hold and drain lands on site, but that no discharges of water into nearby swamps or associated tributaries be allowed. Our existing regulations (15A NCAC 2H .0501 (a)) require that all applicants for 401 Certifications submit seven complete copies of 401 Applications. These copies must be supplied by the Division of Environmental Management to various state and Federal agencies as specified in the same regulations. Having copies available for simultaneous review by other agencies will reduce the overall processing time for your permit application. In the past, we have not enforced this requirement and have seen processing time slowed significantly. Therefore, please send six additional copies of your 401 Certification application so we can initiate the comprehensive review required by our rules. I am unable to do this copying since there are numerous applications with this problem and our regulations state that the applicant must supply these copies. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization can be provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters provided: a. The discharge does not result in the loss of more than l acre of waters of the United States; or b. We compared the site marked on the map included with your project papers to the USGS topographic quad map of Castle Hayne. The quad map includes several buildings in the project area. We will continue our review upon receipt of this information. There are no known archaeological sites within the proposed project area. Based on our present knowledge of the area, it is unlikely that any archaeological resources which may be eligible for inclusion in the National Register of Historic Places will be affected by the project construction.
