919,946-6481 On 26 November 1991, the N.C. Division of Environmental
Wilmington Management received a copy of your plans to fill wetlands at
919/395-3900 Northridge Center. The letter from the Corps of Engineers
indicated that you are eligible for a NW26 permit since you plan

wi896 to fill less than one acre of wetlands. However, your project
will need an individual 401 Water Quality Certification since it
is adjacent to Horsepen Creek which is classified as WS-III
waters. Your project cannot legally proceed since your 404
Permit is not valid without a 401 Certification.
Therefore, if you still want to pursue this project, please
notify me in writing of your desire to obtain a 401
Certification. I will then publish a notice in a local newspaper
to solicit public comments. Accordinq to our regulations (15A
NCAC 2H .0502 (f)), you will need to reimburse the Division for
the expense of this notice. You will be billed after
publication.

classified as a WS III NSW watershed. The plans are to
construct a pond impacting approximately 0.04 acres of
wetlands. It is likely that the pond will create wetlands to
offset the wetlands lost.
The WSRO recommends that a 401 certificate be issued for
the subject project.

Dear Sirs:
Reference the site visit of November 15, 1991, conducted by Mr. John
Thomas of my staff at your property located off U.S. 220 (Battleground
Avenue), adjacent to an unnamed tributary of Horsepen Creek, Greensboro,
Guilford County, North Carolina. The purpose of this meeting was to
review provided plans for a proposed pond (storm water basin) on the
aforemention tributary, and to inspect the site for wetlands subject to
Department of the Army permitting authority.
For the purposes of the Corps of Engineers' Regulatory Program, Title
33, Code of Federal Regulations (CFR), Part 330, published in the Federal
Register on November 13, 1986, lists nationwide permits. Authorization was
provided for discharges of dredged or fill material into non-tidal rivers,
streams, and their lakes and impoundments, including adjacent wetlands, that
are located above the headwaters and other non-tidal waters of the United
States, including adjacent wetlands, that are not a part of a surface
tributary system to interstate waters or navigable waters of the United
States.
The site visit revealed that the proposed site is located adjacent to,
and above the headwaters of, an unnamed tributary of Horsepen Creek. The
review of the proposed development plans indicates that construction of the
pond will involve adverse modification to 1,650 square feet (0.04 acre) of
wetlands on the aforementioned tributary.
Your proposed work, involving adverse modification to less than an acre
(0.04 acre) of waters of the United States located above the headwaters of
the aforementioned tributary, is authorized by nationwide permit provided it
is accomplished in strict accordance with the enclosed conditions. Please
be aware that this authorization does not relieve you of the responsibility
to obtain any other required or local approval. You should contact Mr. John
Dorney, North Carolina Division of Environmental Management, (919) 733-5083,
to obtain the necessary Section 401, Water Quality Certification prior to t
starting work.
This verification will be valid until the nationwide permit is modified,
reissued, or revoked. All nationwide permits are scheduled to be modified,
