Winston-Salem to place fill material in less than one acre of wetlands for
919/896-7007 erosion control at Range 66A located at Fort Bragg in Hoke
County, we have determined that the proposed fill can be covered
by General Water Quality Certification No. 2176 issued November
4, 1987. A copy of the General Certification is attached. This
Certification may be used in qualifying for coverage under Corps
of Engineers` Nationwide Permit No. 26.

The subject project involves the implementation of a long-term erosion
control plan at Range 66A at Ft. Bragg. At present, sediment from the target
area is being allowed to run un-checked into the headwaters of an unnamed
tributary to Little Rockfish Creek, Class "C" waters. Wetland fill will be
limited to the installation of containment berms on the downslope side of
several target cones. Considering the quantity of sediment already deposited
in the wetland, it is doubtful that this fill could have any negative impact
on the wetlands. The intent of this project is to improve, or at least limit,
any further wetland degradation. It is therefore the recommendation of this
office that the appropriate certification be granted.

with Ms. Eunice Vachta on September 6 regarding 401 permit
certification for Range 66A. Enclosed are copies of corre-
spondence issued by Fort Bragg and the U.S. Army Corps of
Engineers, Wilmington District, pertaining to permit require-
ments for Fort Bragg's proposed erosion/sediment control project
at Range 66A.

SUBJECT: Action ID. 199102251; Nationwide Permit No. 26; Proposed T--?rracing
of Range 66A, Located above the Headwaters of Little Rockfish Creek,: Hoke
County, NC
1. Reference your l May 91 Memo regarding permit requirements for the subject
firing range. In addition, reference the 17 Jan 91 onsite delineation work
completed by Mr. Mike Smith of my regulatory staff while in the company of
Dr. Kent Mitchell, USACERL, and Ms. Eunice Vachta, AFZA-DE-D, and the
subsequent 16 Apr 91 meeting between Ms. Vachta and Mr. Smith regarding this
subject.
2. Enclosures 1 and 2 to your 1 May 91 Memo reveal that the proposed
terracing will occur above the headwaters of Little Rockfish Creek and
landward of the jurisdictional wetland.delineation established by Mr. Smith.
Your proposal lies outside our jurisdictional area; therefore, a Department- of
the Army (DA) permit is not required for the proposed stabilization work.
3. As you are aware, several earthen targets are located within our
jurisdictional boundaries. Although a. DA .permit was required for this
deposition of dredged/fill material into waters and wetlands of the United
States and although this approval was not'obtained, we have determined that
due to its apparent age, additional action:is not necessary. However, Mr. Smith
has noted that your contractors typically utilize bladed equipment to retrieve
eroded materials from the side slopes of the targets from the wetland area.
This material is subsequently pushed through the wetland area, back to the
side slopes from which it originated. You should cease this activity since
the 'blading' of material.through jurisdictional wetlands constitutes a
discharge of fill material. Other means must be implemented to prevent the
erosion of this material into the wetlands.
3. Should your terracing proposal require work within our jurisdictional
areas, Nationwide Permit No. 26 (NWP26)(33 CFR 330.5 (a)(26)) allows for up to
.99 acre of fill material within this headwater situation. This approval is
contingent upon your ability to meet certain conditions and management
practices (encl). You are reminded that your proposed work must not adversely
impact any endangered species or their respective habitat. It is your
responsibility to direct a survey of Range 66A to determine whether any
Federally listed species are present and, if so, to determine that your
proposal will not adversely impact such species.

NWP 26 (Section 404) Note: Nationwide permit not available until after 401
certification has been issued or waived. Include condition 11.
Authorization was provided for discharges of dredged or fill material into
non-tidal rivers, streams, and their lakes and impoundments, including
adjacent wetlands, that are located above the headwaters and other non-tidal
waters of the United States, including adjacent wetlands, that are not a part
of a surface tributary system to interstate waters or navigable waters of the
United States. This general authorization is valid only for work that causes
the loss or substantial adverse modification of less than one acre of
wetlands.
CONDITIONS
COND 1
Any discharge of dredged or fill material will not occur in the proximity of a
public water supply.
COND 2
Any discharge of dredged or fill material will not occur in areas of
concentrated shellfish production unless the discharge is directly related to
a shellfish harvesting activity authorized by nationwide permit, 33 CFR
330.5(a)(4).
COND 3 Note: If the activity may adversely affect listed species or
critical habitat, the DE must initiate Section 7 consultation.
The activity will not jeopardize a threatened or endangered species as
identified under the Endangered Species Act, or destroy or adversely modify
the critical habitat of such species.
COND 4
The activity will not significantly disrupt the movement of those species of
aquatic life indigenous to the waterbody (unless the primary purpose of the
fill is to impound water).
COND 5
Any discharge of dredged or fill material will consist of suitable material
free 'from toxic pollutants.
COND 6
Any structure or fill will be properly maintained.
COND 7
The activity will not occur in a component of the National Wild and Scenic
River System nor in a river officially designated by Congress as a "study
river" for possible inclusion in the system.
COND S
The activity will not cause an unacceptable interference with navigation.

e -OND 9 Note: If the DE determines that such properties may be adversely
affected, he will provide the Advisory Council on Historic Preservation an
opportunity to comment on the effects. If the permittee, before or during
work, encounters a historic property, he will immediately notify the DE.
If the activity may adversely affect historic properties which the National
Park Service has listed on, or determined eligible for listing on, the
National Register of Historic Places, or if significant historic properties
are encountered before or during work, the permittee will notify the District
Engineer.
COND 10
The construction or operation of the activity will not impair reserved tribal
rights, including, but not limited to, reserved water rights and treaty
fishing and hunting rights.
COND 11
An individual state water guuality certification must be obtained or waived.
Conditions of certification will.be considered to be special conditions of the
Federal nationwide pemit. Please contact Mr. William Mills, North Carolina

COND 12

The following management practices will be followed to the maximum extent
practicable:
(1) Discharges of dredged or fill material into waters of the United
States will be avoided or minimized through the use of other practical
alternatives.

(7) Discharges into breeding areas for migratory waterfowl will be
avoided.
(8) All temporary fills will be removed in their entirety.
