CERTIFICATION
THIS CERTIFICATION is issued in conformity with the requirements
of Section 401 Public Laws 92-500 and 95-217 of the United States
and subject to the North Carolina Division of Environmental
Management Regulations in 15 NCAC 2H, Section .0500 to Smithfield
Foods, Inc. and Carolina Food Processors pursuant to an
application filed on the 16th day of October, 1991 to install a
sewer line and outfall structure near and in the Cape Fear River
near Tarheel, N.C.
The Application provides adequate assurance that the
discharge of fill material into 0.02 acres of wetlands adjacent
to the waters of the Cape Fear River in conjunction with the
proposed sewer line and outfall structure in Balden County will
not result in a violation of applicable Water Quality Standards
and discharge guidelines. Therefore, the State of North Carolina
certifies that this activity will not violate Sections 301, 302,
303, 306, 307 of PL 92-500 and PL 95-217 if conducted in
accordance with the application and conditions hereinafter set
forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner as to
prevent significant increase in turbidity outside the area
of construction or construction related discharge (increases
such that the turbidity in the Stream.is 25 NTU's or less
are not considered significant).
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the above
conditions are made conditions of the Federal Permit.

The subject project involves the installation of a wastewater discharge
line from the proposed Smithfield Foods (Carolina Food Processors) Wastewater
Treatment Plant to the Cape Fear River. According to information submitted by
Barrett Kays & Associates, a small section of wetlands will be crossed during
installation of this line. Total wetland impacts excluding the submerged
outfall are expected to be less than 1,000 sq. ft. A corridor approximately
10 feet wide will be disturbed during the course of the project but will be
restored to original contours at completion.
Due to the insignificant size of the wetland disturbance, and the
anticipation of no long term adverse impacts, it is the recommendation of this
office that the appropriate certification be granted.
If additional information or clarification is required, please advise.

Permits (#7 and 12) for the processed wastewater line and.

However, they will need an individual 401 Water Quality
Certification since we have no applicable general certification.
I have published a Public Notice in the Southeastern Times
effective October 24 with a comment period ending November 11,
1991. Enclosed is a copy of the application. If your agency has
any comments, please send them to me by November 11, 1991. I can

Dear Mr. Dorney:
This letter is written in response to your telephone conversation with
Mr. James Spangler, Project Manager of our firm on October 15 and 16,
1991. As you indicated, this letter and associated attachments can
serve as the official 401 Certification application.
Barrett Kays and Associates, P.A., as agents for Smithfield Foods, Inc.
and Carolina Food Processors, requests that your office proceed
immediately with the 401 Certification process for the project consisting
of the following:
Installation of a process wastewater discharge pipe crossing a small
wetland area located in the wastewater utility line easement, and
construction of submerged outfall structure in the Cape Fear River.
The project will consist of 18" pipe, installed approximately 3 feet
beneath ground surface. The pipeline will be carrying approximately
60 psi. Clearing and other temporary construction impacts will be
minimal and will include only the width necessary for machinery to

As you know, this project has already received an NPDES permit and
authorization to construct from your Department, as well as all required
authorizations from the Corps of Engineers. We understand that your
office will be moving ahead with the certification process as required in
15 NCAC 21-1.0500, including Public Notification.
We also understand that failure to obtain 401 Certification from your
office will in no way invalidate any permits or authorizations already
received by Smithfield Foods, Inc., Carolina Food Processors, their
representatives and/or their agents.
Please contact our office by close of business today should you require
additional information. As you have indicated that the Public Notice
will be published on October 17, 1991 in the local Bladen County
newspaper, we are eagerly anticipating completion of the Public
Notification process by Thursday, November 7, 1991.

PUBLIC NOTICE is hereby given that Smithfield Foods (Carolina
Food Processors), near Tarheel, North Carolina, has applied to
the North Carolina Division of Environmental Management for a
Water Quality Certification pursuant to Section 401 of the
Federal Clean Water Act and Environmental Management Commission
rules in 15A NCAC 2H .0500 and 15A NCAC 2B .0109. The activity
for which the certification is sought is to construct a processed
wastewater line and outfall structure across approximately 0.02
acres of wetlands in the Cape Fear River basin in Bladen County.
This notice is for an activity separate from the already-issued
NPDES permit.
The public is invited to comment on the above-mentioned
application especially regarding the impact of the processed
wastewater line on these wetlands to the Division of
Environmental Management. Comments shall be in writing and shall
be received by the Division no later than November 11, 1991. The
Division expects to make a decision on the 401 Certification
after that date. Comments should be sent to N.C. Division of
Environmental Management, Water Quality Planning, Post Office Box
29535, Raleigh, North Carolina 27626-0535, Attention: John
Dorney. A copy of the application is on file at the Division

Gentlemen:
Reference your letter of September 17, 1991, whereby Barrett Kays and
Associates, on your behalf, informed us of your plans to install an outfall
structure and place a wastewater utility line through wetlands and on the Cape
Fear River, Smithfield Foods Site, Tarheel, Bladen County, North Carolina.
For the purposes of the Corps of Engineers, Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330, published in the Federal Register
on November 13, 1986, lists nationwide permits. Authorization was provided
for outfall structures and associated intake structures where the effluent
from that outfall has been permitted under the National Pollutant Discharge
Elimination System (NPDES) program. Also, authorization was provided for the
discharge of material for backfill or bedding for utility lines, including
outfall and intake structures, provided there is no change in pre-construction
bottom contours and all excess material is removed to an upland disposal area.
Your work is authorized by nationwide permit provided it is accomplished
in strict accordance with the enclosed conditions. The nationwide permit does
not relieve you of the responsibility to obtain any required State or local
approval.
This verification will be valid until the nationwide permit is modified,
reissued or revoked. All nationwide permits are scheduled to be modified,
reissued or revoked prior to January 13, 1992. It is incumbent upon you to
remain informed of changes to the nationwide permits. We will issue a public
notice announcing changes when they occur. Furthermore, if you commence or
are under contract to commence this activity before the date the nationwide
permit is modified or revoked, you will have 12 months from the date of the
modification or revocation to complete the activity under the present terms
and conditions of this nationwide permit.

GENERAL CERTIFICATION
THIS GENERAL CERTIFICATION is issued in conformity with the requirements of
Section 401, Public Law 92-500 of the United States and subject to -the North
Carolina Division of Environmental Management Regulation in 15NCAC2H, Section
.0500 to municipalities or other units of government for the discharges to the
waters of the State resulting from the categories of activity hereinafter speci-
fied, requiring Section 404 Permits to discharge excavated or fill material into
navigable waters or adjacent wetlands. The categories of activity for which the
Division of Environmental Management issues this general certification are as
follows: (1) the construction of sewer line extensions and interceptors, (2) the
construction of outfall structures and outfall lines.
The State of North Carolina certifies that a specified cat-ego ' s of activi-
ty, if conducted in accordance with the approv d 201 Facility Plans, wi 1 not
violate Sections 301, 302, 306, and 307 of the '2 ndmen Publi Law 92-500.
Public Hearings may be held for specific applications or group of applications
prior to Certification if deemed in the public's best interest by the Director of
the North Carolina Division of Environmental Management.
Violation of any condition herein set forth shall result in revocation of
this Certification.
