As discussed, to prevent withdrawal of our application, we are requesting an extension to respond to your request for additional information until after we meet to discuss the comments at the agency scoping meeting next week. Additionally, I copied Emily Thompson with this email as she is the project manager - you had sent the email to Emily Greer in the Wilmington Field Office. This email serves as official notice that the PCN application you submitted on behalf of Piedmont Natural Gas for its Line 24 Replacement Project in Pitt County, North Carolina, is incomplete. As discussed, please submit the following (you have already provided some of this information in the attached emails): 1. Project plans and cross section drawings for the pipeline indicating where impacts to jurisdictional waters and wetlands will occur. 2. Detailed plan and cross section drawings for the work under the Section 10 navigable waters of the Tar River and its associated floodplain. 3. In accordance with Wilmington District Regional Condition 4.6.9, a written plan on how you propose to restore and re -vegetate wetland areas cleared for construction. 4. Information related to potential affects to Atlantic Sturgeon Designated Critical Habitat (NMFS) associated with the proposed work under the Tar River. 5. The project may alter the Wilmington District's Civil Works Tar River Navigation Project. Pursuant to 33 USC 408, coordination with the Wilmington District must be undertaken to determine whether or not the project requires a Section 408 permission. Note that the Regulatory permit decision cannot be made until the Section 408 review process is complete. We can facilitate this coordination with the Wilmington District once the application is complete. 6. KMZ of the pipeline alignment to facilitate evaluation. As discussed, we also have questions regarding the following: 1. How the waters and wetlands impacts were defined and calculated. 2. PNG's environmental monitoring plan for the project to ensure permit compliance during construction. 3. Permits for work within waters and/or wetlands are available only if the proposed work is the least environmentally damaging, practicable alternative. Accordingly, we must evaluate the steps you have taken to avoid and minimize impacts before we can approve the compensatory mitigation plan. 4. We are not sure that we received the entire PCN package. You stated that you would provide us with a copy. 5. We must also schedule and complete the confirmation of the waters and wetlands Preliminary Jurisdiction Determination (PJD) work you have undertaken. The PCN will be considered incomplete until the requested information is received. Based upon review of the information you provide, additional information may be requested. If no information is received within 30 days, the submittal will be administratively withdrawn, but can be reopened at any time by submitting the necessary information.
