Pond construction - Sandler/McNainy Property
Guilford County
Upon review of your request for Water Quality Certification
to place fill material in 1.0 acres of wetlands for pond
construction, we have determined that the proposed fill can be
covered by General Water Quality Certification No. 2176 issued
November 4, 1987. A copy of the General Certification is
attached. This Certification may be used in qualifying for
coverage under Corps of Engineers' Nationwide Permit No. 26.

No site inspection was made for the subject project.
The proposed pond is to impact 1.0 acres of wetlands. The
pond is tributary to Mears Fork Creek, a WS III NSW
watershed. Please issue the 401 certificate with the
following stipulation: The dam shall be a siphon dam where
it shall discharge cooler water from below the water
surface. This discharge shall occur in the existing
wetlands associated with Mears Fork Creek.
The WSRO recommends that a certificate be issued with
the above stipulation.

Dear Mr. Sandler:
Reference the meeting on March 11, 1991 with Mr. John Thomas of my staff
onsite of the proposed Sandler/McNairy Properties pond located near the
intersection S.R. 2305 and S.R. 2311 adjacent to an unnamed tributary of Mears
Fork Creek, north of Greensboro, Guilford County, North Carolina. Also in
attendance was'Mr. Gene Mustin of Borum Associates, engineer consult for the
proposed pro}fit. The purpose of this meeting was to discuss the plans for

regulatory jurisdiction for the proposed landfill limits. Unless there is a
change in the law or our published regulations, this determination of the
limits of wetlands may be relied upon for a period not to exceed 3 years.
Also please reference site plans forwarded to the Raleigh Field office on
March 27, 1991.
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330, published in the Federal Register
on November 13, 1986, lists nationwide permits. Authorization was provided
for discharges of dredged or fill material into non-tidal rivers, streams, and
their lakes and impoundments, including adjacent wetlands, that are located
above the headwaters and other non-tidal waters of the United States,
including adjacent wetlands, that are not a part of a surface tributary system
to interstate waters or navigable waters of the United States.
The meeting of March 11, 1991 revealed that the proposed site is located
adjacent to, and above the headwaters of, Mears Fork Creek. A review/of th
proposed aforementioned development plans showed adverse impacts to }ie 0.8
acre of jurisdictional wetlands. All other proposed development was bn hi
ground.
Your proposed work, involving adverse modification to 0.8 acre of waters
of the United States located above the headwaters of the aforementioned
tributary, is authorized by nationwide permit provided it is accomplished in
strict accordance with the enclosed conditions. Please be aware that this
authorization does not relieve you of the responsibility to obtain any other
required Stat or local approval. You should contact Mr. John Dorney, North
Carolina Divisicr± of Environmental Management, (919) 733-5083, to obtain the
necessary Section Water Quality Certification prior to starting work.

Enclosed is a copy of the site plan for the above mentioned project. The
property is located on SR 2305 near the intersection of SR 2305 and SR 2311,
above Mears Fork Creek, north of Greensboro, Guilford County, North Carolina.
The initial proposal was to fill 0.8 acres of wetlands with the water of a
proposed pond. I obtained approval for a Nationwide Permit No. 26 from the
U.S. Army Corps of Engineers on this initial proposal. In the interim my
client has asked me to increase the size of his proposed pond, thereby
impacting a total of 1.0 acre of wetlands. This revision is being
resubmitted to the U.S. Army Corps of Engineers for approval. If possible,
please proceed with your review of this plan for the necessary approvals
pertaining to the Section 401, Water Quality Certification.
