Subject: Proposed Fill in Headwaters or Isolated Wetlands
Pipeline renovation/restoration
Cleveland County
Upon review of your request for Water Quality Certification
to place fill material in less than one acre acre of wetlands for
pipeline restoration under Ponder's Branch, we have determined
that the proposed fill can be covered by General Water Quality
Certification No. 2176 issued November 4, 1987. A copy of the
General Certification is attached. This Certification may be
used in qualifying for coverage under Corps of Engineers'
Nationwide Permit No. 26.

Staff of this Office have reviewed the subject certification
request and offers the following comments.
This Office has no objections to the proposed repairs. The
total wetlands disturbance area appeared to be much less than one
(1) acre, and any disturbance should not have a significant
impact.

Re: General Water Quality Certification to Restore Cover Over
Existing Natural Gas Pipeline Crossings Under Ponder's
Branch in Cleveland County, North..Cai?O;l.ina
Dear Mr. Dorney:
Following our telephone conversation th4-, afternoon, I am en-
closing the following items in connection-with issuance of a
General Water Certification for the above project:
1. a copy of my June 14, 1991 letter to Steve Lund, U.S. Army
Corps of Engineers, Wilmington District, requesting project
authorization under Nationwide permit 26; the letter, and
attachments thereto, contains a detailed description of the
proposed work and copies of a project location map, as well
as a plan/profile drawing of the work; and
2. a copy of Mr. Lund's Nationwide Permit Verification indicat-
ing the work is authorized by Nationwide permit 26.
General Condition k of the Nationwide permit requires that State
water quality certification be obtained or waived. Please review
the enclosed materials for consistency with the requirements for
General certification. In order to begin this work as soon as
possible, I would appreciate it if you would send a FAX copy of
the certification to (713) 439-4551 prior to mailing the original
to me.
