ADJACENT WATER BODY: Williams Branch CLASSIFICATION: CSw The project has been reviewed to determine impacts to water quality. The following comments have been provided. Please find the attached letter and plans from Houston and Associates, P.A., requesting a modification of Stormwater Certification, and a copy of a earlier letter to Houston and Associates, dated October 30, 1991. 1. The project will require a 401 Water Quality Certification. 2. The project complies with the General 401 Water Quality Certification No. 2176 for headwater wetlands. It is estimated that less than 0.1 acres of headwater wetlands will be impacted as a result of the construction of the stormwater pond with the proposed modifications. This office has no objection to the project as proposed. On behalf of the owner, we request a modification to the certification for Stormwater Project 910902 issued November 21, 1991. The revisions to this project reflect, to a degree, as-built conditions as of December 2, 1991. Since the as-built conditions entailed a pond surface area, orifice elevation, and outlet structure elevations different from our original design, we had to revise the orifice size, orifice elevation, top of riser elevation, emergency spillway elevation, etc., accordingly. These changes are documented in the calculations accompanying this letter. By copy of this letter, we are also sending Mr. Jim Gregson two copies of the plans for wetlands review. Based on our ongoing conversations, transmittals, and meetings with DEM, we believe that approval of the modification request is warranted. Post Office Box 2927 Shallotte, North Carolina 28459 Subject: Water Quality Certification Project #91701 Jones Ford Shallotte Brunswick County Dear Mr. Covil: The Wilmington Regional Office has reviewed your plans to impact an undetermined amount of wetlands adjacent to Williams Branch, Classified "C Swamp Waters", for the construction of a stormwater retention pond. Based on this review and site visits, it was evident that construction of the stormwater pond had already begun, making a detailed evaluation of wetland impacts difficult. If the wetland areas filled for the construction of the stormwater pond were similar to existing wetlands adjacent to the site, which we believe they were, significant uses were lost by the construction of the stormwater pond. These uses include water quality enhancement, wildlife habitat, and floodwater storage. Insufficient evidence is present in your submittal to conclude that your stormwater pond must be constructed in wetlands. Additionally, it is the policy of this Division to require that stormwater treatment systems not be constructed in wetlands. You explained during our conversation that DEM requires 401 Water Quality Certification for a project even though the US Army Corps of Engineers (COE) does not require a Predischarge Notification (PDN) for the project. On behalf of Mr. Ed Jones, we request that you grant said certification. We have had numerous conversations with the COE about this project. The COE has visited the site at least two times, and during one of their visits we accompanied them. Due to the complex characteristics of the site, the COE could not establish a defined wetlands boundary. Regardless, they did feel that the impact on wetlands was minimal to the extent that a Nationwide Permit is being issued without the PDN requirement. We recommend that you contact Ms. Jean Benton and/or Mr. Ernie Jahnke at 251-4467 if you believe their input would be of value in your determinations about the 401 Certification.
