Enclosed is the application of Mr. John L. Gregson, III, and Ms. Mary M.
Gregson, for after-the-fact Department of the Army authorization and a State
Water Quality Certification to place fill material in wetlands adjacent to the
Pasquotank River, Whitehall Shores; Camden County, North Cafolina. Your
receipt of this letter verifies your acceptance of a valid request for
certification in accordance with Section 325.2(b)(ii) of our administrative
regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification may be required under the provisions of Section 401 of the same
law. A Department of the Army permit will not be granted until the
certification has been obtained or waived.
In accordance with our administrative regulations, 60 days after receipt
of a request for certification is a reasonable time for State action.
Therefore, if you have not acted on the request by January 16, 1991, the
District Engineer will deem that waiver has occurred.

MR. JOHN GREGSON, III, 212 Pinewood Drive, Camden, North Carolina 27921,
has applied for a Department of the Army (DA) after-the-fact permit TO
AUTHORIZE THE PLACEMENT OF FILL MATERIAL IN WETLANDS ADJACENT TO THE
PASQUOTANK RIVER IN CONJUNCTION WITH THE CONSTRUCTION OF A SINGLE FAMILY
RESIDENCE, SEPTIC DRAIN FIELD, AND ACCESS DRIVEWAYS, LOT NUMBER 34, AT THE
CORNER OF RIDGE AND VALLEY ROAD, WHITEHALL SHORES SUBDIVISION, Camden County,
North Carolina.
This public notice does not imply, on the parts of the Corps of Engineers
or other agencies, either favorable or unfavorable opinion of the work
performed; but it is issued to solicit comments on the factors listed above on
which a final decision will be based. Legal action has been suspended pending
the outcome of this consideration. The reference file number for this
enforcement action is 199100005.
The following description of the work is taken from data provided by the
applicant and from observations made during onsite visits by representatives
of the Corps of Engineers. The applicant is responsible for filling and
grading a single lot within the subdivision impacting approximately 18,500
square feet (0.42 acre) of wetlands. The applicant proposes to fill
essentially the entire lot to accommodate a 2,000 square foot single family
residence, including septic drain field, and access driveways. This lot was
filled during initial development of the subdivision in the early 19701s;
however, the property was not sufficiently raised to convert the site to
highground and remove it from regulatory jurisdiction. At present, the site
is cleared and graded. The remaining vegetation is sparse and consists of
red maple, sweetgum, loblolly pine, netted chainfern, and sweet bay. Plans
showing the work are included with this public notice.
The State of North Carolina will review this public notice to determine
the need for the applicant to obtain any required State authorization. No
DA permit will be issued until the coordinated State viewpoint on the proposal
has'been received and reviewed by-this agency, nor will a DA permit be issued
until the North Carolina Division of Environmental Management (DEM) has
determined the applicability of a Water Quality Certificate as required by PL
92-500.
The requested DA permit will be denied if any required State or local
authorization and/or certification is denied. Recipients of this notice are
encouraged to furnish comments on factors of concern represented by the above
agencies directly to the respective agency, with a copy furnished to the Corps
of Engineers.

This application is being considered pursuant to Section 404(b) of t 'e
Clean Water Act (33 U.S.C. 1344). Any person may request, in writing wi hin
the comment period specified in the notice, that a public hearing be hel to
consider this application. Requests for public hearing shall state, wit
particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of he
National Register of Historic Places for the presence or absence of regi t: red
properties, or properties listed as being eligible for inclusion therein and
this work site is not registered property or property listed as being el gible
for inclusion in the Register. Consultation of the National Register
constitutes the extent of cultural resource investigations by the Distri t
Engineer, and he is otherwise unaware of the presence of such resources.
Presently, unknown archeological, scientific, prehistorical, or historic 1
data may be lost or destroyed by work under the requested permit.
The District Engineer has determined, based on a review of data furn shed
by the applicant and onsite observations, that the activity will not aff ct
species, or their critical habitat, designated as endangered or threaten d
pursuant to the Endangered Species Act of 1973.
The decision whether to issue a permit will be based on an evaluatio of
the probable impacts, including cumulative impacts, of the proposed acti ity
and its intended use on the public interest. Evaluation of the probable
impacts which the proposed activity may have on the public interest requires a
careful weighing of all those factors which become relevant in each particular
case. The benefits which reasonably may be expected to accrue from the
proposal must be balanced against its reasonably foreseeable detriments. The
decision whether to authorize a proposal, and if so the conditions under which
it will be allowed to occur, are therefore determined by the outcome of the
general balancing process. That decision should reflect the national co cern
for both protection and utilization of important resources. All factors which
may be relevant to the proposal must be considered including the cumula ive
effects thereof. Among those are conservation, economics, aesthetics, eneral
environmental concerns, wetlands, cultural values, fish and wildlife va ues,
flood hazards, flood plain values, land use, navigation, shore erosion nd
accretion, recreation, water supply and conservation, water quality, energy
needs, safety, food and fiber production, mineral needs, considerations of
property ownership, and, in general, the needs and welfare of the people. For
activities involving the placement of dredged or fill materials in waters of
the United States, a permit will be denied if the discharge that would be
authorized by such permit would not comply with the Environmental Protection
Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any
other applicable guidelines or criteria, a permit will be granted unles the
District Engineer determines that it would be contrary to the public interest.
The Corps of Engineers is soliciting comments from the public; Federal,
State, and local agencies and officials; Indian Tribes, and other interested
parties-in order to consider and evaluate the impacts of this proposed

activity. Any comments received will be considered by the Corps of Engineers
to determine whether to issue, modify, condition, or deny a permit for this
proposal. To make this decision, comments are used to assess impacts on
endangered species, historic properties, water quality, general environmental
effects, and the other public interest factors listed above. Comments Are
used in preparation of an Environmental Assessment and/or Environmental Impact
Statement pursuant to the National Environmental Policy Act. Comments are
also used to determine the need for a public hearing and to determine the
overall public interest of the proposed activity.
Generally, the decision whether to issue this DA permit will not be made
until the DEM issues, denies, or waives State certification required by
Section 401 of the Clean Water Act. The DEM considers whether or not the
proposed activity will comply with Sections 301,- 302, 306, and 307 of the
Clean Water Act. The application and this public notice for the DA permit
serves as application to the DEM for certification.
Additional information regarding the Clean Water Act certification may be
reviewed at the offices of the Environmental Operations Section, North
Carolina Division of Environmental Management, Salisbury Street, Archdale
Building, Raleigh, North Carolina. Copies of such materials will be furnished
to any person requesting copies upon payment of reproduction costs.
The North Carolina Division of Environmental Management plans to take
final action in the issuance of the Clean Water Act certification on or after
December 29, 1990.

Water Act certification should do. so in writing delivered to the North

This letter is regarding the proposed septic system for
lot 34 Valley Road in Whitehall Shores, Camden County,
North Carolina. Mr. John Gregson III has applied for the
septic system.
The following facts apply:
1) I have worked with Mr. Gregson to reduce the
fil l area by 10% (now 56 ft. x 90 ft).
2) The outer 10 ft. of the fill area tapers down
to the original soil.
3) The septic system is kept loft. wi thin the fill area.
4) The proposed system will be, to an extent, "mounded"
as the septic system is kept very shallow within
the filled area.
5) It is my opinion that the proposed system is the
most feasible type to be used in this lot situation
and will require a minimum area. Going off site
is not possible.
If there are questions or if I can be of help otherwise,
please call me at the Camden County Health Department. I
am usually in from 8:00 to 8:30 a.m. Monday through Friday.

The State of North Carolina has not completed its review for consistency
with the North Carolina Coastal Management Program pursuant to 15 CFR 930 of
Corps Public Notice Action ID. 199100074, regarding an application by Mr. John
Gregson, III, for an after-the-fact permit to authorize the placement of fill
material in wetlands adjacent to the Pasquotank River on lot number 34 of the
Whitehall Shores subdivision in Camden County, North Carolina.
To date comments have been received from all State agencies involved in
the review process with the exception of a determination by the NC Division of
Environmental Management on a 401 Water Quality Certification. Since the 401
Certification is a required component of the federally-approved North Carolina
Coastal Management Program, we are unable to make a final determination on the
consistency of the project at this time.
In the course of our review it has been determined that the project area
lies within the 75 foot Estuarine Shoreline AEC. Therefore, a CAMA Major
permit would be required for any fill material placed in wetlands within 75
feet of estuarine waters. We have also recieved objections to the project
from the NC Wildlife Resources Commission and the Division of Parks and
Recreation.
Since a decision on 401 Certification has not been made, we are extending
our,consistency review for an additional 90 days. During that time the
applicant should consult the Division of Coastal Management office in
Elizabeth City, NC, (919)264-3901, for an official determination on whether a
CAMA permit is required.

(NMFS) and the North Carolina Wildlife Resources Commission (NCWRC)
recommended denial of your application by letters of December 14, 1990 and
January 4, 1991 (copies enclosed). These recommendations are due to
anticipated adverse environmental impacts. They are provided for your comment
and/or rebuttal. We would appreciate your response on or before March 29,
1991.
As yet, we have not receeved the North Carolina Division of Coastal

The State of North Carolina has completed its review for consistency with the North Carolina

regarding an application by Mr. John Gregson, III, for a Department of the Army permit to authorize

In our letter of March 8, 1991, extending our review period, we informed you that a 401 Water
Quality Certification had not yet been issued and that the project might require a CAMA permit.
Since that time both of these concerns have been addressed. The 401 Certification was issued by the
Division of Environmental Management on April 15, 1991. The applicant contacted the Division of
Coastal Management Office in Elizabeth City and was informed by letter dated April 15, 1991, that
a CAMA permit is not required for the present activity. Construction of a residence on the lot as
planned will, however, require a CAMA permit.
Since these issues have been resolved, we agree with the applicant's certification that the
project in the current permit application is consistent with the North Carolina Coastal Management
Program.

THIS CERTIFICATION is issued in conformity with the
requirements of Section 401 Public Laws 92-500 and 95-217 of the
United States and subject to the North Carolina Division of
Environmental Management Regulations in 15 NCAC 2H, Section .0500
to John and Mary Gregson pursuant to an application filed on the
4th day of April, 1991 to approve after-the-fact fill for
residential building and septic tank.
The Application provides adequate assurance that the
discharge of fill material into the waters of Pasquotank River in
conjunction with the proposed house and septic tank in Camden
County will not result in a violation of applicable Water Quality
Standards and discharge guidelines. Therefore, the State of North
Carolina certifies that this activity will not violate Sections
301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted

Condition(s) of Certification:
1. That the activity be conducted in such a manner as
to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the Stream is 25 NTU's or less are not
considered significant).
2. That house design be as stated in your April 4,
1991 letter (58' by 42' house with separate
driveway to garage deleted).
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the
above conditions are made conditions of the Federal Permit.

In response to your letter of March 22, 1991 concerning Lot #34,
Whitehall Shores, Camden, NC:
1. Driveway could be redesigned for only one entrance if absolutely
necessary.
2. Alternative sewage disposal - See attached letter from Mr.
Daughtry, Camden Health Department. He has sent you the same
letter under separate cover.
Enclosed are plans of the new house and former plan. Original plan is
reduced from 74' by 64' to 58' by 42' and separate driveway to back of
garage is deleted completely.

This letter is regarding the proposed septic system for
lot 34 Valley Road in Whitehall Shores, Camden County,
North Carolina. Mr. John Gregson III has applied for the
septic system.
The following facts apply:
1) I have worked with Mr. Gregson to reduce the
fill area by 10% (now 56 ft. x 90 ft).
2) The outer 10 ft. of the fill area tapers down
to the original soil.
3) The septic system is kept loft. within the fill area.
4) The proposed system will be, to an extent, "mounded"
as the septic system is kept very shallow within
the filled area.
5) It is my opinion-that the proposed system is the
most feasible type to be used in this lot situation
and will require a minimum area. Going off site
is not possible.
If there are questions or if I can be of help otherwise,
please call me at the Camden County Health Department. I
am usually in from 8:00 to 8:30 a.m. Monday through Friday.
