Upon review of your request for Water Quality Certification
to plaCoe`fill material in 0.9 acres of wetlands for development,
we have determined that the proposed fill can be covered by
,General Water Quality Certification No. 2176 issued November 4,
1987. A copy of the General Certification is attached. This
Certification may be used in qualifying for coverage under Corps
Hof Engineers' Nationwide Permit No. 26.

Subject: 401 Water Quality Certifications
1. City of Raleigh
Walnut Creek Sewer
-Wake County
This project was referenced to the Corps of Engineers after 75
percent of the line was installed. The Corps requested permit
application, but did not require cessation of construction.
Construction has been completed on the project.
The Division of.Land Quality and Eric Alsmeyer have both been
satisfied, with.the project and site restoration. For this reason I
recommend the state waive its right to issue a water quality
certif ivtipm.
2. George Vick.
Excavation and fill
Nash County
Mr. Vick has already completed the fill of 0.16 acres of wet lands,
and received an after-.the-fact Nationwide 26 permit from the Corps of
Engineers. I recommend the state.-;waive its general certification for
.this project.
3. Albert Rose
Fill Activities
Nash County
Mr. Rose has already completed the fill of 0.90 acres of wetlands,
and received an after-the-fact Nationwide 26 permit from the Corps of
Engineers. I recommend the state waive its general certification for
this project.

Reference is made to your meeting of April 1991: Witti r. Ken Jolly of
my staff on your property located between S.I.R. 1713`(d?lplI ill; oad) and U.S.
^01.Bypass in Rocky Mount, Nash County, North-Carolin e?purpose of this
meeting was to discuss Department of the Army,:,permit requi;7, ents for your
recent and proposed fill activities on the property,
The meeting revealed that the property consists of a triangular-shaped
9.3-acre tract bordered by U.S. 301 Bypass to the east, S.R. 1713 to the west,
and Seaboard Railroad tracks to the south. Based on information obtained
during that meeting and during a previous site visit, we have determined that
,approximately 0.9 acre of wetlands existed on the site prior to your recent
fill activities. The property is located adjacent to and above the
headwaters. of, an unnamed tributary to, the Tar River.
For, the purposes of the Corps of Engineers' Regulatory Program, Title- 33,--
Code.of Federal Regulations (CFR) , Part 330, published in the Federal. Register
on November 13, 1986, lists nationwide permits. Authorization was provided.
for discharges of dredged or fill material into non-tidal rivers, streams, and
their lakes and impoundments, including adjacent wetlands, that are located
above the headwaters and other non-tidal waters of the United States,
including adjacent wetlands, that are not a part of a surface tributary system
to interstate waters or navigable waters of the United States.
Your fill activities within waters of the United States on the subject
tract, involving adverse modification to less than an acre of waters and
wetlands, are authorized by nationwide permit provided they strictly comply
with the enclosed conditions. This verification will be valid until the
nationwide permit is modified, reissued, or revoked. All nationwide--permits
are scheduled to be modified, reissued, or revoked prior to January 13, 1992.
It is incumbent upon you to remain informed,,,of changes to the nationwide
permits. We will issue a public notice announcing changes when they occur.
Furthermore, if you commence, or are under contract to commence, this-activity
before the date the nationwide permit is modified or revoked, you will have 12
months from the date of the modification or revocation to complete the
activity under the present terms andsconditions of this nationwide permit.
Please be aware that this authorization does not relieve you of the
responsibility to obtain any required State or local approval.
