Subject: Proposed Fill in Headwaters or Isolated Wetlands
near SR 1141 and 905
Columbus County
Upon review of your request for Water Quality Certification
to place fill material in about 1.6 acres of wetlands for an
electric substation shown on the January 16, 1991 letter, we have
determined that the proposed fill can be covered by General Water
Quality Certification No. 2176 issued November 4, 1987. A copy
of the General Certification is attached. This Certification may
be used in qualifying for coverage under Corps of Engineers'
Nationwide Permit No. 26.

3. That the discharge will consist of suitable
material free from toxic pollutants in other than
trace quantities; .
4. That established erosion control practices are
utilized to prevent excessive increases in
turbidity and settleable solids concentrations in
the water body as a result of the discharge;
5. That the discharge of fill material shall be in
accordance with the conditions and management
practices specified by the Corps of Engineers in
33 CFR 330.5 and 330.6 for nationwide permit
number 26.
Non-compliance with or violation of the conditions
herein set forth by a specific fill project shall result in
revocation of this Certification for the project.
The. Director of...the..North .- Carolina.:Division of
Environmental Management may-- equire?submission of a format
application -for certification- for-.any project in this
category of activity, 'if'it is. determined that the project
is likely to have a significant adverse effect upon water
quality or degrade the waters so that existing uses are
precluded.
Public Hearings may be held for specific applications
or group of applications prior to Certification if deemed in
the public's best interest by the Director of the North
Carolina Division of Environmental Management.

PROJECT DESCRIPTION: The applicant proposes to construct an
electrical substation on a 2.46 acre site, all of which is 404
jurisdictional wetlands. The substation itself will occupy .75
acres. The total area to be graded or disturbed was originally is
2.46 acres. The current proposal is to disturb a total of
approximately 1.6 acres. The site is located on the corner of SR
1141 and NC 904. There is a single family residence on the lot
directly to the east of the site and an agricultural field to the
south. The site has been cleared and has two existing ditches
crossing it from east to west.

CLASSIFICATION: CSw
The project has been reviewed to determine impacts to water
quality. The following comments have been provided.
1. The project will require a 401 Water Quality Certification.
2. The project complies with the General 401 Water Quality
Certification No. 2176 for the placement of fill material in
headwaters or isolated wetlands.
3. Per the attached letter from W. Ronald Hayes dated January
7, 1991, there are two acceptable sites for the substation,
one of which "is not for sale at any price". Mr. Hayes also
stated, because of power demand in the area and the location
of existing power lines the substation needed to go at the
proposed location. Apparently there are no practicable
alternatives to the proposed location.

4. Per Mr. Hayes' fax of January 16, 1991, he has agreed to
limit grading to those areas needed for the substation
itself plus additional area needed for truck access to the
substation. He indicated the shaded area on the plan is to
remain unimproved.
5. It is recommended a Certification be issued for the project
excluding the shaded area on the January 16, 1991 plan. It
is also recommended the Certification be conditioned to
require this area to remain undisturbed and that it shall be
replanted with species to be specified by DEM.
This office has no objection to the project as proposed.

I met with Mr. Jim Grayson today, January 7, 1991, at our proposed
substation site at the intersection of Rd. # 904 and 1141. Mr. Grayson
feels that we should look into any "viable alternatives" to erecting a
Substation on this site-
Before selecting this as a substation site we did a lengthy study into
the location of said substation, and found that this was one of two
feasible sites, because of the load growth in that area and the arrangement
of our existing power lines. We found that the other property was "not for
sale at any price" to quote the land owner. It has become imperative that
we build a substation in this area as soon as possible in order to serve
the needs of our membership in that area of Columbus County.
Again, let me emphasize that we are not going to "destroy" this
property- We only want to get the property, with the exception of
approximately .75 acres, which will be the actual substation, in shape to
provide access to the substation.

Dear Mr. Mills:
Reference our conversation of November 28, 1990 concerning the
location of a Substation in the Guideway area of Columbus County,
North Carolina.
I have been in contact with Mr. Jeff Richter of the Corps of
Engineers in Wilmington, N.C.. He informed me that this site is
considered wet lands, but is located above the headwaters of a
tributary of Grissett Swamp, and that I needed a "Section 401
Certification" from your department.
Please consider this a letter of request that the proposed fill
activities associated with the building of a substation on said
site, be covered under the general certification for fill above the
headwaters of said tributary.
Our plans are clear, grade and seed the entire site (2.46 acres)
with the exception of approximately three quarters (.75) acres (see
attachment) which will be filled with suitable materials (rock and
sand) for the construction of a new substation. The entire site
must be cleared and graded in order to provide access to the sub-
station.

INFORMATION SHEET - NATIONWIDE PERMIT 26
1. Nationwide permit 26 authorizes the discharge of dredged or fill material
which will cause the loss or substantial adverse modification of less than 10
acres of (i) non-tidal rivers, streams, and their lakes and impoundments,
including adjacent wetlands, that are located above the headwaters; and (ii)
other non-tidal waters of the U.S., including adjacent wetlands, that are not
part of a surface tributary system (i.e., isolated waters). The district
engineer must be notified if the discharge will cause the loss or substantial
adverse modification of 1 to 10 acres of such waters. This notification
process is called a pre-discharge notification.
2. The applicant shall not begin discharges requiring pre-discharge
notification under nationwide permit 26:
a. Until notified that the work may proceed under the nationwide permit
with any special conditions imposed by the district or division engineer, or
b. If notified that an individual permit may be required, or
c. Unless 20 days (calendar) have passed from the time the notification
is received by the district engineer and no notice has been received from the
district or division engineer.
3. Notification under NW? 26 must be in writing and should include the
following:
a. Name, address and phone number of owner;
b. Location of the planned work;
c. Brief description of the proposed work, its purpose, and the
approximate size of the waters, including wetlands, which would be lost or
substantially adversely modified as a result of the work; and
d. Any specific information required by the nationwide permit and any
other information that the applicant believes is appropriate.
e. Signature of owner.
f. Applicant is required to obtain a Section 401 Water Quality
Certification from the State of North Carolina for NWP 26 to be valid.
Applicant should furnish a copy of the certification with the pre-discharge
notification to the Corps of Engineers. To obtain a Section 401
dertification, applicant should contact:
