CERTIFICATION
THIS CERTIFICATION is issued in conformity with the requirements
of Section 401 Public Laws 92-500 and 95-217 of the United States
and subject to the North Carolina Division of Environmental
Management Regulations in 15 NCAC 2H, Section .0500 to Nathan
Sanders pursuant to an.application filed on the 25 day of
September, 1991 to excavate and construct a 0.6 acre pond in
clear-cut swamp wetlands.
The Application provides adequate assurance that the
discharge of fill material into ,the waters of a tributary to the
Cape Fear River in conjunction with the proposed pond
construction in New Hanover County will not result in a violation
of applicable Water Quality Standards and discharge guidelines.
Therefore, the State of North Carolina certifies that this
activity will not violate Sections 301, 302, 303, 306, 307 of PL
92-500 and PL 95-217 if conducted in accordance with the
application and conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner as to
prevent significant increase in turbidity outside the area
of construction or construction related discharge (increases
such that the turbidity in the Stream is 25 NTU's or less
are not considered significant).
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become. null and void unless the above
conditions are made conditions of the Federal Permit.

9. PROJECT DESCRIPTION
The project area consists of a 25.73 acre tract of land located
approximately 6 miles south of Wilmington, off Secondary Road
1100 (River Road), adjacent to the Cape Fear River in New Hanover
County.
The majority of the tract is wetlands within the floodplain of
the Cape Fear River. There is, however, a 5.85 acre island of
highground on the property between Secondary Road 1100 and the
river. The island reaches elevations of 17 feet mean sea level,
and supports a variety of climax forest vegetation including live
oak, loblolly pine, and holly.
The island is bordered by the Cape Fear River to the east,
coastal wetlands to the north and south, and wooded,
cypress/gum/maple swamp to the west.
A State CAMA Major Development Permit (144-90) was issued to the
applicant on November 9, 1990. This permit authorizes the
development of a ten (10) lot subdivision, accessed from S.R.
1100 by an elevated wooden bridge (262' x 14.51) through
wooded-swamp wetlands, and a 20 slip marina, including pier,
gazebo, and docking facilities in the Cape Fear River. Since the
initial permit application, the property owner has timbered the
wooded swamp and the area between S.R. 100 and the land for the
subdivision was clear-cut.
The applicant is requesting to modify his original permit to add
the excavation of a pond. The size of the pond would average 200
feet by 130 feet, and a depth of 6 feet has been requested. The
majority of the pond would be located north of the bridge
alignment, however the proposed perimeter of the pond does extend
south of the bridge in two areas with the dimensions; westside -
average 40 feet by 30 feet, and eastside - average 40 feet by 70
feet. This southern excavation alignment would follow the
vegetation transition line from swamp to irregularly flooded
coastal wetlands consisting primarily of Scirpus p2. The
applicant proposes to complete the excavation using a trachoe
mechanical excavator using mats for equipment mobility. The
spoil material would be placed directly into dump trucks, also
using mats to maneuver in and out of the excavation area. The
spoil material would be trucked to a highground site owned by the
applicant, located approximately two (2) miles inland from the
proposed pond site. In the absence of cross-sectional data of
the pond, the applicant's consultant, Charlie Hollis states that
the pond would be constructed with a minimum 3 to 1 sideslope.

10. ANTICIPATED IMPACTS
The proposed project would convert approximately .6 acre of
clear-cut swamp wetlands to a shallow freshwater pond. Water
exchange and flow would be minimal, as the only water source
would be the shallow groundwater table and the overland flow
hydrology of the adjacent swamp/drainage way to the north of the
project. During seasonal dry cycles, adjacent wetlands would be
dry and stagnate water conditions would be expected in the pond.
These conditions would produce ideal mosquito breeding habitat.

r Enclosed is the application of Mr. Nathan S. Sanders for Department of the
Army authorization and a State Water Quality certification to place
Y excavated/fill material in wetlands adjacent to the Cape Fear River associated
with construction of a pond on River Road, near Wilmington, New Hanover
County, North Carolina. Your receipt of this letter verifies your acceptance
of a valid request for certification in accordance with Section 325.2(b)(ii)
of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification may be required under the provisions of Section 401 of the same
law. A Department of the Army permit will not be granted until the
certification has been obtained or waived.
In accordance with our administrative regulations, 60 days after receipt
of a request for certification is a reasonable time for State action.
Therefore, if you have not acted on the request by November 18, 1991, the
District Engineer will deem that waiver has occurred.

Dear Mr. Richter:
This will confirm our telephone discussion regarding the referenced
project and the question of Corps jurisdiction over the proposed
excavation of the small pond described and shown on the.plans submitted
to you on September 6, 1991.
A copy of the application for a modification of CAMA permit No.
144-90 was provided to the Corps on September 6, 1991 with the
understanding that this information would be helpful for the Corps'
determination as to whether a Federal permit would be required. It was
explained in the application that no excavated material would be
stock-piled or otherwise placed onto any wetlands in the area and that
all excavated material will be loaded into trucks and hauled to a high
ground disposal site.
You confirmed in our conversation that if indeed this work was done
with care so as..to avoid the discharge of excavated. mater al.into the .
wetlands, no Federal permit would be required. Since these are exactly
the conditions under which Mr. Sanders proposes this work, we will
consider this question resolved.
By copy of this letter, I am sharing this information with those
addressees who were furnished your two "card letters" both dated
September 17, 1991.

Dear Mr. Parker:
Reference the application of Mr. Nathan S. Sanders for a Department of the
Army permit to place excavated/fill material in wetlands adjacent to the Cape
Fear River associated with excavation of a pond on River Road, near
Wilmington, New Hanover County,, North Carolina.
The Federal agencies have completed review of the proposal as presented by
the application and your field investigation report.
We recommend that the following conditions be included in the State
authorization:
a. All excavated materials will be confined landward of the mean high
water (MHW) elevation contour and any regularly or irregularly flooded
vegetated wetlands.
b. The temporary placement or double handling of excavated or fill
materials within waters or vegetated wetlands is not authorized.
c. The activity will be conducted in such a manner aIt`to prevent a
significant increase in turbidity outside the area of construction or
construction-related discharge. Increases such that the turbidity in the
waterbody is 25 NTU's or less are not considered significant.

If any change in your work is required because of unforeseen or altered
conditions or for any other reason, plans revised to show the change must be
sent promptly to this office and the North Carolina Division of Coastal
Management prior to performing any such change or alteration. Such action is
necessary as revised plans must be reviewed and the authorization modified.
