Post Office Box 694 Hickory, North Carolina 28603 Dear Mr. Champion: The Division of Environmental Management, Water Quality Section has reviewed your plans for wetland fill for 0.4 acres of wetlands near Conover between 1.40 and U.S. 70 for a building site. Based on this review, we have identified a significant use which would be removed by this project. This is water quality enhancement. Furthermore, insufficient evidence is present in our files to conclude that your project must be built in wetlands. Therefore, we are moving toward denial of your 401 Certification. Please provide us with information supporting your position that your project must be constructed in wetlands. Specifically can you construct your commercial site on nearby upland or prior converted farmland? Any documentation such as maps and narrative which you can supply to'address upland alternatives may be helpful in our review of your 401 Certification. We are requesting a State Water Quality Certification or Waiver of Certification. The purpose of the project is to construct a large commercial building with associated paved roads and parking. Approximately 17 acres will be disturbed during the construction period. The site is located west of Conover, NC between I-40 and US 70 with access to Bumgarner Industrial Drive (see Vicinity Map). The site is heavily wooded with a small creek on the east side of the property. Land use in the vicinity is zoned commercial and residential. Areas to the east are residentially and commercially developed while areas to the north, west and south are undeveloped. Soils are primarily Cecil-Hiawassee and hydrological group B & C. The North Carolina Erosion and Sediment Control Planning and Design Manual will be the primary reference for the subject project. Temporary and permanent erosion control measures will include, but not be limited to sediment basins, silt fence, inlet protection, check dams, diversions, slope drains, and seeding/grassing. No off-site borrow on waste areas are proposed. The Corps of Engineers have issued Nationwide Permits concerning the proposed building site and proposed 4th Street SW creek-crossing. (Refer to attached Corps of Engineers permits dated January 10, 1991.)
