The Application provides adequate assurance that the discharge of fill material into 0.02 acres of wetlands adjacent to the waters of the Cape Fear River in conjunction with the proposed sewer line and outfall structure in Balden County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the Stream.is 25 NTU's or less are not considered significant). Violations of any condition herein set forth shall result in revocation of this Certification. According to information submitted by Barrett Kays & Associates, a small section of wetlands will be crossed during installation of this line. Total wetland impacts excluding the submerged outfall are expected to be less than 1,000 sq. ft. A corridor approximately 10 feet wide will be disturbed during the course of the project but will be restored to original contours at completion. Due to the insignificant size of the wetland disturbance, and the anticipation of no long term adverse impacts, it is the recommendation of this office that the appropriate certification be granted. As you indicated, this letter and associated attachments can serve as the official 401 Certification application. Barrett Kays and Associates, P.A., as agents for Smithfield Foods, Inc. and Carolina Food Processors, requests that your office proceed immediately with the 401 Certification process for the project consisting of the following: Installation of a process wastewater discharge pipe crossing a small wetland area located in the wastewater utility line easement, and construction of submerged outfall structure in the Cape Fear River. The project will consist of 18" pipe, installed approximately 3 feet beneath ground surface. The pipeline will be carrying approximately 60 psi. We understand that your office will be moving ahead with the certification process as required in 15 NCAC 21-1.0500, including Public Notification. We also understand that failure to obtain 401 Certification from your office will in no way invalidate any permits or authorizations already received by Smithfield Foods, Inc., Carolina Food Processors, their representatives and/or their agents. The activity for which the certification is sought is to construct a processed wastewater line and outfall structure across approximately 0.02 acres of wetlands in the Cape Fear River basin in Bladen County. For the purposes of the Corps of Engineers, Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330, published in the Federal Register on November 13, 1986, lists nationwide permits. Authorization was provided for outfall structures and associated intake structures where the effluent from that outfall has been permitted under the National Pollutant Discharge Elimination System (NPDES) program. Also, authorization was provided for the discharge of material for backfill or bedding for utility lines, including outfall and intake structures, provided there is no change in pre-construction bottom contours and all excess material is removed to an upland disposal area. Your work is authorized by nationwide permit provided it is accomplished in strict accordance with the enclosed conditions. The nationwide permit does not relieve you of the responsibility to obtain any required State or local approval. This verification will be valid until the nationwide permit is modified, reissued or revoked. All nationwide permits are scheduled to be modified, reissued or revoked prior to January 13, 1992. It is incumbent upon you to remain informed of changes to the nationwide permits. We will issue a public notice announcing changes when they occur.
