Your application for a Water Quality Certification under
Section 401 of the Federal Clean Water Act was received by the
Division on January 3, 1991. The activity for which the
Certification is sought is to clear 3.0 acres of wetlands for
cabbage packing sheds and related agricultural activities.
A Water Quality Certification is a determination by the Division
that the activity for which the Federal Permit or license is
sought is not expected to result in a violation of State Water
Quality Standards for waters of the State. I have determined
that this activity is not eligible for our General Certification
since it is likely to have a significant adverse effect on water
quality by removing significant uses. These uses are stormwater
quality enhancement, floodwater retention, and wildlife habitat.
If you still desire to pursue this project, you will need to
apply for an individual 401 Certification. However, it is likely
that I will deny that request based on removal of significant
uses as outlined above and since we believe that practicable
alternatives exist for your present project design. We believe
that clearing of up to one acre of this wetland (already done)

Dear Mr. Merrill:
The Division of Environmental Management., Water Quality
section has reviewed your plans for wetland fill for 3 acres of
wetlands near Ware Creek (N.C. 101) in Carteret County for
cabbage packing sheds and related facilities. Based on this
review, we have identified significant wetland-related uses which
would be removed by this project. These are water quality
enhancement, water storage and wildlife. Furthermore,
insufficient evidence is present in our files to conclude that
your project must be built in wetlands. Therefore, we are moving
toward denial of your 401 Certification.
Please provide us with information supporting your position
that your project must be constructed in wetlands. Specifically
can you construct your packing sheds on nearby upland or prior
converted farmland? Any documentation such as maps and narrative
which you can supply to address upland alternatives may be
helpful in our review of your 401 Certification. Please respond
within two weeks of the date of this letter.

Reference your application, on behalf of your client, Mr. Kerney Merrill,
of October 10, 1990, for Department of the Army authorization to place fill
material in wetlands above the headwaters of a tribuatary to the Newport
River, in Beaufort, Carteret County, North Carolina.
Your proposed placement of this fill material may qualify for Federal
authorization pursuant to nationwide permit (33 CFR 330.5(a) (26)). Please
complete the enclosed pre-discharge notification (PDN) form, and submit it
with a copy of your Section 401 Water Quality Certification from the North
Carolina Division of Environmental Management. The Section 401 Certification
is required to validate Nationwide Permit No. 26 in the State of North
Carolina; therefore, it must be submitted with the PDN application.
We cannot proceed with the processing of your application until after we
have received your completed PDN form and the 401 Certification.

Enclosed please find a sketch of a 10 acre tract of land owned by
Kerney Merrill of Beaufort, N.C..
Mr. Merrill wishes to fill 3 acres of 404 wetlands on this site.
The site is well removed from navigable water (more than a mile) and is
non adjacent and isolated.
Mr. Merrill wishes to put a packing shed for an adjacent farm on the
three acres.
He is choosing to use nationwide permit 426 to fill the 404 wetlands.
Mr. Hugh Heine of the Corp. suggested that he get a 401 certification from
your office.
It is our understanding that Mr. Merrill is allowed to fill the property
under nationwide #26, and that all he has to do is notify the Corps.
He has done this. By this letter he is notifying your office.
We have done these applications before. and a point discharge notification
has never been required for non adjacent wetlands.
Again, please be notified that Mr. Merrill is planning on filling 3 acres
of possible 404 wetlands , and should he need any approval from your office
he is willing to work with you if you'll work with him.
Finally Mr. Heine has been notified of our plans and he has never sent us
a PDN form.

Enclosed find one copy of Carteret County tax map 11-12 showing an area of
proposed fill in 404 wetlands. Also is enclosed a U-S-C and GS-7 minute quad-
rangle map showing.the same area of proposed fill.
Mr. Kerney Merrill is buying approximately ten acres of land from Kenneth
Wright, which contains this three acre fill area.
`Mr. Merrill would like to use nationwide 26 to accomplish this filling
activity..
If your office has no problem with this, please notify me as soon as possible.
If you have a problem, please do like wise.
Mr. Hugh Heine has already met on site with Mr. Merrill and myself and has
suggested this process.
