This pertnit, issued on 11/21/18 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditians and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1} Unless specifically aitered herein, this Minor Modif cation authorizes the following: construction of a 30' wide x 110' long work trestle within the footprint of the existing bridge, installation of two pipe piles for vessel mooring during the demolition of the old bridge, revision to the current proposed location of the previously authorized cul-de-sac on Raland Avenue by approximately 125' to the north, addition of parking along Roland Avenue, and construction of a 5' wide sidewalk along the east side of Roland Avenue, all as depicted on the attached workplan drawings. 2) In accordance with commitments made by the permittee, due to the classification of Topsail Sound as a Primary Nursery Area, all bottom-disturbing activities shall occur outside the in-water work moratorium of April 1 to September 30 of any year without prior approval of the N.C. Division of Coastal Management {DCM), in consultation with the appropriate resource agencies. {See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20} days of the issuing date. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance worlc or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on No expiration date, pursuant to GS 136-44.7B In issuing this permit, the State of Nortii Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Department of Transportation ADDITIONAL CONDITIONS Permit #60-1 b Page 2 of 2 3) The authorized project is located within a primary nursery area {PNA). Therefore, in accordance with T15A:07H.0208 of the rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibitian shall be applied and enforced throughout the entire existence of the permitted structure. 4) The authorized activities shall not result in any additional permanent or temporary impacts to wetlands or waters of the State, without permit modification. 5) The work trestle, pipe piles, and barges authorized by this Minor Modification shall be removed in their entirety within 90 days after they are no longer needed. However, if this timeframe occurs while the moratorium referenced in Condition Number 2 of this Minor Modification is in effect, then they shall be removed in their entirety within 90 days of the moratorium end date. 6) Barges shall only be utilized in areas of sufficient depth such that the barges do not rest on the bottom during periods af low tide. 7) During bridge demolition, the permittee shall make every attempt to allow the same navigation that is currently possible in Topsail Saund and the AIWW. If this is not possible, then adequate notice shall be provided to the public that navigation will be lirnited during demolition. The notice shall include an estimate of the amount of time that the limited navigation wiIl occur. 8} The permittee shall install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. For further information, the permittee should contact the U.S. Coast Guard Marine 5afety Office. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 9) If it is determined that additional permanent and/or temporary impacts are necessary that are nat shown on the attached workplan drawings or described in the authorized permit application, a permit modification and/or additional authorization from DCM may be required. The permittee shall contact a representative of DCM prior to commencement of any such activity for this determination and any permit modification. 1 Q) This Minor Modification does not eliminate the need ta obtain any additional permits, approvals or authorizations that may be required, including but not limited to, any permits required by the U.S. Army Corps of Engineers and/or the N.C. Division of Water Resources. 11) This Minor Madification sha11 be attached to the original of Permit No. 60- l 6, which was issued on 5/27/lb, as well as the amendment issued on b/2/16, and all subsequent modifications and Ietters of refinement, and copies of all documents shall be readily available on site when a Division representative inspects the project for compliance. 12) All conditions and stipulations of the active permit remain in force under this Minor Modification unless altered herein. NOTE: A minor modification application processing fee af $lOQ was received by DCM far this project.
