Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Shoreline Stabilization 1) The alignment of the authorized riprap extension shall be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of any construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions shall require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. 2) The alignment of the approved riprap shall not extend waterward more than 5 feet from the normal water level at any point along its alignment. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit shall be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work shall cease when the permit expires on December 31, 2010 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. It shall be of a size sufficient to prevent its movement from the approved alignment by wave or current action. 4) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite, marl, or broken concrete. General 5) No Coastal Wetlands shall be excavated or filled. 6) This minor modification shall be attached to the original of Permit No. 5-07, which was issued on 1/24/07 and the minor modification issued 5/2/08, and copies of all documents shall be readily available on site when Division personnel inspect the project for compliance. 7) All conditions and stipulations of the active permit remain in force under this minor modification, unless specifically altered herein. Jennings, III, District Manager, NE DATE: 06/22/09 Dee Freeman Secretary SUBJECT: Marc Basnight CAMA Major Permit #05,07 Modification Request CAMA Major Permit #05-07 was issued on January 24, 2007 to the applicant for maintenance excavation of an existing canal, for estuarine beach nourishment and for jetty and groin extensions. The permit has a December 31, 2010 expiration date. The permit was modified on May 2, 2008 to authorize the placement of 540 feet of riprap along the Shallowbag Bay shoreline of a marsh area (200 feet) and groin field (340 feet) to prevent erosion. The applicant purposely left a sandy beach area unprotected, located adjacent to his home. This area has approximately 280 feet of shoreline and runs from an existing rock jetty protecting a canal on the west side of the property, to an existing groin field that was riprapped as part of the 05/02/08 modification. The applicant is experiencing erosion along the unprotected shoreline area on Shallowbag Bay and requests his permit be modified to allow him to place riprap along approximately 280 feet of shoreline. The applicant proposes the riprap to have an 8- foot base with no more than 5 feet of the base to be located waterward of normal water level (NWL), and the remainder to be landward of NWL. The proposed riprap will have a height above NWL of approximately 4 feet. The modification request is consistent with 07H.0208 Use Standards for AECs.
