Pond construction
Chatham County
Upon review of your request for Water Quality Certification
to place fill material in less than one acre of wetlands for pond
construction, we have determined that the proposed fill can be
covered by General Water Quality Certification No. 2176 issued
November 4, 1987 . A copy of the General Certification is
attached. This Certification may be used in qualifying for cov-
erage under Corps of Engineers' Nationwide Permit No. 26.

The Joe Godwin site is a low value wetlan' '� la rently.fib ,~g used for
row-crop production. Mr. Godwin has adequately a gd� imal waste
concerns for the future. His waste management plan has been approved by the
local Extension Office and SCS office.
The R.M. Hayes site is predominantly upland. The site has been cleared
of vegetation. About .25 acres of wet soils were cleared to be used in the
project. Much less wetlands were impacted than originally planned. Mr. Hayes
has also addressed and planned his animal waste management system for ultimate
irrigation to upland fields. Water quality impacts will be limited to minor
sedimentation in the flood plain of Hannah Creek during construction.
I have reviewed the plans for Paul Nelson's pond construction, but have
not visited the site. I do not perceive any negative water quality impacts to
be associated with the project.
The Raleigh Regional Office recommends issuance of a 401 Water Quality
Certification for these three projects.
I have not been to the Cooke site in Warren County and offer no comment
on the project. Mr. Cooke proposes to put fill into Lake Gaston. The nature
of the material and volume is not described in the plans. I feel he should
approach the Army Corps of Engineers with this project.

Dear Mr . Jolly:
I have purchased a small tract of land in Chatham County
near Jordan Lake where I intend to build a home. I would like to
construct a small dam on the property to Crete a pond of less
than 1 acre of total water surface area. The stream that will be
impounded is .an intermittent stream which is tributary to Little Heaver Creek . According to information obtained from the
Division of Environmental Management , Little Beaver Creek where
this unnamed tributary intersects is classified as "C-NSW" . The
stream is dry most of the year ( it originates on my property) and
in the wet seasons contains a section of about 3 by 250 feet
that would be covered - by my dam and the resultant pond . (The dam
will have a- height of approximately 15 feet and a width of about
95 feet at the base) . I would like to make - sure that I am
covered under all Federal and State environmental statutes and
would appreciate your help in determining what coverage is
needed I understand that wetland filling of this size can be
covered under a Nationwide -26 permit and general -water quality
certification from the State. I would, therefore, like this
letter to be considered as my request for coverage under these
Permit programs. Please let me know if I can be deemed covered
under these programs or , if not , what additional steps I should
take. At is a copy of the map indicating the location of
the proposed pond and a page of. the Division of Environmental
Management Classification scheduleapplicable to this unnamed
tributary.
