Reference your 9 Aug 91 application for an after- a-fact DA permit to authorize the placement of excavated/fill material in the waters/wetlands of Nicholson Creek associated with..construction of an access road and two helicopter pads at AerialGunnery,Range 78, Fort Bragg Military Reservation, Hoke County, NC. 2. Reference the 17 and 18 Sep 91 meetings held at your offices between various members of your staff, SAS, and SAW, and reference our 19 Sep 91 telephone conversation,regarding thesubject activity. 3. After much consultation with our respective staffs and Mr. Mike Lynch,' Director, Range Control at Fort Bragg,,-I understand that it has been determined that Aerial Gunnery Range 78 can be completed and become operational without.the-::-requirement for helicopter pads E and F and the access road in this area being located within the identified wetland area. Mr. Mike Smith of my regulatory staff informs me that a new configuration with the pads located on adjacent-high ground will suffice without subjecting personnel to a safety hazard during training and that the functional integrity of the training site will not be degraded. 4. In light of this new information and as a result of your recent verbal request, we have retired your after-the-fact permit application and are canceling the Public Notice issued on 22 Aug 91. 5. Mr. Smith will be contacting your staff in the immediate future to % rlinate the restoration efforts of all affected wetlands located outside the work previously approved by Nationwide Permits Nos. 14 and 26. 6. This is the report of the U.S. Fish and Wildlife Service (Service) and the Department of the Interior and is submitted in accordance with provisions of the Fish and Wildlife Coordination Act, as amended (16 U.S.C. 661-667e) and Section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543). According to the subject Public Notice, Ft. Bragg placed approximately 13,750 cubic yards of fill material in 2.56 acres of wetlands to construct an access road and two helicopter pads (Site E and F) during Range 78 construction activities. However, based on the September 23, 1991 telephone conversation between Dr. Wayne Wright, of your staff, and biologist Debbie Scruggs, of this office, Ft. Bragg has formally requested that the subject permit application be withdrawn. Additionally, Ft. Bragg proposes to remove the subject fill material from the wetlands. The Service fully supports restoration of the 2.56 acres of wetlands within Sites E and F, as well as the restoration activities at Sites B, C, D, G and H proposed in the subject Public Notice. Service biologists visited Range 78, including Sites E and F, with Mr. Michael D. Smith, of your staff, on July 5, 1990. During that visit, the subject wetland fi11s as well as extensive erosion of the Range 78 construction area and subsequent sedimentation into adjacent wetlands and uplands was observed. To prevt further degradation of fish and wildlife habitat, including wetlands and oe5 t habitats for two federally-listed endangered species, rough-leaved looses, i Lysimachia asperulaefolia) and Michaux's sumac (Rhus michauxi), the Army initiated emergency erosion and sedimentation control measures within Range 78. . The wetland construction area within Range 78 plus a 150 foot buffer area was surveyed by Dr. J.H. Carter III, Ft. Bragg's endangered species consultant for this project, in appropriate habitat for Michaux's sumac and rough-leaved loosestrife. Although Dr. Carter did not locate these species within the area surveyed, fires which occurred just prior to the survey may have eliminated the above-ground growth of these species within some sections of his survey area thereby causing their presence to go undetected during his survey (Carter. 1990. Preliminary Biological Assessment for Listed Plant Species at Range 78, Fort Bragg Military Reservation, Hoke County, North Carolina). The Service's July 20, 1990 Biological Opinion for the effects of these emergency measures on the above- listed endangered species recognized that a small, isolated patch of either of these species may be lost due to ground disturbing activities associated with construction of the erosion and sedimentation control measures. I am requesting that a public hearing be held to consider this application. It is important for the Department of the Army to remember that its objective is to protect this country from forces which would destroy it, whether those forces are from the outside or within. The regulations and guidelines pertaining to filling wetlands are clearly del-inated and available to those who wish to engage in such acti.v'. After considering all information available to me at the present time regarding the construction of rood crossings and hover pads in wetlands, I have concluded that there appears to be no justification for any of the work in wetlands to remain on Range 78. It is our position that t:^.e vo tland areas on this range could have been avoided entirely kith appropriate alternative design and care prior to construction, We dobelieve that the ranee can still serve its purpose without any of the wetland fill remaining, I, terefore, see no reason under the present regulations and policies of the Section permit program for the wetland fills to remain on this sita. 3. You should, therefore, take appropriate action to redesign and relocate all: road. crossings and hover pads presently located in wetlands en Rar.gA 18. The'enclosed copy of the "Paving, Grading, and Drainage Plan" for Aerial Gursery Range has been marked in red with our suggestions for possible relocation of these features. Please review these suggested relocations and furnish any ecommended changes or co=ents regarding them before 17 August 1990. The Aerial Gunnery Range 78 project is located on an approximately 550-acre tract in the western Coleman Danger Area in the central portion of Fort Bragg Military Reservation adjacent to Nicholson Creek in Hoke County, North Carolina (see enclosure 1). The project consists of an aerial gunnery range with control tower, latrine, rearming pads, armor moving targets with carriers, storage bunkers, stationary armor target systems with emplacements, two range control stations, utilities, roads, parking, berms, storm drainage, communications, etc. The project will be used to support training for combat units of the 82d Airborne Division and the XVIII Airborne Corps, Joint Special Operations Command, and the National Guard and Reserve Units. It will provide areas for individual attack helicopter firing and full unit aerial gunnery exercises. Fort Bragg began construction of this project in July 1989, believing that all necessary environmental clearances had been obtained. As the project was nearing completion, the base was notified by the Wilmington Dis-:rict Corps of Engineers that the project had resulted in a violation of Section 404 of the Clean Water Act. Subsequent inspection of the site revealed that the project had resulted in the discharge of fill material into approximately 7.44 acres of wetlands. Of the total fill, approximately 4.92 acres of fill was placed in waters of the United States below the headwaters of Nicholson Creek and 2.52 acres of fill was placed above the headwaters of two tributaries to Nicholson Creek. These fill areas are indicated on enclosures 2-3 as sites A-H. With this knowledge, Ft. Bragg developed a Plan of Action for resolving the existing Section 404 violation. The plan is as follows: a. Site A - This .42-acre fill (450 cubic yards) is approximately 80 feet wide and 200 feet long. The fill was used to create an access road to the site. Fill in this area extends approximately 100 feet either side of the defined channel of the stream. Based on the above, the existing fill is eligible for authorization by 33 CFR 330.5 (a)(14). Therefore, this area would remain in place. b. Site B - Remove the existing road fill (.52 acres, 711 cubic yards) and maintain the existing helicopter pad fill (.72 acres, 1,815 cubic yards). The .72 acres to be maintained is eligible for authorization under 33 CFR 330.5 (a)(26). C. Site C - Remove the existing road fill (.54 acres, 1,990 cubic yards) and maintain the existing helicopter pad fill (.24 acres., 55 cubic yards). The .24 acres to be maintained is eligible for authorization under 33 CFR 330.5 (a)(26). d. Site D - Remove all existing fill (.09 acres, 111 cubic yards) as well as the existing road which was constructed many years ago. e. Sites E and F - Request an of er-t e-fact, individual, Department of the Army permit for the 2.56 acres (13,750 cubic yards) of fill at the sites. f. Site G - Remove the .48 acres (2,963 cubic yards) of fill and shift the helicopter pad up the hill side. g. Site H - Remove the 1.88 acres (17,713 cubic yards) of fill. The plan also includes removal of the material which has eroded into wetlands due to construction to the extent practicable without destroying the existing vegetation at the site. This work would be performed by hand or with small rubber tired equipment. Once the proposed fill removal is accomplished down to preconstruction elevations, the area will be stabilized. These restored areas would then be planted with plant species which occur in she surrounding areas. While this plan was being developed, the entire Range 78 site was surveyed for threatened and endangered species and a Biological Assessment of Threatened and Endangered Species (BATES) was prepared (see enclosure 5). The BATES was then coordinated with the USFWS. As a result of this coordination, the FWS concurred in the conclusion of the BATES that the proposed restoration plan and use of Range 78 would not impact any Federally listed threatened or endangered species nor any habitat critical for their survival (see enclosure 6). After review of the plan and the BATES, the Wilmington District approved this plan and the base is currently taking steps to implement the restoration plan. Current Request. Ft. Bragg is now requesting a Department of the Army Section 404 Permit for maintaining the access road helicopter pads at Sites E and F. Construction of th cce s road and pads resulted in the filling of approximatel 2.5 acres of seasonally flooded wetlands by placement of approx ma ly _13,"750 cubic yards of clay material. The fill material was ' s. i obtained from F. Enclosure portion of the the two pads. -3- a borrow area located just south of Sites E and 4 provides a Plan and Section View Drawing of the access road which was constructed in wetlands and Alternatives Considered. In development of the plan for resolving the Section 404 violations, the primary effort was to try to remove all fill material placed in wetland areas that cannot be authorized under the Nationwide Permits at 33 CFR 330.5. However, the base was not able to do this and maintain a safe and functional range. Helicopter pads E and F and the access road in this area could not be moved without subjecting aircraft to overlapping fields of fire during target engagements, a potentially dangerous safety hazard during training exercises. If these pads cannot be maintained, the functional integrity of this training site would be substantially degraded. Environmental Impacts. As stated above, this project has resulted in the filling of 7.44 acres of wetlands. Our restoration plan for the project will restore approximately 3.5 acres of these wetlands to their previous condition. Therefore, the total wetland impact for the project would be 3.94 acres of which 1.38 acres of impact would be in wetland areas located above the headwaters of the two small tributaries to Nicholson Creek. As part of the restoration plan, a small road which historically crossed Nicholson Creek at Site H will be removed. This road was approximately 50 feet wide by 400 feet long. Therefore, approximately .5 acres of mitigation would be provided by this work. Further mitigation would be provided from the entire removal of this road since this action would restore the historic hydrologic characteristics of this portion of the creek. Creation of some emergent wetlands will also likely occur in the borrow area created at the site. However, creation of such habitat would be limited since there is currently no active stream feeding this site. Also, this borrow site will be used for placement of all material removed from wetland areas during the proposed restoration project. Construction and use of Range 78 has not and will not result in any impacts to any Federally listed threatened or endangered species. In fact, once this range becomes active, the frequent burning of the area would likely increase its ability to support such species. This frequent burning would also enhance the attractiveness of this area to wildlife during non-active periods of range operation. Appropriate erosion control techniques have been implemented at the site which will control erosion. Therefore, no water quality iwacts. would result from maintaining the existing pads and access road. To our knowledge, there are no properties listed or odd for listing on the National Register of Historic I i-A 'u alb r' Properties located c the need for further site in view of the the site. In accordance with a request from Fort Bragge the Savannah District was requested to develop a restoration plan for the reported violation. A copy of the Flan of Action and a set of drawings are enclosed. As the drawings indicate, no additional work would be required outside original construction limits for the project other than removal of material which has eroded into adjacent wetlands. All fill removed would be placed in the borrow pit which was constructed for the project. In accordance with Section 7 of the Endangered Species Act, Fort Bragg requested Savannah District to conduct a threatened and endangered species survey of the project area. The survey t has been completed, and a draft report indicating the results of the survey is enclosed. As the report indicates, neither Federally threatened or endangered species nor any critical habitat for such species will be impacted by the proposed restoration work. Also, no firm evidence could be found that the existing work impacted any such species or habitat, except for possible encroachment within red-cockaded colony 276. According to Fort Bragg, this impact was addressed in the Biological opinion prepared by your office in 1985 on the 5-year range modernization and cantonment program at Fort Bragg and will not be considered in this Section 7 coordination. Several State threatened and endangered species were located at the site. We are coordinating these findings with the State of North Carolina. The report suggests that, to protect these species, the following actions should be taken: a. All listed plants should be mapped, narked in the field, and monitored annually. b. Pixie-moss clumps around the borrow pit which have been partially buried should be carefully uncovered.' c. A plan for proper fire management of the range should be prepared. d. A long-term erosion control plan should be prepared. Fort Bragg has advised that the recommended mapping, marking, and monitoring will be accomplished as soon as a staff botanist/ecologist is hired (active recruiting is being accomplished). The draft management plan for the site includes coftrolled burning of the site every 3 years; the pixie-moss clumps will be uncovered; and strict enforcement of erosion control measures will be provided to prevent siltation of high quality savanna ecotones. In view of the above, I have determined that the proposed restoration plan and use of Range 78 will not result in any impacts to any Federally listed threatened or endangered species or their critical habitat. In accordance with Section 7 of the Endangered Species Act of 1973, I request that you review this inforipation and advise me of whether you concur with my demination as quickly as possible. Lewis Director Planning and Assessment M E M O R A N D U M TO: John Parker FROM: Bill Flournoy i3 7 SUBJECT.: Fort Bragg 404/401, Action ID. 199102985 After review of the August 22 Public Notice for a 404 permit and 401 certification for activities proposed at Fort Bragg, Action ID 199102985, I am of the opinion that the activities constitute a "major federal action. As such, the Corps of Engineers should •, undertake preparation of an appropriate NEPA document before '',making a final permit decision. KFurther, the NEPA requirement would have applied to the original action that has now led to a request for an after-the-fact permit. In the interest of avoiding future problems of similar origin, there should be an analysis of the process leading up to the original actin to determine how it should be amended. (1) If no NEPA documentation was undertaken then attention should be focussed upon the thresholds at which such review is commenced. Alr? (2) If NEPA documentation was undertaken but not circulated for agency and public review, then attention should be focused upon the integrity of such internal review. (3) If NEPA documentation was undertaken and circulated for < agency and public review, then attention should be focused upon either why the documentation did not identify the potential impacts, or why the reviewers did not respond to the projected impacts. • %Rega4dless of which scenario best fits this situation, the pro si for assuring environmental protection failed in this !"stance.
