Structure 20-A was designed and constructed by the Soil Conservation Service as part of the Crabtree Creek Watershed Flood Prevention Plan. The purpose of this structure is the temporary storage of flood waters. Upon acceptance from the contractor it was turned over to the Wake County Commissioners for Operation and Maintenance in August 1985. When the airport authority was developing plans for the improved lighting facilities Wake County officials approached us about our concerns. We advised them that our primary concerns were (1) no net loss of sediment or flood storage volume, (2) all slopes that were disturbed be returned to design requirements, and (3) any vegetation disturbed be reestablished. CESAW-C090-N-092-0194 April 12, 1990 PUBLIC NOTICE DEPARTMENT OF TRANSPORTATION, FEDERAL AVIATION ADMINISTRATION, Post Office Box 20636, Atlanta, Georgia 30320, has applied for an after-the-fact Department of the Army permit TO AUTHORIZE THE PARTIALLY COMPLETED AND PROPOSED PLACEMENT OF FILL MATERIAL INTO CRABTREE CREEK WATERSHED SITE 20A, ON LITTLE BRIER CREEK, FOR CONSTRUCTION OF AN EARTHEN BERM TO FACILITATE INSTALLATION OF RUNWAY LIGHTS AT RALEIGH-DURHAM AIRPORT, Wake County, North Carolina. This public notice does not imply, on the parts of the Corps of Engineers or other agencies, either favorable or unfavorable opinion of the work performed; but it is issued to solicit comments on the factors listed above on which a final decision will be based. Legal action has been suspended pending the outcome of this consideration. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by representatives of the U.S. Army Corps of Engineers. Plans submitted with the application show the placement of approximately 20,000 cubic yards of excavated material below the ordinary high water contour of Site 20A of the Crabtree Creek Watershed to create a 130-foot-wide (bottom width) earthen berm. The berm will extend approximately 145 feet waterward of the ordinary high water contour elevation of the reservoir, with riprap placed from the toe of slope to an elevation of 310.0 feet for stabilization. Approximately 41,300 cubic yards of fill material has been excavated, during low water, from approximately 6.5 acres of the reservoir. This material has been stockpiled in a 1.3 acre area of the lake, adjacent to the excavation sites, and is to be utilized for the berm construction. All excavation and fill activities have occurred within unvegetated, open water areas of the reservoir. The purpose of the proposed work is to provide a base for installation of runway alignment indicator lights. The applicant has stated that the original, soft overburden over the shallow rock base within the lake would not support pile-type foundations for the lights. Plans showing the existing and proposed construction are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a Department of the Army permit be issued until the North Carolina Division of Environmental Management has determined the applicability of a Water Quality Certificate as required by PL 92-500. -2- This application is being considered pursuant to Section 404(b) of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archaeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer has determined, based on a review of data furnished by the applicant and onsite observations, that the activity will not affect species, or their critical habitat, designated as endangered or' threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. -AF r -3- The Corps of Engineers is soliciting comments from the public; Federal, State, and local agencies and officials; Indian Tribes, and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition, or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects, and the other public interest factors listed above. Comments are used in preparation of an Environmental Assessment and/or Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Generally, the decision whether to issue this Department of the Army permit will not be made until the North Carolina Division of Environmental Management (DEM) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The DEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army permit serves as application to the DEM for certification. Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, North Carolina Division of Environmental Management, Salisbury Street, Archdale Building, Raleigh, North Carolina. The North Carolina Division of Environmental Management plans to take final action in the issuance of the Clean Water Act certification on or after May 7, 1990. (DOA) authorization associated with Airport, On February 6, 1990, the DOA and the U.S. Environmental Protection Agency (EPA) signed a memorandum of agreement (MOA) establishing procedures to determine the type and level of mitigation necessary to comply with the Clean Water Act Section 404(b)(1) Guidelines. This MOA provides for first, avoiding impacts to waters and wetlands through the selection of the least damaging, practical alternative; second, taking appropriate and practical steps to minimize impacts on waters and wetlands; and finally, compensating for any remaining unavoidable impacts to the extent appropriate and practical. The initial design called for concrete piers with double Tee concrete beams. Due to the cost of approximately $800,000 for construction, this design concept was ruled out. The alternate design was that of an earth filled berm, which could be constructed within project funds. On January 10, 1989, representatives from the FAA, Lee Wan & Asso., Inc., Wake County Community Development Service, and the Raleigh-Durham Airport Authority attended a meeting to discuss the design, construction, and coordination requirements. Lee Wan & Asso. Inc. prepared the plans and specification to meet the requirements of the North Carolina Department of Environment- al, Health, and Natural Resources (NCDNR). Plans and specificati- ons were coordinated with the above representatives, for approval and concurrence. Construction started on November 29, 1989, and the performance time is ninety (90) calendar days. However, construction of the berm has been temporary halted.
