Reference your application for Department of the Army (DA) authorization
to construct two new boatram s three piers, a bulkhead and a retaining wall
on Runyon Creek, Washington, Wort,County, North Carolina.
On February 6, 1990, the DA and the U.S. Environmental Protection Agency
(EPA) signed a memorandum of agreement (MOA) establishing procedures to
determine the type and level of mitigation necessary to comply with the Clean
Water Act Section 404(b)(1) Guidelines. This MOA provides for first, avoiding
impacts to waters and wetlands through the selection of the least damaging,
practical alternative; second, taking appropriate and practical steps to
minimize impacts on waters and wetlands; and finally, compensating for any
remaining unavoidable impacts to the extent appropriate and practical. To
enable us to process your application in full compliance with this MOA, we
request that you provide the following additional information:
a. Permits for work within wetlands or other special aquatic sites are
available only if the proposed work is the least environmentally damaging,
practicable alternative. Please furnish information regarding any other
alternatives, including upland alternatives, to the work for which you have
applied and provide justification that your selected plan is the least
damaging to water or wetland areas.
b. It is necessary for you to have taken all appropriate and practical
steps to minimize wetland losses. Please indicate all that you have done,
especially regarding development and modification of plans and proposed
construction techniques, to minimize adverse impacts.
C. The MOA requires that appropriate and practical mitigation will be
required for all unavoidable adverse impacts remaining after all appropriate
and practical minimization has been employed. Please indicate your plan to
mitigate for the projected, unavoidable loss of waters or wetlands or provide
information as to the absence of any such appropriate and practical measures.

This information is essential to our expeditious processing of your
application and it should be forwarded to us by March 4, 1993. Also, a copy
of this information must be sent to the North Carolina Division of
Environmental Management to enable them to adequately evaluate your
application for a Water Quality Certification pursuant to Section 401 of the
Clean Water Act.

THIS CERTIFICATION is issued in conformity with the
requirements of Section 401 Public Laws 92-500 and 95-217 of the
United States and subject to the North Carolina Division of
Environmental Management Regulations in 15 NCAC 2H, Section .0500
to City of Washington pursuant to an application filed on the
5 day of February 1992 to construct a water treatment facility,
raw water force mains and wastewater diffuser to the Pamlico
River.
The Application provides adequate assurance that the
discharge of fill material into the waters of Pamlico River in
conjunction with the proposed water and wastewater treatment
facilities in Beaufort County will not result in a violation of
applicable Water Quality Standards and discharge guidelines.
Therefore, the State of North Carolina certifies that this
activity will not violate Sections 301, 302, 303, 306, 307 of PL
92-500 and PL 95-217 if conducted in accordance with the
application and conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner as
to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the Stream is 25 NTU's or less are
not considered significant).
2. A NPDES permit will be required from the North
Carolina Division of Environmental Management.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the
above conditions are made conditions of the Federal Permit.

On February 11, 1991, we renewed general permit No. CESAW-CO80-N-000-0291
(copy enclosed), which provides Federal authorization for construction
activities that receive authorization from the State of North Carolina.
A review of your application received January 29, 1993, for Department of
the Army authorization to.construct two new boatramps, three piers, a bulkhead
and a retaining wall on Runyon Creek, Washington, Beaufort County, North
Carolina, indicates it to be a candidate for Federal authorization under this
general permit. Accordingly, the administrative processing of your
application will be accomplished by the North Carolina Division of Coastal
Management. Comments from Federal review agencies will be furnished to the
State.
If your application must be withdrawn from this general permit process for
any reason, you will be informed regarding its further management. If there
are no unresolved differences in State-Federal positions or policies, the
final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the
general permit and you may commence your activity. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and Harbor Act and
Section 404 of the Clean Water Act, has been assigned Action ID No. 199301122
and will be coordinated by Mr. Norm Sanders in our Washington Field Office.

for water quality concerns. The applicant, City of Washington, has requested
that the CAMA Permit be modified to include an extension of the diffuser pipe

additional concerns to this modification request. The Section 401 Water

As you are aware, on 13 December 1991 the North Carolina Division of Coastal
Management (DCM) received from the City of Washington applications for permits to
construct a diffuser discharge pipe into the Pamlico River at Shady Banks in Beaufort
County. The city's proposal at that time was to place the pipe a maximum of 350' into
the river beyond the NWL. Recently, the DCM received the attached plats from the city
indicating that they now plan to extend the pipe a maximum of 900' into the river
beyond the NWL at the same location. It is my understanding that the construction
method will remain the same, that is, the pipe will be placed by a hydraulic jet
trencher.
The DCM would appreciate your comments on this latest proposal.- If you could
forward a memorandum to John Parker by 26 June 1992 it would be appreciated so that
your comments can be used by the Division in the permit decision making process.

I represent a number of residents in Shady Banks
Subdivision. My clients have shown to me a copy of the easement
deed dated September 23, 1991 from Charlie F. Harris and wife to
the City of Washington that is recorded in Book 946, at Page 23.
I trust you are aware that Mr. Harris' deed was made subject to
certain easement rights previously existing of record.
This letter is to put you on notice that most of the
lot owners at Shady Banks have in their deeds a right of ingress
and egress to the Pamlico River over the identical lot in which
the City of Washington proposes to locate your discharge pipe.
These easements originate from Charles Meekins who acquired the
property in 1928, caused it to be subdivided and sold off lots.
I understand a map of the subdivision partially appears in Map
Book 2, at Page 10.
My clients have continually used this easement area for
both pedestrian and vehicular traffic, to launch boats and
generally to enjoy the use of the Pamlico River. They feel that
they have a property right in this easement area which Mr. Harris
did not have authority to convey to the City of Washington. This
letter is to put you on notice of my clients' right and request
that the City not do anything that would interfere with their
rights of ingress and egress over this property.
I would also like to raise the issue with the City
regarding the safety of discharging these chemicals into the
Pamlico River where a residential beach area exists. It would
appear to me that there is some danger in excavating a dragline
ditch in the river at this point as well as discharging the
concentration of chemicals in a residential area.

whether the City intends to proceed with the installation of the
discharge line over my clients' objections.

This letter is in reference to the City's application request for a CAMA
permit authorizing a water treatment plant discharge line. Processing of your
application is nearing completion and the statutory deadline for such
completion or action is near. However, at this writing, not all of the
necessary easements for the project alignment have been made a part of this
record. This factor alone makes -tbe application "incomplete" and for this, a -
"hold" position is necessary. It goes without saying, it is also necessary to
protect the review period so as to allow time for staff assessment of the
total project. This action is taken under section 74.0204(d) of the Rules of
the Coastal Resources Commission. _
In addition to the statutorily required easements, we are also following
closely the progress of the NPDES permit.
Should there be any question on this matter, do not hesitate to contact
this office or other staff members.

8. PROJECT SUMMARY: The applicant is proposing to construct a.water treatment
facility with raw water force mains and i user discharge o was ewa er o
e Pamlico River.
Environmental setting
The City of Washington is in the process of upgrading its existing potable water
system. The process will include the construction of a 3.0 million gallon per
day water treatment facility on a 10.34 acre tract of land east of Washington
adjacent to SR 1325. The project will also include the construction of six raw
water wells and 6.25 miles of raw water force mains. These force mains will be
located within public road right-of-way or on property owned by the city. Also
to be constructed are 9.7 miles of potable water distribution mains within
public road right-of-ways. The last segment of the project will involve the
construction of 3.4 miles of discharge force main which will extend from the
treatment facility to the Pamlico River. This segment of the project will also
be located on public road right-of-ways or on land owned by the city.
In the construction of this water system, development will occur at the
following locations which have been determined areas of permit jurisdiction by
the N.C. Division of Coastal Management.
(1) Cherry Run on US 17
(2) Herring Run on SR 1501
(3) Broad Creek on NC 32
(4) A canal which connects to the Pamlico River on SR 1320
(5) Pamlico River at the end of SR 1321
Cherry Run - At the US 17 crossing, Cherry Run is a navigable stream, and is a
tributary of Tranters Creek which is a tributary of the Tar River. At US 17
the Run has a width of ± 3' and a depth of ± 5' at normal water. The Run is
bordered by upland vines and grasses.
Herring Run - At the SR 1501 crossing, Herring Run is a navigable stream.
Herring Run is a tributary of the Pamlico River. At SR 1501 the Run has a width
of ± 34' and a depth of ± 7' at normal water. The Run is bordered by upland
vines, grasses, and sweet gums.
Broad Creek - At the NC 32 crossing, Broad Creek is a navigable stream. Broad
Creek is a tributary of the Pamlico River. At the NC 32 crossing the creek has
a width of ± 140' and a depth of ± 10' at normal water. The creek is bordered
by upland vines and grasses on the south side and by a wetland area vegetated
with myrtles and Hibiscus on the north.

Pamlico River - At the end of SR 1321 is the site where the diffuser system will
enter the Pamlico River. The area is vegetated by lawn grasses and has been
historically used as a recreational area. At the NWL is a concrete retaining
wall which has retarded erosion. Existing is a sandy shoreline with no wetland
vegetation.
Project proposal
As previously stated, the project will involve the construction of raw water
lines, potable water lines and a discharge line to the Pamlico River. The
following will be conducted at each of the above stated sites.
Cherry Run - At Cherry Run a 12 inch potable water line will be placed across
the creek on the west side of US 17. To place the pipe, a 2' wide by 3' deep by
3.3' long trench will be excavated by a backhoe, or by a clamshell bucket on a
dragline. Once the pipe is in place, the trench will be allowed to be filled
naturally. Also once the pipe is in place, the disturbed banks will be
stabilized with riprap.
Herring Run - At Herring Run a 12 inch potable waterline will be placed across
the creek, on the north side of SR 1501. To place the pipe, a 5' wide by 3'
deep by 35, long trench will be excavated by using a trench jetting method.
Once the pipe is in place, the trench will be allowed to be filled naturally.
Also once the pipe is in place the disturbed banks will be stabilized with
riprap.
Broad Creek - At Broad Creek a 12 inch filter wash and softener regeneration
discharge line will be placed across the creek on the east side of NC 32. To
place the pipe, a 5' wide by 3' deep by 125' long trench will be excavated by
using a trench jetting method. Once the pipe is in place, the trench will be
allowed to be filled naturally. Also once the pipe is placed the disturbed
banks will be stabilized with riprap.
Canal to Pamlico River - At the canal to the Pamlico River, a 12 inch filter
wash and softener regeneration discharge line will be placed across the canal.
To place the pipe, a 5' wide by 3' deep by 45' long trench will be excavated by
using'a trench jetting method. Once the pipe is in place, the trench will be
allowed to be filled naturally. Also once the pipe is in place the disturbed
banks will be stabilized with riprap. The pipe will cross the canal on the east
side of SR 1320 within the highway right-of-way.
Pamlico River - At the end of SR 1321 an 8 inch filter wash and softener
regeneration discharge line will enter the Pamlico River. From the end of SR
1321 a ± 6' wide by ± 2' deep by ± 200' long trench will be excavated on land by
either a dragline or a backhoe. This trench may extend as far as ± 10' beyond
the NWL of the Pamlico River. From this point the trench will extend another
340' into the Pamlico River. This section of trench will be excavated by a
hydraulic jet trencher. Once the pipe is in place the trench will be allowed to
be filled naturally. The last 250' of the pipe will be weighted with concrete
ballasts. The diffuser portion of the pipe will be the last 1501. This section
of pipe will lay on the river bottom in approximately 516" of water. At the end
of the pipe a buoy will be placed for recognition.
Environmental impact
The project as proposed should have a minimal environmental impact. Short term
turbidity will occur at all of the crossings during pipe placement. The only
wetland vegetation which will be excavated is at the Broad Creek crossing. At
this location ± 40 sq.ft. of wetlands will be excavated and then returned to
original contour once the pipe is in place.

This project includes the construction of a 3.0 million gallon per day
water treatment facility on 10.34 acres of property located on the
Northwest side of NCSR 1325 near Douglas Crossroads and which is owned
by the City of Washington. The project also includes construction of
six (6) raw water wells and 6.25 miles of associated raw water
transmission force mains, all of which will be constructed on.properties
or easements which are or will become the property of the City, or which
will be located within the public road right-of-way. 9.7 miles of
potable water distribution mains will be constructed in public road
right-of-ways. 3.4 miles of discharge force main will be constructed
from the treatment plant site to the Pamlico River in public road right-
of-ways or in easements procured by the City. The following stream
crossings and areas of environmental concern where construction will be
within the public road right-of-way have been identified by CAMA's
Washington, NC regional office as requiring a CAMA Permit:
• Broad Creek on NC 32
• Herring Run on NCSR 1501
• Cherry Run on US Hwy 17
• Canal on NCSR 1320 (Shady Banks) may be within 75 ft. of area
of environmental concern.
• The point of discharge in the Pamlico River has also been
identified as requiring a CAMA Permit. The City has procured a
permanent easement from the public road right-of-way on the west end of
NCSR 1321 south to the Pamlico River. The easement deed, between the
City (Grantee) and Mr. Charlie F. Harris and his wife (Grantors), is
attached as a part of this Permit Application.

The Broad Creek, Herring Run, and Shady Banks Canal Crossings and the
Pamlico River Encroachment will be installed using a hydraulic jet
trencher. This type of trenching operation uses a high pressure water
jet. A qualified diver uses the water jet to temporarily displace the
stream bottom to the required trench depth. The subaqueous pipe is then
placed in the stream trench and is covered by the natural siltation and
sediment transport processes in the stream.
The Cherry Run Crossing will be installed using a clamshell bucket on a
dragline or backhoe to excavate the trench.

ATTACHMENT 6a
The purpose of the proposed excavation at the Cherry Run Crossing,
identified by CAMA's Washington regional office as a public trust water
crossing, is to install below ground 12-inch potable water system
piping. All other public trust water piping system crossings or
encroachments will be installed using trench jetting methods which
temporarily trench the stream bottom to a depth adequate for pipe
installation (see profiles on enclosed plan sheets for details). All of
the stream trenches, including the excavated Cherry Run Crossing, will
be returned to original grade by naturally occurring siltation and
sediment transport processes within the streams. Excavated stream banks
not below the water surface will be returned to original grade using
clean fill material (free of organics). The disturbed banks will be

Spoils from the Cherry Run stream crossing will be broadcast over upland
landscaped areas on the proposed water treatment plant site. The U.S.
Army Corps of Engineers will survey the site for 404 wetlands prior to
any spoil disposal activities.
ATTACHMENT 6k - FILL
The CHERRY RUN CROSSING (trenched by backhoe excavation) will be
returned to original grade by natural siltation and sediment transport
processes.
The SHORE AT THE PAMLICO RIVER will be trenched using a dragline or
backhoe. Excavated material from the trenching activities will be stored
temporarily in a local construction easement. The perimeter of the
storage area will be surrounded by silt fence. The clean excavated
material will be returned to the shore as backfill material once the
discharge piping is installed.
The remaining 340-feet of discharge piping will be installed under the
River bed using a hydraulic jet trencher. The trench will be returned
to original grade by the naturally occurring sediment transport
processes in the Pamlico River.

Compliance with the North Carolina erosion and sedimentation control
requirements is being ensured through a permit application with the
North Carolina Division of Environment, Health, and Natural Resources.
Mr. Floyd Williams, NCDEH&NR, Washington, N.C., will coordinate the
permit review.
ATTACHMENT 7
A minimum amount of excelsior matting and rip rap will be employed for
erosion control purposes to stabilize disturbed stream banks. An effort
will be made to return the shoreline back to original grade. In no case
will the rip rap be installed to extend greater than 2-feet into the
stream bed.

the Department of Environment, Health and Natural Resources hereby gives
public notice as required by N.C.G.S. 113A-119 (b) and 143-215 3(a) (1)(c) that
the City of Washington of Washington, N.C. filed an application on 13 December
1994-for a-permit from the Division. of Coastal Management to develop in an Area
of Environmental Concern and for certification from the Division of Environmen-
tal Management that a discharge of fill material in project wetlands will not violate
applicable water quality standards.
According to said application, the City proposes to construct a water treatment
Facility with raw water force mains and a diffuser discharge of wastewater to the
Pamlico River. The five sites are located in Beaufort County.
A copy of the entire application and additional information may be examined (or
copies furnished upon request and payment of reproduction costs) during nor-
mal business hours of the Division of Coastal Management, 1424 Carolina Av-

It is with a great deal of concern that I write to
you about the enlarged copy of the notice which appeared
in our local paper.
The data submitted for water quality certification was
taken from a site very different from the current plans to
locate the diffuser discharge of wastewater. The 40 feet
of property at Shady Banks used as a public access to the
river and the only public beach for body contact water in
the area is NOT a good location. This is a highly
developed swimming area and the only sandy beach for young
swimmers. Four hundred thousand gallons of ANY material
is bound to change the water quality 800 feet away. The
placement of tie outfa.ll pipe is of utmost concern to a
large portion of the population. I urge you to support
a State level public meeting so that the views of all may
be heard before any permits are granted.
As indicated by the map enclosed, the better location
and the one selected by the engineers where all the testing
.was.done is 2.2 miles East along US 264 to SR 1332 and 2.7
miles due South to the river. This route is within road
right of ways with minimal, if any, infringement on public
properties.. This would place the `point= of discharge in a.
'larger body of water with Blount's Bay depth offering
improved dilution. Also please note the South shore Hills
Point and the North Shore Broad Creek Point. These two jutd
of land are a strong dividing mark between the slower moving
waters of the upper river and the deeper more turbulant waters
below.
If you feel you must take final action before a state
meeting, please, please limit the certification to discharge
where tested.

the Army authorization and a State Water Quality Certification to construct a

verifies your acceptance of a valid request for certification in accordance
with Section 325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification may be required under the provisions of Section 401 of the same
law. A Department of the Army permit will not be granted until the
certification has been obtained or waived.
In accordance with our administrative regulations, 60 days after receipt
of a request for certification is a reasonable time for State action.
Therefore, if you have not acted on the request by March 16, 1992, the
District Engineer will deem that waiver has occurred.

the proposed site is located off S.R. 1328, near Washington, aart ;
County, North Carolina. Mr. Richardson submitted documentation from the
U.S. Soil Conservation Service (SCS), verifying the soil conditions at the
proposed plant and access road sites.
Based upon Mr. Sanders' onsite inspection, as well as information
supplied by SCS, the soil conditions did not meet the requirement to be
classified as hydric soils, a parameter that must be met to be classified as
wetlands. Therefore, no Department of the Army permit is required for the
discharge of dredged or fill material onto these sites. This authorization
does not relieve you of the responsibility to obtain any other required
State or local approval.
