The Application provides adequate assurance that the
discharge of fill material into the waters of Jordan Lake in
conjunction with the proposed pond draii347ie in Chatham County
will not result in a violation of applicable Water quality,,
Standards and discharge guidelines. Therefoze,,the State of North
Carolina certifies that this activity will rfot<violate Sections
301, 302, 303, 306, 307 of PL 92-500 and,PL, `95•-217 if conducted
in accordance with the application and conditions hereinafter set
forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner as to
prevent significant increase in turbidity outside the area
of construction or construction related discharge (increases
such that the turbidity in the Stream is 25 NTU`s or less
are not co4sidered significant).
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the above
conditions are made conditions of the Federal Permit.

I visited this site on July 16, 1991. The Corps plans
to drain a pond adjacent to Jordan Lake due to imminent dam
failure for safety reasons.
The pond is stagnant, is of low water quality and
provides marginal water quality benefits. The dam has
serious erosion problems and is in severe danger of failure.
The Raleigh Regional office recommends issuance of a
401 Water Quality Certification for this project. The
Corps in their plan of operation has taken reasonable steps
to minimize sedimentation associated with the drainage and
restoration of the site.

Enclosed is an Application for Water Quality Certification,
pursuant to Section 401 of Public Law 95-217 for discharge of
dredged material associated with the drainage of Farm Pond,
Seaforth Recreation Area, B. Everett Jordan Lake, Chatham County,
North Carolina.
The discharge of about 1,000 cubic yards of dredged material
is associated with draining a 1-acre former farm irrigation pond
at B. Everett Jordan Lake. The proposed action is consistent with
the authorized project purposes as described in the Final
Environmental Impact Statement, New Hope Lake, North Carolina,
filed with the Council on Environmental Quality on October 22,
1971, and in the Final Supplement to the Environmental Impact
Statement, B. Everett Jordan Dam and Lake, Cape Fear River Basin,
North Carolina, filed with the Council on Environmental Quality on
September 17, 1976.

PUBLIC NOTICE
DRAINAGE OF FARM POND
SEAFORTH RECREATION AREA
B. EVERETT JORDAN LAKE
CHATHAM COUNTY, NORTH CAROLINA
TO WHOM IT MAY CONCERN:
The Wilmington District, Corps of Engineers, Wilmington, North Carolina,
proposes to discharge excavated material into a drained farm pond at the
Seaforth Recreation Area, B. Everett Jordan Lake, Chatham County, North
Carolina.
PROJECT DESCRIPTION
The proposed action involves draining a 1-acre former farm irrigation pond
at B. Everett Jordan Lake (figure 1). The farm pond in question was not
drained or filled during impoundment. Currently, the embankment separating
the pond from the lake is eroding from wave action and high water from the
lake side. Trees growing on the embankment have been undermined and are
falling into the lake. Continued erosion will eventually lead to bank
failure. The embankment is considered to be a safety hazard since it is
adjacent to a public recreational facility.
The embankment is approximately 450 feet long, with a crown width varying
from 2 to 10 feet in width. Surface water elevation in the pond is
approximately 220 feet mean sea level (msl) (figure 2). The conservation
(normal) pool elevation for Jordan Lake is 216.0 msl, with a minimum
conservation pool elevation of 202.0 feet msl. The overall depth of the pond
is less than 5 feet with the primary source of inflow coming from surface
runoff and overtopping of the embankment during seasonal flooding from
B. Everett Jordan Lake.
The proposed work involves excavating a 10-foot-wide cut with 3H:1V side
slopes through the embankment followed by excavation of an approximately 100-
foot-long by 10-foot-wide sloped drainage ditch to allow for a positive flow
of water from the pond into B. Everett Jordan Lake. Approximately 1,000 cubic
yards of mostly clay and silty clay material will be excavated and placed on
the bottom of the drained pond. The work will be performed by a backhoe or
other suitable piece of heavy equipment and is expected to take 7pproximately
2 days to complete. The work will be scheduled during the period when the
lake level is below 216 feet msl. Future plans for the area may include
placing fill material in the drained pond, seeding, and using the area as an
open recreational area.
