[D FE F=1 (-okM \?t October 15, 1997 New Hanover County DWQ# 95332 SUBJECT: COMPLIANCE EVALUTION INSPECTION Tidalhohn Subdivision Dear Mr. Clark: On April 24, 1995 you were issued General Water Quality Certification Nos. 2664 and2732 authorizing 0.84 acres of wetland impacts for residential development. This certification contained the following conditions: 1) Anti-seep collars be placed along the sewer line at 150 foot intervals through the wetland areas, 2) Deed restrictions shall be placed on all lots with remaining wetlands to prevent future wetland impact, and 3) Wetland areas disturbed by sewer line construction shall be restored to their original elevation and the width of the sewer line through wetlands shall be maintained at 10 feet. As part of an ongoing compliance monitoring and enforcement program, Mr. Pete Colwell and Mr. Jim Gregson conducted a compliance evaluation inspection at the aforementioned site on April 24, 1997. From this inspection they determined that the sewer line through wetlands along Erinshire/Adele Court had not been restored back to original wetland elevation. As a result, in a letter dated May 6, 1997 you were requested to remove this excess fill and restore this area back to original wetland contours. . On October 7, 1997 Mr. Eric Fleek and Mr. Pete Colwell conducted another compliance evaluation inspection at this site. From this inspection it was noted that the excess fill in wetlands along the sewer line on Erinshire/Adele Court had been removed and the original wetland contours restored We did note however 5 or 6 large piles of fill in the wetlands along the woodline of the sewer line corridor. The sewerline through wetlands at the terminus of Passage Gateway Drive was for the most part restored back to original wetland grade. The only exception to this was the first 20 feet (approximately) of corridor immediately adjacent to the gravel turnaround (opposite the pump station). This area had many upland species of plants, was dry, and in sharp contrast to the wetland plants present (e.g. cattails) and very wet conditions found on the remainder of the restored corridor. This excess material should be removed and the elevation in this area brought down to the grade of the nearby wetlands. Future inspections will be made as construction and lots are completed. This certification contained the following conditions: 1) Anti-seep collars be placed along the sewer line at 150 foot intervals through the wetland areas, 2) Deed restrictions shall be placed on all lots with remaining wetlands to prevent future wetland impact, and 3) Wetland areas disturbed by sewer line construction shall be restored to their original elevation and the width of the sewer line through wetlands shall be maintained at 10 feet. As part of an ongoing compliance-monitoring and enforcement program, Mr. Pete Colwell and Mr. Jim Gregson conducted a compliance ' evaluation inspection at the aforementioned site on April 24, 1997. From this inspection they determined that the sewer line through wetlands along Erinshire/Adele Court had not been restored back to original wetland elevation. As a result, in a letter dated May 6, 1997 you were requested to remove this excess fill and restore this area back to original wetland contours. On October 7, 1997 Mr. Eric Fleck and Mr. Pete Colwell conducted another compliance evaluation inspection at this site. From this inspection it was noted that the excess fill in wetlands along the sewer line on Erinshire/Adele Court had been removed and the original wetland contours restored. We did note however 5 or 6 large piles of fill in the wetlands along the woodline of the sewer line corridor. The sewerline through wetlands at the terminus of Passage Gateway Drive was for the most part restored back to original wetland grade. The only exception to this was the first 20 feet (approximately) of corridor immediately adjacent to the gravel turnaround (opposite the pump station). This area had many upland plant species, was dry, and in sharp contrast to the wetland plants present (e.g., cattails) and very wet conditions found on the remainder of the restored corridor. This excess material should be removed and the elevation in this area brought down to the grade of the nearby wetlands. Future inspections will be made as construction continues and lots are completed. The certification also has the standard condition that wetland areas disturbed by sewer line construction shall he restored to their original elevation and only a 10 foot wide corridor can be maintained through the wetland. As part of an ongoing compliance monitoring and enforcement program for 401 Water Quality Certifications, Jim Gregson from the Division's Wilmington Regional Office and myself made a compliance inspection of the project site on April 24, 1997. We found that the road crossing and sewer, lines had been installed. We found that the sewer line crossings along Erinshire Road had not been restored to the original wetland elevation. In order to bring your project hack into compliance with the 401 Water Quality Certification you should restore the wetlands back to the original wetland elevation and pull the pile of debris and soil at the end of Erinshire away from the wetland. Another site inspection will be made in the near future to determine if you have complied with this request.
