Siler City Processing Plant Siler City, Chatham County General NPDES Permit No. NCG060383 Dear Ms. Morman: Pursuant to our phone conversation on December 21, 2018, Duncklee & Dunham, P.C. (Duncklee & Dunham), on behalf of Mountaire Farms, Inc. (Mountaire) submits this letter providing notice to the North Carolina Division of Energy, Mineral, and Land Resources (NC DEMLR) of the anticipated implementation date of the Siler City Processing Plant's Stormwater Pollution Prevention Plan (SWPPP). The Siler City Processing Plant is currently under construction, with a planned opening on January 14, 2019. Mountaire obtained a Certificate of Coverage (No. NCG060383) from NCDEMLR for discharge of stormwater under the National Pollutant Discharge Elimination System (NPDES) General Stormwater Permit on August 25, 2017. Part III, Section A (Compliance and Liability) of the General Permit requires that an existing facility already in operation and applying for coverage under the General Permit for the first time develop and implement their SWPPP within 12 months of the effective date of the Certificate of Coverage (COC), and a new facility applying for coverage under the General Permit for the first time develop and implement a SWPPP prior to the beginning of stormwater discharges from area(s) of the industrial activity (ies). As stated previously, the facility was not in operation 12 months after the effective date of the COC, with an expected opening date of January 14, 2019. Duncklee & Dunham is still obtaining operational information on the facility for use in the development of the SWPPP and does not anticipate full completion/implementation of the SWPPP when the facility commences operations. Therefore, we are providing notice to NC DEMLR that the SWPPP will be completed and implemented by the facility by January 31, 2019.
