Dear Mr. Dorney:
This letter is request for issuance of N. C. Water Quality Certification for the
above referenced project. I believe that the project as designed will comply
with the existing U. S. Army Corps of Engineers regional permit for mechanized
land clearing (SAWCO 81-N-000-0049) and the existing national permit (# 12)
for discharge of material for backfill or bedding of utility lines. Alternatively, for
NCDEM purposes, a total of 1.67 acres of wetlands or waters would be
-impacted by the project pursuant to national permit #26.
The proposed project consists of the installation of approximately 3,635 I.f. of
8" DIP gravity sewer line within jurisdictional wetlands and waters of the U. S.
adjacent to _??. ributary of West Buies Creek in. Harnett County, N. C. (see
attached ma This line is needed to allow completion of the Harnett Central
Middle School. Land clearing and disturbance, construction and stabilization
practices°for the project will be in accordance with the requirements specified
in 33CFR 330.5(a)(12) & (b), 330.6(a) and Regulatory Guidance Letter # 88-

Thisis the report of the U.S. Fish and Wildlife Service (Service)
on Public Notice 199101511, dated November 14, 1991. is P
Notice is an amendment to the one dated July 3, 199i Harnett
County has. requested a Department of the Army permit to
maintain an il-mileregional sewer interceptor system in the
forested.wetlands adjacent to West Buies and Buies Creeks." The
proposed system would connect existing wastewater treatment plants
near Angier and the village of Buies Creek to a proposed wastewater
.,,::.,,treatment facility to be constructed in non-wetlands, near the
confluence of Buies Creek and the Cape Fear River, all located in
Harriett County, North Carolina. This report supplements the
Service's August 5, 1991 report, and is submitted in accordance
with the Fish and Wildlife Coordination Act (48 Stat. 401, as
amended; 16 U.S.C. 661-667d), and Section 7 of the Endangered
Species Act.of 1973, as amended (16 U.S.C. 1531-1543). It is to be
used in your determination of compliance with 404(b)(1) guidelines
(40 CFR 230).and in,your public interest review (33 CFR 320.4) as
the-yrelate ..to protection of fish and wildlife resources.
According to. information provided in the Public Notice, the
location of `:`the proposed wastewater treatment plant has been
changed, and the'°diameter of some of the sewer line has been
reduced. The magnitude of these changes' .does not alter the
recommendations made by the Service in our mot recent repo of
August 5, 1991. However, rerouting the sewer main to the relocated
treatment. plant will add at least three stream.cr.ossings. If it is
necessary .to relocate the treatment plant,` wetland impacts
associated with these stream crossings will need to be mitigated in
the s~aine -manner 'as other wetland losses. According to topographic
maps of the project area, the new crossings are of intermittent
streams. The Service therefore recommends that all clearing,
excavation, and construction in these areas be conducted when the
streams are dry and that appropriate erosion control measures are
ALoyed.
