Wilmington, North Carolina 28402-1890 Action ID. 199101217 August 19, 1993 PUBLIC NOTICE MR_ UTLEY STALLINGS, Post Office Box 431, Havelock, North Carolina, has applied for a Department of the Army (DA) permit TO CONSTRUCT AN 80-SLIP MARINA, WITH ATTENDANT FEATURES, INCLUDING A FUELDDCK, BATHHOUSE, GAZEBO AND PARKING LOT, ON MITCHELL CREEK, near Havelock, Craven County, North Carolina. HISTORY: Mr. Stallings applied for a permit from the North Carolina Division of Coastal Management on January 24, 1991. The original plan called for 81 slips and included a boatramp and incidental fills in approximately 250 square feet of wetlands. on September 23, 1991, the application was revised to delete the fills in wetlands and reduce the number of slips to 80. On January 9, 1992, the application was denied by the North Carolina Department of Environment, Health and Natural Resources, Division of Coastal Management. The denial was upheld by an administrative law judge on October 21, 1992. on June 25, 1993, the North Carolina Coastal Resources Commission reversed the denial, and on July 9, 1993, the North Carolina Division of Coastal Management issued the Coastal Area Management Act permit- The following description of the work is taken from data provided by the applicant and North Carolina Division of Coastal Management Field Investigation Report. Plans submitted with the application show an 80-slip marina will be aligned along three main piers which will extend approximately 30o feet into Mitchell Creek. A fuel dock will be constructed on the southeast corner of the facility, serviced from a 1,500 gallon gas tank and a 1,500 gallon diesel tank; located on highground. The applicant proposes to convert an old fish house into a 28-foot by 28-foot gazebo. Also proposed is a 6-foot-wide walkway over coastal wetlands, leading from the gazebo to a proposed bathhouse and office- The purpose of the work is to develop a commercial marina. Plans showing the work are included with this public notice- The applicant has determined that the proposed work is consistent with the North Carolina Coastal Zone Management Plan and has submitted this determination to the North Carolina Division of Coastal Management (NCDCM) for their review and concurrence (See History above). This proposal shall be reviewed for the applicability of other actions by North Carolina agencies such as: a. The approval of an Erosion and sedimentation Control Plan by the Land Quality Section, North Carolina Division of Land Resources, pursuant to the State Sedimentation Pollution Control Act of 1973 (NC G.S. 113 A-50-66). The requested DA permit will be denied if any required State or local authorization and/or certification is denied. No DA permit will be issued until a State coordinated viewpoint is received and reviewed'by this agency. Recipients of this notice are encouraged to furnish comments on factors of concern represented by the above agencies directly to the respective agency, with a copy furnished to the Corps of Engineers- This application is being considered pursuant to Section 10 of the River and Harbor Act of 1899 (33 U.S.C. 403). Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. - The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. consultation of the National Register constitutes the extent of cultural resource investigations by the District ft9ineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehtatorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. R -3- probable impacts which the proposed activity may have on the public interest requires a careful weighing of all. those factors which become relevant in each particular case- The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental ,Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental. Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Box 867 New Bern, N.C. 28563-0867 Dear Clark: Route 1 Box 176 Havelock, N.C. 28532 (919)444-1805 In regards to the letter from Mr. Kirkman dated Sept 9, 1993 that you forwarded to me, I have carefully read the letter and was amazed by the singular thought and attitude that it displayed. It seemed to.reduce all. of the studies and negative comments from N.C. Marine Fisheries, National Marine Fisheries, Corps of Engineers, Environmental Protection Agency, N.C. Wildlife Resources Commission, Dept. of Environmental Health and Natural Resources Division of Environmental Management, Neuse River Foundation, N.C. Coastal Federation, Environmental Law Center and the hundreds of property owners, fishermen and boaters to one point - Turbidity - and then distorted that. His client's problem is that 5' draft boats cannot run in 3.5' of water. With any normal S.W. wind tide, we lose 1.5' of water in Mitchell Creek, rendering his deepest area only 3.51. Currently, our normal depth is 6.5 - 71. The boats in the proposed marina will be moored within 75' of my channel - the channel that I depend on for my livelihood. It cannot be dredged due to its location in a Primary Nursery Area. All of the mud and debrie that these boats will "kick" is directed at my channel and marina, thus filling it in and rendering my facility seriously impaired. As an avid hunter, fisherman and sportsman, I am concerned that.this. CRC reversal, if allowed to stand, will open the door for future damage to our valuable Primary Nursery Area. People would be more protective of these areas if they had lived on one for over 40 years, as I have. Mr. Kirkman's singular "Us versus Them" head fake is the same tactic that he used successfully on the CRC at Nagshead, when he said he didn't want to talk about the record and all the negative comments; he wanted to talk about "fairness". He then went on to mislead the CRC into believeing that.my family was given an original marina permit in 1988, when, in fact, we only upgraded our existing facility then, having been operating a marina here since 1951. I learned one thing as a former High School defensive back - never take a head fake - always watch the belt buckle. That's where the meat and potatoes go and where they ultimately end up. Dear Mr. Wright: °= Recently I was shocked and dismayed to learn that the Coastal Resources a Commission of North Carolina (CRCNC) voted to grant Mr. Utley Stallings a permit to construct an 80 slip marina on Mitchell Creek,. a tributary of Clubfoot Creek, on the Neuse River. RIEF N I was aware of the fact that six separate agencies, including the United E I - States Environmental Protection Agency, the United States Fish and Wildlif C Service, the National Marine Fisheries, and the North Carolina Division of ? Coastal Management, all performed separate and exhaustive studies of this project. My understanding is that ever one of these agencies recommended that Mr. Stallings' permit be denied, and that this marina should not be constructed. In addition, an administrative law judge upheld the denial of the permit on appeal. I thought that this matter finally had been put to rest in logical fashion. To my amazement, the.CRCNC, a political body, ignored all of the learned advice provided by the above-named investigative agencies, and moved to grant Mr. Stallings his permit to proceed with construction of his marina. The construction of Mr. Stallings' marina would present the following practical problems. 1) The close proximity of the proposed marina to the existing Matthews Point Marina would decrease swinging room and access to the outside slips at Matthews Point, making it quite difficult to dock boats in normal weather, and quite impossible to do so in high wind conditions. It doesn't make sense to allow construction of the new marina in such close proximity to the existing facility,so as to damage the usefullness of the-existing-facility. .. Page Two Letter to Mr. Wright 2) Construction of the new marina would create an overcrowding of the area, with 186 vessels in the mouth of this small primary fish nursery area creek. The presence of the new marina would produce one of the largest marina facilities in North Carolina, with one of the smallest areas of channel (with approximately 60 feet). 3) Construction of the new marina would create a narrow access corridor to the fueling station, approximately 160 feet wide and 500 feet long. In windy weather conditions serious accidents could occur. 4) The availability of hurricane anchorage in Mitchell and Clubfoot Creeks is currently at 100% capacity considering the 100 vessels currently moored at Matthews Point Marina, and surrounding landowner vessels. 5) The new facility would be built over the existing No Wake Zone. Mr. Wright, the United States Army Corps of Engineers must provide Mr. Stallings with a federal permit before he can proceed with construction. I urge you to join with the logical and informed decisions of six state and federal agencies and to act against the careless and whimsical decision on the part of the CRCNC. This creek is in aA, critical shellfish nursery area and flows, along with o -- Clubfoot Creek, directly into the Neuse River. The nnL water is very shallow and motor boats will churn the bottom. The N.C. Division of Environmental Management has tested the proposed site for turbidity, and determined according to State standards that a marina in this location would violate the.Turbidity Standards by a factor of 7 to 8 times the allowable amount. A permit from the Corps of Engineers to permit this marina would be in violation of the Federal Clean Water Act.
