The category of activities shall include any fill activity in these headwaters and isolated wetlands areas where the activity does not result in the loss or substantial:-modification of 10 acres or more of waters of the United -States,, including wetlands. Proposed fill or substantial modification of 1 to 10 acres of such waters, including wetlands, requires a written concurrence from the Division of Environmental Management. Activities involvinq less than one acre do not require written concurrence. 7. Proctor, Jr. 4131 Arlington Street Rocky Mount, North Carolina 27801 Dear Mr. Proctor: I?91 Reference is made to a meeting on December 13, 1990, between Mr. Ramon Sundquist of my staff and yourself on your farm near Sharpsburg, Edgecombe County, North Carolina. The purpose of that meeting was to discuss Department of the Army permit requirements for the construction of a proposed cattle barn and sewage/washdown lagoon (approximately 50 feet by 50 feet) on your property above the headwaters of an unnamed tributary to Cokey Swamp. Based on that meeting and an inspection of the project site, your proposed cattle barn would be constructed on the high ground as established by Mr. A. B. Whitley, Soil Conservation Service, and would not be subject to our regulatory jurisdiction under Section 404 of the Clean Water act. Your proposed lagoon location, however, is within wetlands and would be subject to our regulatory jurisdiction. The lagoon would not be exempt as an irrigation pond, even though you stated that you intended to spray your field with the effluent. The lagoon's primary purpose is to hold cattle effluent with irrigation being a method of removal. The farm pond exemption would not apply to this activity. By letter dated July 16, 1990, you were notified that your proposed placement of excavated material into wetlands, associated with your excavation of a 600-foot-long ditch, was authorized by a nationwide permit in our regulations. During this inspection it was determined that your proposed lagoon and the previously authorized fill would still result in an area of less than 1 acre of wetlands subject to our regulatory jurisdiction under Section 404 of the Clean Water Act. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330, published in the Federal Register on November 13, 1986, lists nationwide permits.
