Upon review of your request for Water Quality Certification
to place fill material in 2.3 acres of waters for quarry
relocation and reconfiguration located at Huffman Mill Road in
Alamance County, we have determined that the proposed fill can be
covered by General Water Quality Certification No. 2671 issued
January 21, 1992. A copy of the General Certification is
attached. This Certification may be used in qualifying for
coverage under Corps of Engineers' Nationwide Permit No. 26.

Reference is made to your meeting on January 10, 1992, with Mr. John
Thomas of my staff at the site for a proposed filling of a pond on the
Burlington Quarry property located off of Huffman Mill Road, adjacent to an
unnamed tributary of Back Creek, Burlington, Alamance County, North Carolina.
The purpose of the site visit was to review proposed plans for the
aforementioned project, and to inspect the site for wetlands subject to
Department of the Army permitting authority.
The site visit revealed the proposed site is adjacent an unnamed/above
headwaters tributary of Back Creek. The limits of the wetland jurisdiction
were the banks of the normal pool elevation of the pond. The pond appeared to
be between 2 and-3 acres in size. It was recommended that the pond be
surveyed for size and a "Pre-Discharge Notification Form For Nationwide Permit
26" submitted for the proposed work.
Reference is also made to your letter of January 22, 1992, where you
requested Department of the Army authorization to discharge fill (PDN
application) within these aforementioned delineated jurisdictional wetlands.
The review of the request indicates you propose adverse modification (filling
of the pond) to approximately 2.3 acres of Section 404 jurisdictional waters
of the United States. -
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization was
provided, pursuant to Section 404 of the Clean Water Act, for discharges of
dredged or fill material into headwaters and isolated waters provided:
_ a. the discharge does not cause the loss of more than 10 acres of waters
of the United States;

b. the permittee notifies the District Engineer if the discharge would
cause the loss of waters of the United States greater than one acre in
accordance with the "Notification" general condition. For discharges in
special aquatic sites, including wetlands, the notification must also include
a delineation of affected specific aquatic sites, including wetlands; and
c. the discharge, including all attendant features, both temporary and
permanent, is part of a single and complete project.
Your proposed work, involving adverse modification to 2.3 acres of waters
of the United States located above the headwaters of the aforementioned
tributary, is authorized by nationwide permit provided it is accomplished in
strict accordance with the enclosed conditions. Please be aware that this
authorization does not relieve you of the responsibility to obtain any other
required or local approval. You should contact Mr. John Dorney, North
Carolina Division of Environmental Management, (919) 733-1786, to obtain the
necessary Section 401, Water Quality Certification prior to starting work.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification of the nationwide permit
authorization. If during the 2 years, the nationwide permit authorization
expires or is suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the nationwide permit,
activities which have commenced (i.e., are under construction) or are under
contract to commence in reliance upon the nationwide permit will remain
authorized provided the activity is completed within 12 months of the date of
the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,
suspend, or revoke the authorization.

A site inspection was made on February 20, 1992. The
subject creek is classified as a C NSW watershed. The plans
are to partially fill an existing pond. Approximately 2.3
acres of wetlands would be affected. The existing pond
receives the pit dewatering (it has a NPDES permit). Little
twetlands exist becausd the pond banks are very steep. The
large pond will be divided into two (2) smaller ponds with a
channel connecting them. It is believed that the wetlands lost
would be offset with the wetlands created by the 2 ponds.
Attached is the wetlands rating sheet.
The WSRO recommends that a 401 certificate be issued for
the subject project.

Dear Mr. Dorney:
Martin Marietta would like to request 401 Water Quality Certification for this project in Alamance
County. Construction will require the placement of fill material in an old pond area that is needed
for plant and stockpile area.
This project will allow better protection of Back Creek by providing additional stockpile area away
from the creek. Due to limited space we have not been able to maintain an adequate buffer between
the creek and our existing stockpile area.
Attached is a completed PDN application for Nationwide Permit No. 26. Also included is a quad
sheet of the area, channel design calculations, and a 1" = 100' scale map showing the proposed
project.
