Subject: Proposed Fill in Headwaters or Isolated Wetlands
Residential lot fill
Bladen County
Upon review of your request for Water Quality Certification
to place fill material in wetlands for home construction, we have
determined that up to 1.5 acres of fill can be covered by General
Water Quality Certification No. 2176 issued November 4, 1987. A
copy of the General Certification is attached. This
Certification may be used in qualifying for coverage under Corps
of Engineers' Nationwide Permit No. 26. The 1.5 acres of fill
should be adjacent to existing nonwetland area on the property.

Dear Mr. Dorney:
In response to your request for additional information related to the above
application, our request for three acres of fill area was made to allow us to
provide a one acre cottage site for each of our three children. We believe this
to be a reasonable and permissible use of our property.
As we said earlier, this is family owned property and is one of the last
undeveloped tracts on this lake. Since this is a one-time request, we do not
believe it sets a precedent for the use of wetlands in other locations under
different sets of circumstances.
To the best of our knowledge, this request is not governed by guidelines in
existence at this time. While use of isolated wetland tracts appears to be of
concern to your Department, "no-net-loss" of isolated wetlands does not appear
to be a part of any guidelines to which we have access. Nor does it appear to
be a policy of the State of North Carolina. Since this tract is surrounded by
fully developed areas and since we believe the environmental impact would be
slight, we therefore believe that it would be a proper use of your authority to
issue this certification.

Dear Mr. Perry:
As of today, I have not yet received a reply to my 25 April 1991
letter concerning your wetland fill project at White Lake. I
would like to process the 401 Certification but will not be able
to do so until you document the minimum amount of fill needed for
construction of the homes.
Please respond within two weeks of this letter so we can proceed

have any questions.

The subject project involves the placement of fill material in
approximately 3 acres of "isolated" wetlands at White Lake, Bladen County.
This area is separated from the lake by an area already filled under previous
COE approval.
The purpose of the fill is to provide a suitable building site for the
construction of "vacation" homes by members of the Perry family.
Although there are alternatives available to this project, i.e.
purchasing a lot in an adjacent subdivision, it appears reasonable to approve
this request. Most of the area surrounding the lake has been commercially or
residentially developed. Also, this request involves only 3 of a total of 23
acres, most of which is wetland. Rating on the Division's Wetland Rating
System Worksheet yielded a score of less than 19%. As indicated in Mr.
Perry's letter of March 31, 1991, no surface water impact is expected.
With these considerations in mind, it is the recommendation of this
office than the requested certification be granted. Minimal adverse impact
should be expected.

1. Details Of Wetland Areas To Be Filled
Attachment #1
The Proposal is to place fill material on 3.0 acres of isolated wetlands
as shown on the sketch (attachment #2).
2. Intent of Pro.iect and Alternatives
The owners are not developers. The purpose of this project is to enhance
the property for family use by increasing the usable area at this tract.
There exists approximately one acre of land on this tract which is suitable
for building a family cottage. The proposed project will expand that area
to improve landscaping and to provide additional area for other cottages.
The tract is bounded on the foursides by a paved State highway, White
Lake, a dirt access road,.and a developed residential area (Turtle Cove).
Tracts located adjacent to and East of the subject tract are owned by
other relatives and are used for recreation. The property has been in the
family for 40 - 50 years. Since the project goal is to increase the size
of the cottage building site, no appropriate alternative is available.
3. Measures To Minimize Wetland Loss
The proposed project will have a minimal impact on the environment.
There are no surface streams on this tract and the proposed fill area is
level terrain which collects rainwater and recharges the groundwater
reservoir. There is no runoff, therefore no effect on surface water by
sediment and no affected stream flow. The lake on which the tract is
located is fed by artesian springs; therefore, the placement of fill
material will not be expected to affect the lake.
Access to the property is by means of existing roads and no loss of
wetland is required to provide access for the required activity.
It is believed the proposed project will have little effect on the
ecology of the area.

Please issue a Section 401 Water Quality Certification for our use with a Na-
tionwide Permit 26 to be filed with the Corps of Engineers. The location of the
planned work is at White Lake, NC and the permit request is for placing fill
dirt on a portion of the tract for Mr. & Mrs. Dow V. Perry.
Attached are a highway map and property map showing the location of the proper-
ty. Please contact me if you have questions or require additional,,information.
I would appreciate you issuing this certification by November 30, 1990, if
possible, in order to allow action on the permit request by the Carps of Engi-

fill in wetlands between Highway 701 and the waterfront of White Lake in
Bladen County. Approximately one acre of wetland has already been filled on
the actual water front across the property owned by Mr. Perry. This fill
appears to have been placed fairly recently, probably within the last 12
months. The applicant has requested certification in order to place
additional fill in at least part of the remaining undisturbed wetlands.
No specific details have been provided regarding this project. Mr. Perry
apparently desires approval to place additional fill in order to provide
suitable land for construction of a homesite(s).
The proposed activity is not water dependent and this office cannot make
a favorable recommendation for 401 Certification until the applicant has
fulfilled the following:
1. Provide details concerning the size of the area to be filled.
2. Show evidence that there are no practicable alternatives for
achieving the ultimate intent of the project.
3. Identify any measures which will be taken to mitigate the loss of
the wetland.
In regard to the previous filling, our office has advised the COE of this
matter.
Once these terms have been suitably addressed, the project may be
reevaluated. If additional information or clarification is required, please
contact Ken Averitte at 486-1541.
