You had requested confirmation as to whether the General Certification for discharges from upland diked disposal areas, Certification No. 1273, would be applicable to these areas. Our field staff has evaluated your request and the accompanying data. We have concluded that Ranges 5 and 6 can be satisfactorily covered under the scope of the General Certification. BOX 1890 WILMINGTON, NORTH CAROLINA 28402.1890 July 12, 1990 IN REPLY REFER TO Planning Division Ms. Deborah Sawyer, Environmental Technician '?V- Division of Environmental Management C North Carolina Department of Environment, Ct Z Health, and Natural Resources C 990 Washington Regional Office TFpQ& Post Office Box 1507 Washington, North Carolina 27889 Dear Ms. Sawyer: You stated in your letter of September 12, 1989, concerning the Environmental Assessment and Finding of No Significant Impact (EA/FONSI), Maintenance of the Atlantic Intracoastal Waterways Virginia State Line - Beaufort Reach, Goose Creek - Bay River Section, Ranges 5 through 7, Pamlico County, North Carolina, dated August 1989 (A-95/EIS Review Project No. 90-0123), that the subject project will require a Section 401 (P.L. 95-217) water quality certification from the Division of Environmental Management. However, you also stated that after review of sediment analysis and information on the quality of the decant water anticipated, a decision will be made to recommend a formal application for certification or allow the project to be done under General Water Quality Certification No. 1273• Our evaluation of the project area and the grain size analyses of the sediment samples taken on October 26, 1989, in ranges 4 through 7 (enclosed), indicates that the material is suitable for disposal in an upland diked disposal site and that no known sources of contamination exist, other than vessels using the Atlantic Intracoastal Waterway. Therefore, it is our judgment that no further testing is required. The sediment samples, analyzed by the Corps of Engineers, South Atlantic Division Laboratory, Marietta, Georgia, consist of 95 percent or greater sand in ranges 5 and 6, 53 to 83 percent sand in range 7, and 54 to 87 percent sand in range 4. Therefore, it is our determi- nation that all material in ranges 4 through 7 is suitable for upland diked disposal and that performing this work will not have a significant adverse effect on water quality. -2- Approximately 160,000 cubic yards of material will be dredged from ranges 5 and 6 during FY 91 and disposed of in a suitable upland diked disposal site. Future maintenance dredging will be performed in ranges 5 through 7, as needed, in accordance with the EA/FONSI. Although range 4 was not covered in the EA/FONSI dated August 1989, and the range has consistently remained at project depth (-12 feet mean low water) or below, it is included in our application for water quality certification since future maintenance dredging and disposal activities may include this area. If maintenance of range 4 is required, the EA/FONSI will be amended to include this area. We are continuing to search for a suitable upland diked disposal site within the project boundaries of ranges 4 through 7, since the selected site may not be available for disposal when the area requires dredging. Any change in the selected disposal site will be coordinated with your office. As we would like to perform maintenance dredging of ranges 5 and 6 of the project during the first quarter of FY 91, we would appreciate receiving your determination of whether Water Quality Certificate No. 1273 is applicable as soon as possible. If a new water quality certificate is required, we request that this letter with enclosures be considered as our application. (WILMINGTON DISTRICT) FROM PAMLICO RIVER TO SOUTH CAROLINA STATE LINE (PAMLICO AND BRUNSWICK COUNTIES) TO WHOM IT MAY CONCERN: The Wilmington District, Corps of Engineers, Wilmington, North Carolina, proposes to perform maintenance dredging in the Atlantic Intracoastal Waterway (AIWW) between Pamlico River, North Carolina, and the South Carolina State Line. PROJECT DESCRIPTION This maintenance work, which is scheduled to begin during January 1991, will require approximately 5 months to complete and requires the removal of isolated shoals above the plane of 14 feet below mean low water (MLW) within the designated limits of the channel as shown on the enclosed drawing. Two of the three disposal areas have previously been used for placement of dredged material. No impacts to known archeological/historical resources or endangered species will occur. A drawing showing the proposed work is enclosed with this notice. More detailed drawings are available in the Wilmington District Office. Enclosed is a list of Federal, State, and local agencies with whom this activity is being coordinated. The proposed work is consistent with the approved Coastal'Management Program of the State of North Carolina. The work at Yellow Banks and Holden Beach received consistency concurrence from the North Carolina Department of Environment, Health and Natural Resources (NCDEHNR), letter dated February 25, 1980, as amended July 16, 1984. A consistency determination for the Goose Creek - Bay River Section (Hobucken) will be mailed to the NCiDEHNR and concurrence received prior to performing the work. The discharge of effluent from upland diked disposal areas is covered under Section 401 (P.L. 95-217) Water Quality Certificate No.' 1273, issued on November 10, 1978, and NWP 33 CFR 330.5 (a)(16). Information regarding the proposed upland diked disposal site for the Goose Creek - Bay River Section (Hobucken) has been sent to the N.C. Division of Environmental Management. The work is being performed in accordance with the Final Environmental Impact Statement for the Maintenance Dredging of the Atlantii Intracoastal Waterway AIWW , filed with the Council on Environmental Quality (CEQ), on November , 1975; the Supplemental Information Report, Maintenance of the Atlantic Intracoastal Waterway from the Cape Fear River to the South Carolina Line, Brunswick County, North Carolina, December 3, 1986; and the Environmental Assessment and Finding of No Significant Impact, Maintenance of Atlantic Intracoastal Waterway, Virginia State Line - Beaufort Reach, Goose Creek - Bay River Section, Ranges 4 through 7, Pamlico County, NC which is scheduled to be completed October 1990. The Proposed action has been evaluated under Executive Order 11990, Protection of Wetlands. The work at Yellow Banks and Holden Beach will not require dredging or filling of any wetlands. A <0.2 acre isolated wetland within the disposal site for the Goose Creek - Bay River Section, ranges 5 and 6, will be filled. No practicable alternative to the filling of the isolated wetland exists. Filling of the <0.2 acre wetland is authorized under Nationwide Permit (NWP) CFR 330.5(a)(26). The discharge pipeline may cross wetlands to reach the disposal sites. Where the pipeline crosses wetlands, pipeline joints will be properly sealed to provide protection from leakage. Any impacts to wetlands will be minor and of duration. 0 -3- The proposed disposal areas are within the flood plain. The dredging and discharge of dredged material has been evaluated for adherence to the requirements of Executive Order 11988, Flood Plain Management. Every effort will be taken to minimize potential harm to the flood plain, and the work is in compliance with State/local flood protection standards. Work within the Goose Creek - Bay River Section of the AIWW will be completed prior to March 31 to avoid adverse impacts to juvenile shrimp and finfish which may be moving from the primary nursery areas located in Gale Creek and Jones Bay. The decision whether to perform this work was based on an evaluation of the probable impact, including cumulative impacts of the proposed activity on the public interest. That decision reflected the national concern for both protection and utilization of important resources. The benefits which reasonably may be expected to accrue from the proposal were balanced against its reasonably foreseeable detriments. The dredging and discharge of dredged material has been evaluated for adherence to the requirements of Executive Order 11988, Flood Plain Management. Every effort will be taken to minimize potential harm to the flood plain, and the work is in compliance with State/local flood protection standards. The work at Yellow Banks and Holden Beach received consistency concurrence from the North Carolin Department of Environment, Health and Natural Resources (NCDEHNR), letter dated February 25, 1980, as amended July 16, 1984. A consistency determination for the Goose Creek - Bay River Section (Hobucken) will be mailed to the NCDEHNR and concurrence received prior to performing the work. The discharge of effluent from upland diked disposal areas is covered under Section 401 (P.L. 95-217) Water Quality Certificate No. 1273, issued on November 10, 1978, and NWP 33 CFR 330.5 (a)(16). Informationlregarding the proposed upland diked disposal site for the Goose Creek - BaylRiver Section (Hobucken) has been sent to the N.C. Division of Environmental Management. The work is being performed in accordance with the Final Environmental Impact Statement for the Maintenance Dredging of the AtlanticiIntracoastal Waterway (AIWW), filed with the Council on Environmental Quality (CEQ), on November 6, 1975; the Supplemental Information Report, Maintenance of the Atlantic Intracoastal Waterway from the Cape Fear River to the South Carolina Line, Brunswick County, North Carolina, December 3, 1986; andithe Environmental Assessment and Finding of No Significant Impact, Maintenance of Atlantic Intracoastal Waterway, Virginia State Line - Beaufort Reach, Goose Creek - Bay River Section, Ranges 4 through 7, Pamlico County,, NC which is scheduled to be completed October 1990. The Proposed action has been evaluated under Executive Order 11990, Protection of Wetlands. The work at Yellow Banks and Holden Beach will not require dredging or filling of any wetlands. A <0.2 acre isolated wetland within the disposal site for the Goose Creek - Bay River Section, ranges 5 and 6, will be filled. No practicable alternative to the filing of the isolated wetland exists. Filling of the <0.2 acre wetland isjauthorized under Nationwide Permit (NWP) CFR 330.5(a)(26). The discharge pipeline may cross wetlands to reach the disposal sites. Where the pipeline crosses wetlands, pipeline joints will be properly sealed to provide protection from leakage. Any impacts to wetlands will be minor and of duration. -3- The proposed disposal areas are within the flood plain. The dredging and discharge of dredged material has been evaluated for adherence to the requirements of Executive Order 11988, Flood Plain Management. Every effort will be taken to minimize potential harm to the flood plain, and the work is in compliance with State/local flood protection standards. Work within the Goose Creek - Bay River Section of the AIWW will be completed prior to March 31 to avoid adverse impacts to juvenile shrimp and finfish which may be moving from the primary nursery areas located in Gale Creek and Jones Bay. The decision whether to perform this work was based on an evaluation of the probable impact, including cumulative impacts of the proposed activity on the public interest. That decision reflected the national concern for both protection and utilization of important resources. The benefits which reasonably may be expected to accrue from the proposal were balanced against its reasonably foreseeable detriments. All factors relevant to the proposal were considered, including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, historic properties, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership and, in general, the needs and welfare of the people. Any person who has an interest which may be affected by the disposal of this dredged material may request a public hearing. The request must be submitted in writing to the District Engineer within 30 days of the date of this notice and must clearly set forth the interest which may be affected and the manner in which the interest may be affected by this activity.
