A copy of the General Certification is attached. Mis Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 26. City of Raleigh Walnut Creek Sewer 3 Wake County This project was referenced to the Corps of Engineers after 75 percent of the line was installed. The Corps requested permit application, but did not require cessation of construction. Construction has been completed on the project. The Division of Land Quality and Eric Alsmeyer have both been satisfied kth the project and site restoration. For this reason I recommend the state waive its right to issue a water quality certification:. 2. George Vick Excavation and fill Nash County Mr. Vick has already completed the fill of 0.16 acres of wet lands, and received an after-the-fact Nationwide 26 permit from the Corps of Engineers. I recommend the state waive its general certification for this project. 3. Albert Rose Fill Activities Nash County Mr. Rose has already completed the fill of 0.90 acres of wetlands, and received an after-the-fact Nationwide 26 permit from the Corps of Engineers. Dear Mr. Vick: Reference is made to your meeting of April 10, 1991, with Mr. Ken Jolly of my staff on your property immediately west of S.R. 1426 (Sykes Road) and Spring Branch near the Corinth Community, Nash County, North Carolina. The purpose of this meeting was to discuss your recent excavation and fill activities on the site. The property is located adjacent to, and above the headwaters of, Spring Branch. .The meeting revealed that your.excavation of a.pond and construction of an access drive across an unnamed tributary to Spring Branch has adversely modified approximately 6,840 square feet (0.16 acre) of wetlands and waters subject to our regulatory jurisdiction pursuant to Section 404 of the Clean Water Act. For the purposes of the Corps of Engineers' Regulatory Program- Title 33, Code of Federal Regulations (CFR), Part 330, published in--the- Federal Register on November 13, 1986, lists nationwide permits. Authorization was provided for discharges of dredged or fill material into non-tidal-rivers, streams, and their lakes and impoundments, including adjacent wetlands, that are located-above the.headwaters and other non=tidal waters of the United States,.including adjacent wetlands, that are not a part of a surface-tributary system to interstate waters ..or navigable waters of the United States. Your excavation and fill activities within waters of the United States, involving adverse modification to less than an acre of waters and wetlands (0.16 acre), are authorized by nationwide permit provided that you strictly comply with the enclosed conditions. As discussed with you, and in accordance with Condition "e" of the enclosure, q: 1 fi7.1 must be stabilized and maintained to prevent sedimentationadjacent -waters or wetlands. This verification will be valid ui i1 the nationwide permit is modified, reissued, or revoked. All nationwide` permits are scheduled to be modified, reissued, or revoked prior to January 13, 1992. It is incumbent upon you to remain informed of changes to the nationwide permits. We will issue a public notice announcing changes when they occur.
