The project has been reviewed to determine impacts to water
quality. The following comments have been provided.
1. The project will require a 401 Water Quality Certification.
2. The Office commented on this project on January 14, 1991.
The applicants are now proposing to fill 4.94 acres instead
of 3.37 acres. Our earlier comments have not changed.
This office has no objection to the project as proposed.

SUBJECT: 401 Water Quality Certification for Doky Saffo c/o Saffo Turner
Corporation, SR 1492 (Masonboro Loop Road), approx. 0.5 mile north of
Whiskey Creek on east side, New Hanover County, North Carolina.
The Wildlife Resources Commission has reviewed the subject permit application. A
site visit was made on July 2, 1992. Our comments are provided in accordance with
provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C.
661 et. seq.).
Plans call for the filling of 4.94 acres of wetlands to develop home site lots for sale.
The project site is largely "404" wetlands and has been ditched in some areas. Spoil piles
from the excavation appear to have been placed in wetlands. Vegetation includes red and
sweet bay, longleaf pine, black gum, sweet gum, wax myrtle, smilax, cinnamon fern and
sphagnum moss. The site provides habitat suitable for raccoon, oppossum and a variety of
songbirds.
The project as proposed would result in the loss of 4.94 acres of wetlands currently
providing wildlife habitat. This loss would also reduce the water retention capabilities of
the area. No mitigation for these impacts is proposed. The destruction of wetlands and
their important inherent functions without in-kind mitigation is inconsistent with our
Policies and Guidelines for the Conservation. of Wetlands and Aquatic Habitats.. We must
therefore recommend that water quality,-certification be, denied.

activity located in New Hanover County, NC.
Dear Mr. Saffo:
The NC Division- of Coastal Management has reviewed the above
referenced application for a Nationwide Permit received 06/22/92 pursuant
to Section 307 of the Coastal Zone Management Act of 1972 as amended.
Based upon our review, we have determined that the proposed activity is
consistent with the North Carolina Coastal Management Program provided the.
following conditions are met.
1. The activity described in the above referenced application qualifies
to receive one of the Nationwide Permits described in 33 CFR Part 330 with
the exception" of numbers 17, 21, 24, and 34 which were found inconsistent
with the North Carolina Coastal Management Program.
2. A 401 Water Quality Certification is received, where required,. from
the NC Division of Environmental Management.
This letter does not relieve you of the responsibility to insure that

Whispering Pines subdivision wish to proceed with processing a
PDN/Nationwide 26 Permit Request to fill 4.94 acres of isolated 404
wetlands in New Hanover County.
I have enclosed 7 copies of the 401 certification application and
map showing the wetland area.
This site was previously reviewed by D.E.M. in 1990 and the filling
of ;.this. isolated wetland areawas determined not to have any
significant impacts on water quality values.
The Corps of Engineers has also reviewed this site and approved the.
surveyed wetland area shown on our drawing. They will also be-
receiving a copy of the enclosed joint application form.

NATIONWIDE PERMITS THAT REQUIRE INDIVIDUAL SECTION 401 CERTIFICATION
A. NOTIFICATION TO THE CORPS OF ENGINEERS DISTRICT ENGINEER. (REFER TO
ITEM B. BELOW FOR DIVISION OF ENVIRONMENTAL MANAGEMENT NOTIFICATION
REQUIREMENTS-AND SPECIFICALLY NOTE NWP 26 DIFFERENCE.)
Certain nationwide permits require notification to the Corps of Engineers
before work can proceed. They are as follows:
NWP 5 (only for discharges of 10 to 25 cubic yards)
NWP 7
NWP 13 (only for stabilization activities in excess of 500 feet in length
or greater than an average of one cubic yard per running foot)
NWP 14 (only for fills in special aquatic sites, including wetlands, and
must include a delineation.of affected special aquatic sites)
NWP 17
NWP 18 (required when discharge exceeds 10 cubic yards or the discharge is
in a special aquatic site and must include a delineation of the affected
special aquatic site, including wetlands)
NW? 21 (must include a delineation of affected special aquatic sites,
including wetlands)
NWP 26 (only for greater than 1 acre total impacts and must include a
delineation of affected special aquatic sites, including wetlands)
NWP 33 (must include a restoration plan of reasonable measures to avoid
and minimize impacts to aquatic resources).

NWP 38 (must include a delineation of affected special aquatic sites,
including wetlands)
For activities that may be authorized by the above listed nationwide permits
that require notification, the applicant shall not begin work
a. Until notified that the work may proceed under the nationwide permit
with anyspecial conditions imposed by the District Engineer, or
b. If notified that an individual permit may be required, or
c.' Unless 30 days (calendar) have passed from the time a complete
notification is received by the District Engineer and no notice has been
received from the District Engineer, and required state approvals have been
obtained. Required state approvals include: 1) a Section 401 water quality
certification if authorization is requested for a discharge of dredged or fill
material, and 2) an approved coastal zone management consistency determination
if the activity will affect the coastal area.

above. The applicant should make sure that all necessary information is
provided in order to avoid delays. One copy of the application is required by
the Corps of Engineers and seven copies are required by DEM. Plans must be on
8 1/2 x 11 inch paper.
Endangered species requirement: Applicant must notify the U.S. Fish and
Wildlife Service and/or the National Marine Fisheries Service regarding the
presence of endangered species that may be affected by the proposed project.

PROJECT. DESCRIPTION: The applicant proposes to filr 3.37 acres
of 404 wetlands for the development of a residential subdivision.
The project is located on b asonboro Loop Road (SR 1148) in New
Hanover County and adjoins:'-the existing development of Downing
Creek to the south east, The proposed 404' fill sites are
isolated pocosin type stet" nds containing Pond Pine, Loblolly
Pine, Sweet Bay, Bitter llberry, Fetter-bush, and a smaller
area dominated by Sweet 'G .,Black Gum and Red Maple that:-may at.
one time have been a far pond: The New Hanover Cpunty;Soil
Survey maps the area as mostly. Muk-ville :with.' slime smalldt. areas
of Leon. The site has mazlor, dra ?n?age ditches. n three sides„' ah
the adjacent development 'on:the: `fourth. rAtowater management
plan for the proposed developmektf, wad approve on May 10.;;1 T98$ '
All runoff from the streets in Whisgering Pine development will
be collected in a stormwater.detention'pond?in the Downing Creek
development.
The project has been reviewed to determine impacts to water
quality. The following comments have been provided.
1. The project will requi..r 'a401 Water Quality Certification.
2. The project complies. with the General 401 Water Quality
Certification No. 217, for the placement of fill material in
headwaters.and isolated wetlands.

3. Due-to-the 'sma,ll isolated nature and drainage ditches, it is
felt the filling of the areas proposed should have little if
any impact, on water quality. However, it is recommended the
area near ;Tall- Fine Court listed as "unappropriated
property`s `on the January 11,1991 plans, be reserved as a
natural area - This area appears to be flooded more often,
and has more diverse vegetation than the other areas on the
site. This„area should be protected from filling by
individual'6t,ow'ners either through deed restrictions or
conservation area designation.

Enclosed please find an application for a 401 water quality
certification, a vicinity map and a map showing the fill area
requested under the Corps,Nationwide 26 Permit.
The wetland-.'areas affected are isolated in nature and',the tract
is surrounded by substantial ditching that was performed about
four 'years ago. The soils on:,the,tract are primarily muryille
and leon.
Mr. Saffo would.like to proceed with work as soon as possible.
