Upon review of your request for Water Quality Certification
to place fill material in 2.0 acres for hog operation
construction, we have determined that the proposed fill can be
covered by General Water Quality Certification No. 2176 issued
November 4, 1987. A copy of the General Certification is
attached. This Certification may be used in qualifying for
coverage under Corps of Engineers' Nationwide Permit No. 26.

PROJECT DESCRIPTION: The applicant proposes to construct a swine
lagoon in approximately 2 acres of 404 wetlands.

The project has been reviewed to determine impacts to water
quality. The following comments have been provided.
1. A site visit was conducted on June 27, 1991. Please find
the attached Wetland Rating System Worksheet.
2. The project will require a 401 Water Quality Certification.
3. The project complies with the General 401 Water Quality
Certification No. 2176 for headwaters and isolated wetlands.
4. The proposed project should be done in such a way as to not
cause the turbidity outside the immediate construction area
to exceed 50 NTU.
This office has no objection to the project as proposed.

Dear- Mr. Stacks:
I made a detailed soils investigation of the soils mapping
on the wooded areas mapped Lynchburg fine sandy loam and
Grifton fine sandy loam. The soils mapping is correct.
This is the farm adjacent to NC: 904 where the swine I agoo-n
is being planned.
The areas mapped Lynchburg fine sandy loam will be
designated as a non-wetland. The areas mapped Gr° i f ton w i l l
be designated as a wetland. There is approximately 2.0
acres of wetland areas that would be involved with the
construction of the swine lagoon.

Reference your May 22, 1991, meeting with Mr. Jeff Richter of my staff
concerning your proposed construction of a hog operation on a tributary of
Grissett Swamp off N.C. 904 near the Guideway community in Columbus County,
North Carolina.
Mr. Richter determined that your proposed construction site includes
wetlands under our jurisdiction pursuant to Section 404 of the Clean Water
Act. These wetlands are located in all areas which are not presently under
cultivation or considered "prior converted" wetlands by the Soil Conservation
Service. He has determined that this site is above the headwaters of the
tributary (enclosed map), although very close to being adjacent to Grissett
Swamp. Roughly, the headwaters point is the wetland road crossing which you
walked. South of this crossing, or towards N.C. 904, is headwaters.
As Mr. Richter explained onsite, the difference in these classifications
is that projects performed in headwater areas may be eligible for
authorization under our Nationwide Permit No. 26 (NWP26). Projects in adjacent
wetlands require authorization by individual permit, a more lengthy and
difficult process. You stated that your present plans call for a majority of
the work (primarily the waste lagoon) to occur in the wooded wetlands
identified by Mr. Richter, although you have several options available.
Please contact this office upon your finalization of your desired layout and
design. If you can limit all impacts of the project to less than an acre of
wetlands in the headwaters, your proposal may be authorized by NWP 26.
Impacts to greater than one but less than 10 acres of wetlands in the
headwaters may also qualify for Federal authorization pursuant to NWP 26. To
apply, please complete the enclosed pre-discharge notification (PDN) form, and
submit it with a copy of your Section 401 Water Quality Certification from the
North Carolina Division of Environmental Management. The 401 Certification is
required to validate nationwide permit No. 26 in the State of North Carolina.
It must be submitted prior to or with the PDN application.
