That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the Stream is. 25 NTU's or less are not considered significant). The project, involving construction of a weir to enhance cold water fishery, is located .9 miles below Chatuge Dam near Shooting Creek, in Clay County. Based on a coordinated agency review, this state viewpoint will interpose no objection to the project from an environmental standpoint. It is important to note for the record, however, a letter of broad general concern from the Division of Archives & History concerning TVA activity in N.C. I refer to a letter of Feb. 7, 1992 from David Brook, Deputy State Historic Preservation office to Colonel Tulloch. We respectfully suggest your office provide appropriate attention to any matters under your purview relative the situation described in Mr. Brooks' letter. The additional key agency comments for the record are as follows: Wildlife Resources Commission supports the project and recommends the following permit conditions to minimize adverse impacts: 1) Construction must be accomplished so that wet concrete does not contact water entering or flowing in the Hiwassee River. This will reduce the likelihood of fish kills associated with weir construction. 2) Stringent erosion control measures should be implemented where soil is disturbed and maintained until project completion. Parker, 404 Coordinator Division of Coastal Management FROM: Dennis Stewart, Manager Habitat Conservation Section DATE: January 15, 1992 SUBJECT: U.S. Army Corps of Engineers Public Notice No. 199200576, request by Tennessee Valley Authority for a permit to discharge fill material into the Hiwassee River.in conjunction with the construction of a flow reregulation weir downstream of Chatuge Dam, Clay County. The North Carolina Wildlife Resources Commission (NCWRC) has reviewed the information provided by the U.S. Army Corps of Engineers, and biological field staff are familiar with the project site. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.), and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661=667d.). The applicant is requesting a permit to construct a 140-foot long, 50-foot wide, 8.25-foot high weir in the Hiwassee River about 0.9 mile downstream of Chatuge Dam. The purpose of the project is to enhance the coldwater fishery downstream of the dam by aerating generation flows and providing a minimum instantaneous flow in the river. The reregulation structure will consist of two parts--a weir for regulation of minimum flows and an infuser deck for aeration of releases. Five 19-inch diameter valve-controlled pipes and three uncontrolled pipes will be placed within the weir to pass a controlled discharge of 60 cubic feet per second during nongeneration periods. Quantities of material to be placed within the river channel are: 13,000 linear feet of 6-inch by 6-inch pressure treated timbers; 5,470 linear feet of 2-inch by 6-inch pressure treated timbers; 92 feet of 18-inch diameter steel pipe; 5 cubic yards of cement grout; 450 cubic yards of rock fill; 27 tons of steel for reinforcement and safety barriers; 5,000 square feet.of steel grating; and six 40-foot reinforced concrete beams. In addition, 47 cubic yards . r Memo Page 2 January 15, 1992 of earth and 10 cubic yards of rock will be excavated from the channel and deposited in an appropriate spoil area. The Tennessee Valley Authority (TVA) has consulted the NCWRC throughout the planning stages of this project. Recently the NCWRC sent a letter of approval to the TVA through Mr. Jack Davis, Manager of Navigation and System Modification Section in charge of Reservoir Release Task Force, in which we expressed support for this project (see attached). These modifications will enhance habitat for trout in the tailwaters of Chatuge Dam, and the NCWRC is pleased that the TVA is undertaking this project. The NCWRC recommends that the following stipulations be implemented by the applicant in order to minimize adverse impacts to``fisheries resources during construction: .1) Construction must be accomplished'so that wet concrete does not contact water entering or flowing in the Hiwassee River. Install an aerating regulation weir in Hiwassee River approximately 0.75 mile below Chatuge Dam. 2. Provide a 60 cfs minimum flow below the weir at all times by pulsing the turbine at 12 hour intervals during nonoperative periods. 3. Purchase an approximately 9-acre tract of land adjoining the Hiwassee River on the south side between the weir site and US 64 highway. 4. Construct minimal facilities (access and parking) to provide river access for small boats. This site will be available to the NCWRC for a long term lease agreement. 5. Provide assistance in constructing fish habitat improvements in the vicinity of the purchased land. 6. Provide supplemental aeration to increase dissolved oxygen levels in the pool behind the weir under minimum flow conditions. 7. Install a vented turbine when the existing turbine is replaced. 4*k A^ These changes will enhance the aquatic resources of the Hiwassee River in the vici ity of Chatge Dam and will provide better angling opportunities. The purpose of the weir is to increase instantaneous minimum flows in the river and to aerate low dissolved oxygen (DO) releases from the dam. This will help enhance the foodbase along with improving the flow, depth, and DO conditions for the downstream fisheries. The anticipated date for construction to begin is April 1992 with completion by May 1993. The reregulation structure will consist of two parts--a weir for regulation of minimum flows and an infuser deck for aeration of releases. The weir will consist of wood timber cribs filled with crushed rock constructed 8.25 feet high and 140 feet long. The infuser deck will extend from the top downstream edge of the weir wall to support columns of either wood and reinforced concrete (option 1) or reinforced concrete (option 2). In both options, the deck is covered with a steel grating. Design of the weir abutments is based on 100-year flood levels plus 1 foot of freeboard.
