from Mr. D. Engineer with the Department
of Environ As he states i..i the letter,

I hope this provides the necessary information as to orignal depth of the
subject mosquito ditches. When we met in Raleigh it was my understanding
that DEM's position was excavation to original depth was acceptable if it
could be documented. I believe that we have provided that documentation.
Therefore, I request that you remove DEM's objection to the Major CAMA
permit application for maintenance excavation of canals adjacent the Harris
Properties project that is now pending a permit decision.

Dear Kr. Lassiter:
I submit the following information to you as a result
of our recent phone conversation.
It would be extremely difficult, probably impossible,
to ldcate any maps of mosquito control ditches in the Wan-
chese area that would show the depth of cut. These diiyches
were cut 20-25 years ago, before regulatory agencies demand-
ed information.
Being the designated engineer for this work back then,
I recall that the average cut of all ditches in the salt
marshes was four feet. If I can be of further assistance
to you or your firm, please contn.ct me.

Dear John:
Per our 7 May 91 telephone conversation I am forwarding to "
you two (2) Dare County Tax Maps on which I have color coded'the
location of the proposed Harris Properties project and the
adjoining waters. I believe these maps, in conjunction with the
CAMA application, help indicate the extent of the adjoining canal
system. The adjoining system has a straight line connection to
both the north and south canals adjacent to the Harris property
that are proposed for maintenance excavation. It does not seem
to me a valid argument that the removal of less than 1000 yards
of loose sediment from these canals to a depth of -4 feet will
create a major change in dissolved oxygen within the system. It
is my position that the excavation will improve water circulation
in that portion of the canals and that DO levels will not be
significantly altered.
Thank you for your attention to this matter. I request that
you review the file and contact Mr. George Matthis of the
Division of Coastal Management after you make a determination. I
am forwarding a copy of this information to him as well. The
Elizabeth City Office of DCM has recommended issuance of the
permit and it seems to me that with a moratorium on dredging
during periods of larval recruitment and growth the nrODospr9

3' canal to a width of 25' and depth of -41. While no structures are
(,proposed applicant does indicate that 13 parcels will be divided from
this property.

Site Description
The applicant currently owns a 9.26 acre site in Manteo.
The site is located on the northeast side of Highway 64/264 about
100 yards southeast of the Manteo Hardee's. Turn down a sand
lane marked by a Sun Realty Sign and go 200 yards.
The site is predominately upland and vegetated by loblolly
pine, lawn grasses, wax myrtle and blackberry bushes. Two 404
wetlands dominated by Phragmites communis, loblolly pine,
Spartina patens, wax myrtle and Juncus roemerianus account for
.84 acres of the site. A thin fringe of Juncus roemerianus
coastal marsh is scattered along one canal and measures 50' x 21.
The property is nearly surrounded by canals and is currently
accessible by boats from Shallowbag Bay and Scarborough Creek.
Two borrow pits were excavated along the southwest and northwest
boundary lines. These pits are -5' to -8' deep and were
constructed in 1974 under state permit number 120-74. Two
mosquito ditches 17' x -3' form the properties northwest and
southeast boundary lines. The mosquito ditches connect the
borrow pits to Shallowbag Bay, classified as SC waters, and also
designated as a primary nursery area.
The applicant proposes to excavate the canals to a uniform
depth of -4' and a width of 251. The spoil will be removed by
backhoe and deposited along the canal on adjacent high ground.
No other development is proposed at this time, however, the
applicant indicated that he eventually intends to develop the
property into 13 lots on individual septic tanks.
Anticipated Impacts
This project will result in the loss of 100 sq. ft. of
coastal marsh and 2,080 sq. ft. of 404 wetlands. 1 The existing
canals will be deepened from -3' to -4' for a total area_ of_i
15,810 sq. ft. The restricted flow of this-canal system because
of length and 900 turns may result in slow flushing and poor
water quality. The development of this area will result in
increased boat traffic with the associated impacts of fuel spills
and overboard discharge of sewage. These impacts are difficult
to quantify.

conservation class is to provide for effective, long-term
management of significant limited or irreplaceable areas.
