Major CAMA Permit. Based on a joint meeting with various State and Federal agencies, at which Mr. Steve Chapin and Mr. Ernest Jahnke of your staff were present, the loss of wetlands is mutually agreed to be-the area impacted by the proposed boat ramp. The area, 3.5' x 15', represents the total wetland loss proposed and is a water dependent use. The 3.5' of wetland fringe was the narrowest crossing from uplands to the water body. An initial location for the boat ramp was modified to the present based on a request from CAMA officials. j. We propose to mitigate the loss at a 3:1 ratio, resulting in the cr-eation of 158 square feet of wetlands. Please find enclosed drawing Sheet 2 of 4 showing the proposed mitigation area. There are several portions of your plan which will result in 401 denial unless modified. These concerns are outlined below. 1) Marina - The 29 slip marina (by itself) will not cause closure of SA waters. However, if any of the private lot owners adjacent to the water build piers (which is likely) the waters would be closed as required by the Shellfish Sanitation Section of DHS. Therefore in order to approve the marina, we will need to be assured that no individual piers will be built on these private lots. An alternative approach would be to delete the marina from your plans or reduce the size so that the total number of slips would be less than 30. 2) Pond excavation - The purpose of the pond is not clear. If it is only for aesthetic purposes, we are likely to deny the 401 Certification. Therefore, you will need to apply for that permit to the COE or modify your existing application accordingly. As you can see, we have serious reservations about the present design. A site visit and review agency meeting was held on July 16, The proposed marina will have 29 slips, no boats with heads and no boats over 21 feet. However, there are 21 lots along the access channel adjacent to the marina that have the potential for constructing individual boat docks with four boats per lot, bringing the total number of potential boats to 113. The Division of Health Services has stated that the 29 slip marina would not cause an automatic shellfish closure, however, as soon as the first individual lot owner constructs a pier there would be an automatic closure. Because individual piers with up to four slips could be constructed without going through the formal permitting process, and because of the inevitable shellfish closure they would cause, this office objects to the 29 slip marina. This Office would not object to the marina if the applicant submits a provision, such as a conservation easement along the shoreline of the waterfront lots, to prohibit individual lot owners from constructing piers. During the site visit and review agency meeting, the Corps of Engineers indicated the pond excavation would not require a permit, but were unsure whether they would take jurisdiction over the construction of the clubhouse and deck over 404 wetlands. It is difficult to make a decision regarding the 401 Certification for the project until the Corps of Engineers decides if a 404 Permit is required. It appears, however, that the construction of a clubhouse over 404 wetlands would certainly remove the habitat value of this area. David Taylor of Marine Fisheries stated they found similar clam densities to those in the July 31, 1990, Goldstein Report. DMF found an average of .75 clams per square meter where Goldstein found an average of .48 clams per square meter. Such densities are not considered a significant resource. NARRATIVE DESCRIPTION: The applicant's property consists of an approximately 39.2 acre tract of land located towards the western end of the Town of Atlantic Beach, Carteret County. The property is bordered-on the south by NC Hwy. 58, on the west by Atlantic Station Shopping Center, and to the north by the waters of Bogue Sound. Bisecting the property is a human-made canal locally known as 'Hoop Hole Creek'. A substantial amount of the applicant's property consists of a diversified mixture of coastal wetland species (including Spartina alterniflora, Juncus roemerianus, Salicornia spp., Distichlis spicata, Spartina patens), and, Section 1404' wetlands (including Iva frutescens, Sea ox-eye, Eastern baccharis, Sweet bay, Red bay, Fetterbush titi, etc.). The highground areas can be characterized as either Maritime Forest (vegetated with red cedar, red bay, sweet bay, yaupon, holly, live oak, wax myrtle, etc.),.or, areas which were filled during the initial excavation of Hoop Hole Creek and are now vegetated primarily with scattered amounts of Spartina patens. There are also scattered pockets of 1404' wetlands located in the swales of the Maritime Forest complex. The U.S. Army Corps of Engineers have approved the wetland delineation performed on this property. Hoop Hole Creek was altered many years ago and can be characterized as having irregular channel depths ranging from -0' to -5.4' MLW deep. The bottom consists of mostly sandy material except towards the upper end of the canal where it is silty. An existing highway stormwater discharge pipe is also located at the head of the canal. A varying border of coastal wetlands and scattered amounts of oysters exist along the shoreline of the canal. Hoop Hole Creek has been classified as 'SA' waters and is open to the harvesting of shellfish. This property was the subject of a permit application in 1984. This permit application was for the construction of a shopping center, condominium complex, and commercial marina and involved the excavation of an approximately 1 mile long access channel. A permit was issued but was later appealed. The Coastal Resources Commission modified the permit conditions in 1985 to primarily address stormwater concerns and required monitoring of water quality conditions in the canal system. The shopping center was built, but, the marina access channel excavation and condominium complex was never constructed. The applicant is now proposing to develop this property into a fifty-four (54) lot subdivision with an associated op FIELD INVESTIGATION REPORT - SUGARLOAF PROPERTIES, INC. CARTERET COUNTY PAGE 3 residential marina clubhouse and other amenities. The residential marina is proposed on the west side of Hoop Hole Creek and will consist of 29 boat mooring slips extending into the creek. A concrete boat ramp is also proposed and will be approximately 75' in length x 15' in width. The ramp will cross an approximately 6' border of 1404' wetlands and an approximately 4' wide border of coastal wetlands. It will then extend into the creek and beyond the MHW line for a distance of approximately 271. A 34 space vehicular asphalt parking lot will be constructed on the highground to service this marina facility. Access will be gained from an existing asphalt road in the Atlantic Station Shopping Center. The subdivision and other amenities are basically proposed on the south and east side of the canal. An asphalt roadway will provide access into the property from NC Hwy. 58. The roadway will provide access to 21 waterfront lots adjacent to the canal with 34 interior lots. Minimum lot size will be 7,000 sq. ft. A park area is proposed in the middle of the subdivision which will have an approximately 240' long x 40' x -3' deep pond excavated in its middle. The majority of the area proposed for excavation has been identified as a 1404' wetland (maritime forest swale), however, the majority of the vegetation has recently been cleared. Adjacent to Hwy. 58 and an approximately 150' long x 60' wide gravel boat storage area is proposed. Additionally, the existing stormwater drainage pipe will be relocated but will still discharge into the canal. At the end of the cul-de-sac, the applicant is proposing to construct a nature trail which will partially utilize an existing trail system that goes out and through coastal and 1404' wetlands. The applicant has indicated that only hand clearing and construction of elevated boardwalks will occur in the area and that no filling activities will be performed. A 14' x 14' elevated gazebo is proposed near the water's edge and will be constructed over an existing sandy area void of wetlands vegetation. Also proposed is an approximately 25' long x up to 6' wide "day" pier which will extend into the waters of Hoop Hole Creek. One of the roads in the subdivision will provide access to a proposed bridge which will provide vehicular access to a small island of maritime forest which is surrounded by coastal wetlands. The 65' long x 12' wide bridge will transverse an approximately 55' wide area of coastal and 1404' wetlands. Adjacent to both sides of the bridge will be underground utility lines which will require excavation FIELD INVESTIGATION REPORT - SUGARLOAF PROPERTIES, INC. CARTERET COUNTY PAGE #4 trenches of approximately 3' in width. On the island, a clubhouse, pool, deck, tennis courts, and an asphalt parking lot is proposed. The clubhouse and deck will be built primarily over '404' wooded wetlands and will be constructed on pilings. The applicant is also proposing to excavate portions of an access channel in order to gain improved water depths to the existing canal in Bogue Sound. Approximately 2,070 ln. ft. of creek and sound bottom would be excavated to a depth of -4' MLW. The applicant indicates that existing depths within the dredged area range from -2' to -3.6' MLW deep and that approximately 1,000 cu. yds. of material would be 5HJx removed. Excavation will be accomplished by the use of a dragline mounted on a barge with the resultant spoils being trucked off to a highground disposal site. The bottom area to be excavated are primarily sandy with various pockets of shell material. 10. ANTICIPATED IMPACTS: The project as proposed will result in approximately 6 acres of primarily maritime forest being cleared and leveled in conjunction with the subdivision roadways and amenities. The applicant has indicated that impermeable coverage of streets and amenities would amount to approximately 4.3 acres and that less than 1% of impermeable coverage would be within the Estuarine Shoreline AEC. The applicant has indicated that he plans to meet the Division of Environmental Management's (DEM) low density requirements (less than 25% built-upon surface area), but has not submitted the necessary information to them for their review. It would appear, however, that several of the waterfront lots may have some difficulty in designing residential development which would meet the impermeable coverage limitation (30%) in the Estuarine Shoreline AEC. Potable water for the development will be obtained from the Town of Atlantic Beach, and, wastewater will be provided by an existing 100,000 GPD package treatment plant located off-site. Vegetated wetland impacts will occur to an approximately 5,750 sq. ft. area which will be excavated in order to create a pond and approximately 250 sq. ft. will be filled in in conjunction with the boat ramp. The construction of the clubhouse and deck will require an approximately 3,350 sq. ft. area of wooded wetlands to be cleared and then -_ built upon. These structures will be supported by pilings, but it is doubtful that significant amounts of vegetation will become established underneath the footprint structures because of shading. Utility lines adjacent to the bridge will cause the temporary excavation of approximately 330 sq. ft. of wetlands. The proposed boat ramp will result in the filling in of approximately 405 sq. ft. of bottom area below the MHW line. with approximately 7.5 cu. yds. of concrete. The 29 slip marina has been proposed so as to restrict boats greater than 21' in length in order to comply with Health Services closure policy. The location of some of the mooring pilings associated with the marina dock appears to extend beyond one-third of the width of the canal. It can also be expected that some of the future owners of the 21 canal front lots will be constructing docks in the canal too. Current CRC rules would allow one (1) dock with up to four (4) slips on each lot to be exempt from the formal permitting process. The proposed access channel will result in the excavation of approximately 41,400 sq. ft. of bottom area with approximately 1,000 cu. yds. of mostly sandy material being removed. Increased levels of turbidity can be expected during the excavation but should be short-term in nature. The access channel is proposed to be marked with 2" PVC pipe. Century 21 Coastal Properties of Atlantic Beach, N.C. asked Robert J. Goldstein and Associates (RJG&B), Environmental Consultants, to investigate clam density along a channel adjacent to Hoop Hole Creek in Bogue Sound, northwest of Atlantic Beach, Carteret County.' North Carolina (Figure 1). The development firm, Sugar Loaf Properties, proposes to construct a small-craft marina, shopping center, and condominiums along the southern end of the channel. This clam density study was requested by Century 21 Coastal Properties to establish whether a significant public shellfish resource may exist in the vicinity of the marina. The project site is just vest of the Atlantic Beach town limits, on the north side of NC-58. A partially paved road provides vehicle access to 'the property, but is secured with a chain. Public access to the site is by boat or wading. The site plan for Sugar Loaf Properties proposes commercial and residential development, excavating a basin at the south end of the channel to accomodate 100 boat slips, and improving the channel connecting the basin to Bogue Sound (Figure 2). Methods. RJG&A biologists used aerial photographs, Beaufort and Mansfield USGS topographic maps, and field examination to locate probable shellfish beds along 3500 feet of channel between the prgposed basin and open water of Bogue Sound. Thirty-one sites were sampled,-all on muddy to sandy, unvegetated bottom which quahog clams (Mercenaria species) prefer (Meinkoth, 1981). No significant submersed plant beds were found in the area. Numbered sample sites were recorded by distance and compass direction from a previous site, lettered base flags, or other reference points discernable on the aerial photographs and maps (Figure 3). Figure 3 also shows the location of marsh, mud flat, and maritime forest habitats. At each sample site, a one-meter square grid of PVC pipe was placed on the bottom and raked to blade depth with a 'standard butterknife clam rake. The plot was raked with parallel, overlapping strokes until the bottom was thoroughly loosened and solid objects retrieved. A second set of scrapings was then taken perpendicular to the first. All quahogs collected were measured to the nearest millimeter, sorted by size class into seed (08 mm long), littleneck (38-60 mm long), cherrystone (61-80 mm long), or chowder (>80 mm long), and recorded by size class and location on data sheets. Other shellfish species are not included in DMF density estimates used to designate shellfish waters, and were not counted. All shellfish were returned to the water where collected. M This study was conducted under a 261 Scientific Collecting Permit (No. SC- 15-90), Issued by the N.C. Division of Marine Fisheries. Results. RJG&A biologists sampled the area on July 17, 1990 betveen 1:00 and 6:00 PM (high tide at 5:15 PM), and on July 18 betveen 9:00 AM and 3:00 PM (lov tide at 11:39 AM). The channel is bordered by intertidal mudflats and saltmarsh; upslope are maritime grassland and forest. The sample plots vere located on the mudflats or in the shallov subtidal margin along the channel. Table 1 provides locations of reference flags and sample sites. RJG&A biologists collected 15 live quahogs, including both northern (M. mercenaria) and southern (M. campechiensis) species from 9 of the 31 sample sites (Table 2). High density of edible-size clams vas found only at tvo adjacent sites 150 feet apart (sites 5 and 6, vith 4 and 2 clams, respectively). Additional samples 150 to 200 feet from these sites yielded no clams. Overall quahog density averaged 0.48 clams per square meter. Other live shellfish collected or observed include eastern oyster (Crassostrea virainica), ribbed mussel (Modiolus modiolus), jackknife clam (Taaelus vlebius), bay scallop (Aeauipecten irradians), knobbed vhelk (Busy _Con erica), and blue crab (Callinectes sapidus). Conclusions. Based on these findings, RJG&A concludes that most of the project area does not have sufficiently high clam density for designation as state shellfish eaters, particularly in the sandy channel. A more intensive study of the mudflat near sites 5 and 6 may be warranted, using the DMF standard grid of 20 one-meter square samples per acre. When running the DO model, average summer ambient DO should be representative of conditions immediately adjacent to the mouth of the proposed entrance channel. The Sugarloaf basin will be situated at the end of a approximately 1,600 ft. man-made canal off Hoop Pole Creek. Salinity and temperature will also need to be monitored to calculate saturation DO. 2. Include the total canal area in the entrance channel surface area when running the model. Additionally, based on the design depths in the basin, the reaeration coefficient value should be .44.
