A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 26. Duplin County PROJECT DESCRIPTION: The applicant proposes to develop a 1.07 acre parcel for the purpose of constructing a gas station. During a site visit on July 18, 1991, it appeared the entire 0.76 acres proposed for fill had been cleared and graded. The project has been reviewed to determine impacts to water quality. The following comments have been provided. 1. The project will require a 401 Water Quality Certification. 2. The project complies with the General 401 Water Quality Certification No. 2176 for headwaters and isolated wetlands. 3. The proposed project should be done in such a way as to not cause the turbidity outside the immediate construction area to exceed 50 NTU. This office has no objection to the project as proposed. Box 1890 ATTN: Regulatory Branch Mr. David Franklin Re: Marine Oil Co., Inc. development, Duplin County, NC Dear Sir: Harine Oil Co., Inc. proposes to develop a commercial enterprise on a 1.07 acre parcel at the intersection of I-40 and I\JC 24 near the Town of Warsaw in Duplin County, NC (Fig. 1 and 2). The property is currently undeveloped, and has been cleared of most significant forms of vegetation. Biologists with Environmental Services, Inc., Raleigh, N.C., visited the site on January 10, 1991 to determine presence and general location of wetlands. Although there are no streams, tributaries or other permanent water bodies on the property, field indicators (soils, surrounding vegetation, hydrology) suggest that the site may be subject to jurisdictional consideration under Section 404 of the Clean Water Act. Site impacts associated with our project will be concentrated on portions of the property bordering the NC 24 corridor. Approximately 0.76 acres will be directly affected by filling and development (Fig. 2). We believe that potential infringement on area wetlands can be authorized under Nationwide Permit #26 (33 CFR 330.5(a) (26)). Although takings of less than one (1.0) acre of above headwater wetlands do not require written authorization from your office, we are submitting a Pre-discharge Notification (PDN) application with a copy of our site plan for your review and evaluation. By copy of this letter, we are forwarding similar information to the Division of Environmental Management, N.C. Department of Environment, Health and Natural Resources (DEHNR) to request confirmation for use of 401 General Water Quality Certificaiton. I trust you will find the enclosed data sufficient to complete your evaluation of the project.
