The Application provides adequate assurance that the discharge of fill material into the waters of an unnamed tributary to the Horsepasture River in conjunction with the proposed dam and lake in Transylvania County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the Stream is 50 NTU's or less are not considered significant). Violations of any condition herein set forth shall result in revocation of this Certification. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application show the construction of a 133-foot-long by 75-foot-wide dam across the unnamed tributary to the Horsepasture River. A total of 2,586 cubic yards of material will be used to construct the dam, of which approximately 7 cubic yards will be placed below the ordinary high water elevation of the creek. The 18-foot-wide top of the dam will also serve as a road crossing to access future development areas. The proposed pond will have a surface area of 0.60 acre, and will impound approximately 490 linear feet of existing creek channel. An existing golf cart path will be relocated along the road crossing. The pond is being constructed for aesthetic purposes as well as to provide access to the remainder of the property. Due to the private nature of the development and difficult accessability to the project site it is suggested that any state or Federal agency representatives wishing to inspect the site arrange such inspection through either Pamela Cockley or Luther Smith of Luther Smith and Associates, P.A., telephone (704) 697-2307. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a Department of the Army permit be issued until the North Carolina Division of Environmental Management has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register -2- constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer has determined, based on a review of data furnished by the applicant and onsite observations, that the activity will not affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in'each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shorelerosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. Generally, the decision whether to issue this Department of the Army permit will not be made until the North Carolina Division of Environmental Management (DEM) issues, denies, or waives State certification,required by Section 401 of the Clean Water Act. The DEM considers whether'or not the proposed activity will comply with Sections 301, 302, 306, and''307 of the Clean Water Act. The application and this public notice for the Department of the Army permit serves as application to the DEM for certification. Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, North Carolina Division of Environmental Management, Salisbury Street, Archdale Building, Raleigh, North Carolina. HARRELSON SECRETARY On July 24, 1989, the North Carolina Department of Transportation applied for a Corps of Engineers 404 Permit to place fill material in Britton Creek and adjacent wetland areas in conjunction with the construction of a rest area on the south side of US 19-129 and west of SR 1388. On December 29, 1989, NCDOT received Corps correspondence which expressed concern over the project's site design and the proposed encroachment into Britton's Creek. On January 10, 1990, NCDOT staff members met with Mr. Bob Johnson of your staff and Mr. John Fridell (USFWS) on site, in order to work out an acceptable site design plan to reduce the impacts to Britton Creek. After discussing various options to lessen impacts, the following modifications to the original site plan proposal have been developed by NCDOT. We feel that these measures will significantly lessen the impacts to the proposed site and answer concerns raised by the Corps in its December 29, 1989 correspondence. As shown on the attached plan and cross section, Britton Creek will have a split channel. The main run of the channel will be located along the south edge of the truck parking area and will rejoin the natural course of the creek approximat5-=ly 150 feet upstream from its confluence with an unnamed trj;:)utary of valley River. In accordance with our conversation, we ?__r-_- supplying you with data which shows the length of the channel both before and after the proposed rechannelization. This plan will serve NCDOT's site design requirement of isolating the old landfill from pedestrian access while retaining an equivalent length of stream channel. This overflow channel will be a dry streambed except in times of high water when it will reduce some of the water volume flowing through the longer channel. During flood flows the elevated channel will serve as an outlet to the Valley River. Please note that the new streambed portions of Britton's Creek have been changed from 6' width as shown in the original plans to 12' as requested by the Corps of Engineers during the field meeting. Class I rip rap will be placed along the newly created channel banks. A four foot reinforced concrete culvert will be installed and used in the newly created portion of Britton Creek to provide pedestrian access from the truck parking lot to the visitor center. The culvert will be the minimum length possible to support the 5' wide sidewalk shown on the drawings. NCDOT will incorporate appropriate landscape plantings along the relocated portions of Britton Creek. Modified embankments will be immediately landscaped and planted in native rhododendron, mountain laurel, white pine and red maple along with understory herbaceous cover. In order to reduce potential siltation runoff into the Valley River, the relocated channel will be constructed in the dry and stabilized with rip rap before flow is diverted. Single wing deflectors will be installed at 50 foot intervals in the newly created portions of channel. Stringent erosion control features including sediment basins, silt fencing and vegetated buffer zones near watercourses will be employed. Suggestions in the September 18, 1989 memorandum from the N. C. Wildlife Resources Commission (copy attached) will be fully implemented. District Engineer Page 3 February 6, 1990 The hazardous spill containment basin has been relocated to the north of its original site. This location on the site provides a more direct connection to the original channel while providing more buffer between the containment basin and the Valley River. NCDOT will route necessary sewage lines between the rest area building and the Andrews sewer main via the SR 1388 Bridge over the Valley River instead of crossing the river with a buried line. The buried line method would be less expensive and provide a more direct crossing but would necessitate some disruption beneath the Valley River. The land for this rest area was acquired by the Department of Transportation in January 1975 in conjunction with construction of the US 19-129 relocation around Andrews. An Appalachian system rest area for this segment has been included in long range plans since 1978 and has received much support from Cherokee County officials. This highway functions as an important link for traffic between Western North Carolina and parts of Tennessee-Georgia. Engineering and design work for the rest area site began in 1987 and has progressed in a normal preconstruction sequence until now. The proposed site has very limited access due to the control of access on US 19-129, the entrance spacing along SR 1388, and the Valley River. A deceleration lane is being considered and will likely be constructed in the near future to provide safe traffic movement and maximum public usage of this facility for east bound traffic. Incorporating a direct entrance access to the facility limits the options NCDOT has for repositioning the truck parking lot in its design proposal. As you are aware, NCDOT had intended to let this project to contract in February 1990. Even though this schedule will not be met, we respectfully ask that you give this permit matter your immediate attention so that we can proceed toward project construction as soon as possible. A 401 Water Quality Certification for this project was issued on October 16, 1989. Our staff feels like this District Engineer Page 4 February 6, 1990 revised plan represents our best effort to offset negative impacts associated with Britton's Creek at the proposed site.
