Upon review of your request for Water Quality Certification
to place fill material in less than one acre of wetlands for
residential fill, Wooded Acres Subdivision at Hwy. 24, Lot No. 3,
in Carteret County, we have determined that the proposed fill can
be covered by General Water Quality Certification No. 26.71 issued
January 21, 1992. A copy of the General Certification is
attached. This Certification may be used in qualifying for
coverage under Corps of Engineers' Nationwide Permit No. 26.

PROJECT DESCRIPTION: The applicant proposes to place fill in
less than one acre of headwater wetlands in order to develop a
portion of a lot.

Jumping Run Creek
The project has been reviewed to determine impacts to water
quality. The following comments have been provided.
1. The project will require a 401 Water Quality Certification.
2. Jumping Run Creek is classified SA Waters from it's source
to Bogue Sound. It would appear that an individual 401
Water Quality Certification would be required for this
project.

Dear Mr. Cooper:
This is in regards to your inquiry concerning plans to develop a lot in
Carteret County, North Carolina. Specifically, the lot is located on Wooded
Acres Drive, Wooded Acres subdivision, off Highway 24. In order to develop a
portion of this lot, less than an acre of wetlands within the headwaters of an
unnamed tributary of Jumping Run Creek are proposed to be filled. The
proposed work is authorized by Nationwide Permit Number 26.
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330, published in the Federal Register
on November 13, 1986, lists nationwide permits. Authorization was provided
for discharges of dredged or fill material into non-tidal rivers, streams, and
their lakes and impoundments, including adjacent wetlands, that are located
above the headwaters and other non-tidal waters of the United States,
including adjacent wetlands, that are not a part of a surface tributary system
to interstate waters or nav' able ters of,the United States. This general
authorization is valid only for work that causes the loss or substantial
adverse modification ofj? ss than an acre-of wetlands.
Your work is auth rized ionwide permit provided it is accomplished
in strict accordance with the enclosed conditions. The nationwide permit does
not relieve you of the responsibility to obtain any required State or local
approval.
This verification will be valid until the nationwide permit is modified,
reissued or revoked. All nationwide permits are scheduled to be modified,
reissued or revoked prior to January 13, 1992. It is incumbent upon you to
remain informed of changes to the nationwide permits. We will issue a public
notice announcing changes when they occur. Furthermore, if you commence or
are under contact to commence this activity before the date the nationwide
permit is modified or revoked, you will have twelve months from the date of
the modification or revocation to complete the activity under the present
terms and conditions of this nationwide permit.

Dear Mr. Cooper:

704/663-1699 On 1 October 1991, the N.C. Division of Environmental
Raleigh Management received a copy of your plans to fill wetlands at
919/733-2314 Wooded Acres Subdivision in Carteret County. The letter from the
Corps of Engineers indicated that you are eligible for a NW26
Washington
919/946-6481 permit since you plan to fill less than one acre of wetlands.
However, your project may need an individual 401 Water Quality
Wilmington Certification since it is near waters classified by DEM for
919/395-3900 commercial shellfishing. Your project might not be able to
Winston-Salem legally proceed since your 404 Permit is not valid without a 401
919/896-7007 Certification.
Please submit a map of your project design and location to
allow us to determine the location of your fill. At that time we
can then decide whether an individual certification is necessary.
