919/896-7007 determined that the proposed fill can be covered by General Water
Quality Certification No. 2671 issued January 21, 1992. A copy
of the General Certification is attached. This Certification may
be used in qualifying for coverage under Corps of Engineers'
Nationwide: Permit No. 26. Fill shall be as adjacent to
nonwetland areas as possible.

The applicant has requested a 401 Certification to allow placement of
fill material in 3.2 acres of wetlands adjacent to White Lake in Bladen
County. The purpose of this fill is to provide suitable area for building
homes for family members.
This particular project has been discussed at length, and a decision was
made to grant a certification for up to 1.5 acres. This is consistent with
the response given to a previous request from an adjacent landowner,
Mr. Dow V. Perry. Mr. Keith was contacted on December 30, 1991, and advised
that a certification could be provided for this amount. No objections were
voiced to this decision.
It is therefore the recommendation of this office that the appropriate
certification be granted for 1.5 acres of fill.

Dear Mr. Noland:
Please refer to your letter (Attachment #1) of March 8, concerning
my request for a 401 Water Quality Certification. The information
which you requested follows:
1. The 3.2 acre area that I propose to fill is shown on Attachm#2i/#24.
2. This tract has been in the family for over four decades. The
proposed fill area will be used to provide low density building
sites for .cottages for my children and grandchildren. The site
has-been and will continued to be used primarily for recreation.
I have no.other alternative sites that are suitable for this
purpose.
3. All agency guidelines and state laws will be followed to insure
that the proposed project will have minimal impact on the
environment.
There are no surface streams on this tract and the proposed fill
area is level terrain which collects rainwater and recharges the
groundwater reservoir. There is no runoff, therefore no effect
on surface water by sediment and no affected stream flow. The
lake which the tract-Is near is fed by artesian springs and the
placement of fill material is not expected to affect the lake.
I do not believe that the proposed project will have a significant
impact on the ecology of the area.

The Fayetteville Regional Office has received a copy of your request for
a 401 Water Quality Certification. This certification must be obtained prior
to issuance of a Nationwide 26 Permit from the US Army Corps of Engineers.
Prior to making a decision on this certification, we request that you address
the following items:
1. Details must be provided indicating the actual wetland area to be
filled.
2. Prior to recommending approval of wetland fill, the Division of
Environmental Management requires that the applicant prove that
there are no practicable alternatives available by which his goals
may be achieved. Please address the final intent of this project
and any available options or lack thereof.
3. Please indicate all measures which will be taken to minimize the
impact of wetland loss as a result of this project should the
approval for wetland fill be granted.
