Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity it the Stream is 25 NTU's or less are not considered significant). Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal Permit. This the 15th day of July, 1991. Sizemore landfill in Guilford County has been examined by our regional office staff. Since the project is in a water supply watershed, our General Certification for NW26 is not applicable. Therefore, I will need to publish a public notice of the project in order to process an Individual 401 Certification. If you would like me to pursue this process, please advise within two weeks of this date. Also, the Division will request (by copy of this letter) that the N-:_-th Carolina Wildlife Resources Commission conduct a site 0 examination to determine whether any rare, threatened or endangered amphibians are present. It is out on public .notice now since it is in a water supply watershed. When Eric Galamb (Winston-Salem Regional office (919/896-7007) visited the site in April, he noted the presence of several salamander and frog species. We would appreciate a visit by a trained WRC staff member able to identify these species with respect to their endangered/threatened/rare status. If this is possible, please have your WRC staff member contact Eric to arrange a time for site visit. If this is not possible, please advise me. The area has several unique characteristics. There were unusual salamanders and frogs observed at the site. The WSRO requests that a Wildlife Commission i Representative inspect the site for the salamanders and frogs. It appeared that pickerel-weed was growing on the edge of the creek. It appeared to be unusual and unique to be found in this location. The existing pond had yellow water lilies, another aquatic plant and Canada geese on it. Because of the unique character of the wetland, the WSRO recommends that the owner provide mitigation. The WSRO defers recommendation until the wildlife representative has located and identified the salamanders (lizard) and frogs to determine their endangerment status. Also in attendance was Mr. Gene Mustin of Borum Associates, engineer consultant for the proposed project. The purpose of this meeting was to discuss the plans for the proposed demolition landfill and to inspect the site for waters and wetlands subject to Department of the Army permitting authority. This letter also confirms the March 25, 1991, wetlands survey verification. Based upon previous onsite inspections and review of the aforementioned survey, we recognize this surveyed alignment to be the limits of our regulatory jurisdiction for the proposed landfill limits. Unless there is achange in the law or our published regulations, this determination of the limits of wetlands may be relied upon for a period not to exceed 3 years. Also please reference site plans forwarded to the Raleigh Field office on March 22, 1991. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330, published in the Federal Register on November 13, 1986, lists nationwide permits. Authorization was provided for discharges of dredged or fill material into non-tidal rivers, streams, and their lakes and impoundments, including adjacent wetlands, that are located above the headwaters and other non-tidal waters of the United States, including adjacent wetlands, that are not a part of a surface tributary system to interstate waters or navigable waters of the United States. The meeting,of September 21, 1990, revealed that the proposed site is located adjacent to and above the headwaters of Moores Creek. A review of the proposed aforementioned development plans showed adverse impacts to 0.35 acre of jurisdictional wetlands. All other proposed development was on high ground. Your proposed work, involving adverse modification to 0.35 acre of waters of the United States located above the headwaters of the aforementioned tributary, is authorized by nationwide permit provided it is accomplished in strict accordance with the enclosed conditions. Please be aware that this authorization does not relieve you of the responsibility to obtain any other required State or local approval. Furthermore, if you commence, or are under contract to commence, this activity before the date the nationwide permit is modified or revoked, you will have 12 months from the date of the modification or revocation to complete the activity under the present terms and conditions of this nationwide permit. Please be reminded that no excavated or fill materials may be placed in any waters or wetland areas without prior Federal permit authorization.
