I have studied the plat and have determined that Tarpon Drive can be shifted south toward Coast Guard road by approximately twenty-five feet. This revision will minimize the amount of wetland fill required for the project. However, the roadway realignment will also have a significant impact on the lots located between Tarpon Drive and Coast Guard Road. These lots will be hampered by a shallow lot depth of 125 feet, a bare minimum planning standard for lots situated between two roadways. Any shift further to the south would have significant economic impact on the marketability of the affected lots. I doubt, in fact, if the lots would be marketable considering land costs and improvements involved. For comparative purposes, the revised alignment will require filling 1.73 acres. The original plan required filling 2.6 acres. Whereas, the previous revision requested 0.87 acres, the current 401 certification request is for filling 0.73 acres, of which 0.03 acres are located in the "northern" wetland slough. The applicant has been very forthcoming in these protracted negotiations which have taken many months. The current plans will result in a loss of two lots and will severely test the marketability of the four shallow lots along Coast Guard Road. During a site visit on December 14, 1990 I discovered fill material has already pushed into the swale closest to Coast Guard Road, presumably for the construction of Tarpon Place. If the the wetlands indicated on the revised plans are to remain undisturbed, it is recommended the applicant should explain what his intentions are concerning the wetland area in lots 44 and 43. The applicant should also submit deed restrictions and protective covenants to the Division which would prohibit the filling of wetlands on a per lot basis, and if a Certification is issued, it be issued conditional upon these deed restrictions and protective covenants being enforced. At some point the deed, or master plan should contain a detailed delineation of all wetlands and also state: (1) This (these) covenant(s) is (are) to run with the land and shall be binding on all parties and all persons claiming under them. (2) Where lots border on or contain wetlands, the buyer of each lot shall keep that area as a natural area, unaltered or modified from a predevelopment state. There shall at no time be modifications of said areas that would include dredging, filling draining removal of vegetation or the use of herbicidal agents. The State should specifically designated as a beneficiary of the covenant because only a beneficiary of a restrictive covenant may enforce it. It is also recommended that where road crossings cut off a section of wetlands, adequate flow of surface water between the two sections be provided for. There are two such road crossings on the site presently that are not culverted. As indicated on the enclosed plans, the cul-de-sac roadway (Tarpon Place) has been realigned to the south to minimize direct impact on the 404 isolated wetlands. The property owner has agreed to make this adjustment which will require the loss of two residential lots. Carteret County PROJECT DESCRIPTION: Per the attached July 17, 1990 letter from John P. McLean Engineering Associates, the applicant is requesting confirmation that he can fill under a General Certification for the residential development named Bogue Landing. The applicant proposes to fill 2.6 acres of wetlands determined by the COE to be "isolated". Fill material has already been placed in wetlands for road crossings under a Nationwide Permit. Field investigations were conducted on August 10, 1990 and August 29, 1990. The site consists of ridge/swale complexes, typical of this area of Bogue Banks. The swales consist of freshwater ponds, swamp forests and scrub-shrub swamps. Soils are Duckston fine sand (swales) and Fripp fine sand (ridges). A June 1977 (1 in. = 1000 ft.) soil survey indicates a connection between the swales at the Bogue Landing site and the adjacent waters of Bogue Sound. As proposed, fill would be placed in two swales approximately 1,100 ft. long X 50 ft. wide each, connected on the western side of the property. The purpose of the fill would be for roadways and building areas. ADJACENT WATER BODY: Bogue Sound CLASSIFICATION: SA ORW STATUS: Open 9007-S.AUG Page Two The project has been reviewed to determine impacts to water quality. The following comments have been provided. 1. The project will require a 401 Certification. 2. Due to the sensitive location and nature of the wetlands on the site, it is recommended that the applicant submit sequencing information in accordance with 15A NCAC 2B .0109, Waters Affected by Dredge and Fill. Specifically, an explanation of why the roadway cannot be constructed on a ridge and the swales bridged to reach building sites. Several building sites may be lost, however it should be up to the applicant to demonstrate that this is not a practicable alternative to filling all of both swales. 3. The field investigation revealed several areas where delineation lines need clarification. a. Isolated 404 pocket with no southern boundary shown on plat. Flag #'s 1288-1301 on March 20, 1990 plat. b. Area between flags 398 and 407 is shown on plat as separating two wetland areas. No break was found during the August 29 field investigation. 4.
