Upon review of your request for Water Quality Certification
to place fill material in 0.25 acres of wetlands for commercial
development, we have determined that the proposed fill can be
covered by General Water Quality Certification No. 2176 issued
November 4, 1987. A copy of the General Certification is
attached. This Certification may be used in qualifying for
coverage under Corps of Engineers' Nationwide Permit No. 26.

Thank you for your assistance on the telephone last Friday concerning the
appropriate prcedures to follow in order to get my father-in- law's farm pond
drained.
As you instructed I am writing you this letter requesting a Section 401 Water
Quality Certification so that it can be attached to our application for a
Nationwide Permit 26. Should anyone need directions to the property or for
Mr. Lloyd or myself to be present on the property at sane appointed time,
please call me during the day at my office [phone]. Mr. Lloyd's mailing
address is Roy Shelton Lloyd, Po.O.Box 278, aE rboro, N.C., 27510 and his
phone number is 942-5092. The property is in Carrboro, N.C. at the intersection
of W.Main Street/Hwy 54 west and James Street.

In response to your 9 March 1994 letter concerning fill of about
0.25 acres of waters or wetlands for the Carrboro Postal Facility, my
staff has checked our files. The Division of Environmental Management
issued a certification to Mr. Roy Shelton Lloyd on 22 July 1991. This
fill was for filling in two small areas one just upstream of an
existing pond and one just downstream of the pond. This fill is still
acceptable to DEM since it coumplies with Water Quality Certification
No. 2671.

Dear Mr. Dorney:
As we discussed by telephone on March 8, 1994, the United States Postal
Service is prepared to begin construction of the Postal Facility in Carrboro,
North Carolina. I understand that by letter of July 22, 1991, the State sent
water quality certification to Linda Lloyd for the subject property.
You stated that as long as the filled area of the prepared project did not
exceed the 1/4 acre on the certification, no further action beyond the July
22, 1991 certification was necessary by your office. Also, any fill upstream
of the Postal Facility project limits would be evaluated when the specifics
are known.
The Corps of Engineers is requesting confirmation of this status prior to
their issuance of a Nationwide Permit. If you would send me the confirmation
along with a copy of the July 22, 1991 letter, I will forward it to the Corps
of Engineers.
I appreciate your cooperation in this matter and please call if you have any
questions.
