DWQ Project # 2006-0123
Otter Creek [NSW, SC, Sw]
Dear Mr. Wright:
On June 23, 2009, Anthony Scarbraugh of the Division of Water Quality (DWQ) inspected a
proposed residential dwelling to be constructed at the subject property located on Fairwinds Drive
in Oriental, Pamlico County. This project was inspected for compliance with the Neuse River
Riparian Buffer Protection Rules "General" Major Variance with Additional Conditions granted
on March 14, 2006 for the construction of dwelling at the subject property.
The "General" Major Variance approved the impact of 1,354 ft2 of Zone 1 and 1,380 of Zone 2 of
the protected Neuse River buffers to complete your project as described in your February 21,
2006 variance request.
The inspection revealed that the project has not yet been completed. As such, you will be
rescheduled for an inspection at a later date. This office would like to remind you that you are
limited to the impacts proposed in your application and you must comply with all additional
conditions detailed in the "General" Major Variance granted on March 14, 2006.
As a reminder, if you change your project you must notify us and you may be required to send us
a new application. If the property is sold, the new owner must be given a copy of the minor
variance and approval letter and is thereby responsible for complying with all conditions. Upon
completion of all work approved within the 401 WQC or applicable Buffer Rules, and any
subsequent modifications, the applicant is required to return the enclosed certificate of
completion to the 401 Oversight/Express Review Permitting Unit, North Carolina Division of
