Mr. Lawrence Sneeden, Jr., P.E. with Siteworks Design Group,
has requested sewer service from North Topsail Water & Sewer,
Inc. for Phase I of the Yow property (10 units). North Topsail
Water & Sewer, Inc. has agreed to relinquish 3,600 gpd from
Bermuda Landing's sewer allocation for use by the Yow property.
Permit # 10623, dated August 16, 1984, was issued to North
Topsail Water & Sewer for the Bermuda Landing subdivision
allocating 35,250 gpd. Only 23,040 gpd is needed for the Bermuda
Landing project.
Therefor, there is capacity available at North Topsail to
receive the flow from the 10 units of the Yow property. This
office has no objection to this; However, until North Topsail has
demonstrated the capacity, approval will be given for the
connection of only these 10 units.

With regard to the availability of sewer service to the
Subject project from the North Topsail Water and Sewer Company,
our regional office has recently had a conference with principals
involved. There has been a verbal agreement reached which, when
executed, will allow a sewer capacity allocation from an already
approved project to be reallocated for the Yow project. We
recommend that final action be withheld until the signed
agreements have been executed. We do not anticipate that there
will be a real problem if all parties follow through on the
agreed upon solution.

Attached is a copy of a letter from North Topsail Water and Sewer, Inc. indicating
that sewer service will be provided and maintained to the subject property. DCM
has been informed that North Topsail cannot presently accomodate sewage from the
proposed development on the subject property. Apparently, capacity at North Topsail
can be reallocated to accomodate the proposed development. Issuance of a CAMA permit
is pending a termination of the feasibility of this reallocation. Please provide
comments to this office by February 15, 1990.

8. Project Summary The applicant proposes to construct 117 single family houses,_
(54 on sound side and 63 on oceanfront) 117 parking spaces, 2 pools 4 tennis
courts and 2 clubhouses.

9. PROJECT DESCRIPTION
The project site is located on both sides of NC 210 on west
Onslow Beach between Permuda Island's Causeway and the western
edge of Ocean City. The +100 acre tract stretches from the
Atlantic Ocean along the 1.600' long S.E. boundary and reaches
landward into the marshes another 2.600' to the N.W. boundary.
The net usable area comprising upland above the MHW contour and
above flagged CAMA-Corp wetlands is best broken down into two
broad groupings. "The Beach Tract" approximately 17.1 acres and
"The Sound Tract approximately 30 acres.
The "Beach Tract" runs 1.600 linear feet along the ocean and
along NC 210 and has an average width of ±3501. It has
approximately 17.1 acres of relatively flat duneland area with a
continuous classical frontal dune along the oceanfront cresting
at 20' (MSL). The width of the dune from toe to heel is about
85' and ends along the abandoned road bed. One solitary large
dune exists at the southern corner of the tract which has a
pinnacle of + 22' (MSL). All of the duneland vegetation is
comprised of Sea Oats (Uniola Paniculata) with yucca and
similax vines scattered throughout. The average elevation of the
buildable areas is 8-10' (11SL). The ocean hazard area extends
back 320' and the 100 years BFE is established at 12.5' (MSL) and
it appears to be within FEMA's "No Insurance Zone" as identified
by the COBRA bill.
The "Soundside Tract" totals approximately 93 acres of which, 30
acres are uncluded in the project for a net buildable area of +
23 acres of upland. It is totally comprised of relatively young
maritime woods. Some small live oaks (Quercus virginica) are
found throughout but the dominant canapies include yaupons,
hackeberrys, cedars, myrtles and bay trees. This tract borders
high marshes of banks channel and the Stump Sound Channel and the
S.E. Shoreline of a 1.200' long man-made channel. Most of the
bordering high marsh is comprised of black needle marsh,
fimbristylis, salt grass and Sea Lavender. Other species present
include Sea ox-eye, giant Spartina, Saw grass and IVA. Much of
the upland bordering the channel and Stump Sound Creek averages
5.5' (MSL). It is comprised of a low loamy sand (Duckston) and
also of relict dredge spoil caused by the dragline work on the
channel. Evidence of an old road bed also bisects the tract.

The applicant proposes to construct on the ocean tract 63 single
family houses a club house and swimming pool to be located on the
ocean side of NC 210, also proposed are streets to provide access
to the single family houses. 14 parking spaces are to be located
adjacent to the clubhouse and 23 parking spaces to be located
directly across the street (proposed) from the clubhouse. Also
an area of 150'x45" is set aside, along the eastern property line
for public parking and a_ 10' access easement to the beach is
dedicated.
The "Sound Side Tract" will have 54 single family houses, 4
tennis courts, each being approximately 9,100 s.f., a clubhouse
with pool occupying approximately 6,000 s.f. Also proposed is a
parking area located adjacent to the clubhouse having 24 spaces
to accommodate the clubhouse and tennis facility.
10. ANTICIPATED IMPACTS
The project as proposed will cause the disturbance of
approximately 8 acres of estuarine shoreline habitant consisting
of maritime woods and grassy niches. Also approximately 6 acres
of ocean hazard low dunelands will be graded and/or filled to
established finish elevations for the streets, and necessary
gradient for stormwater runoff. In order to prevent storm water
from reaching estuarine waters no impervious surface must be
placed within 30' landward from all marshes and MHW. A grassed
10-15' wide recharge area is to run parallel to all roads,
parking and impervious surfaces. It is unknown whether
groundwater recharge with stormwater can still seep into adjacent
productive nursery and shellfish areas. It is very important
that all sites be graded gradually away from the brackish waters.
The density for the complete project is approximately 2.5
units/acres. The depicted 150' x 45' and 10' public beach access
and parking appears adequate.

8 ADDITIONAL INFORMATION
In addition to the completed application form, the
following items must be submitted:
A copy of the deed (with state application only) or
other instrument under which the applicant claims
title to the affected property. If the applicant is not
claiming to be the owner of said property, then for-
ward a copy of the deed or other instrument under
which the owner claims title, plus written permis-
sion from the owner to carry out the project.
An accurate work plat (including plan view and
cross sectional drawings) drawn to scale in black
ink on 8 1/2 x 11 white paper. (Refer to Coastal
Resources Commission Rule 7J.0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will he accepted. Blue-line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.
(Contact the U.S. Army Corps of Engineers regard-
ing that agency's use of larger drawings.) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include
county road (SR) numbers, landmarks, and the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit com-
ments on the proposed project to the Division of
Coastal Management. The applicant must advise
the adjacent landowners of this opportunity by sen-
ding a copy of the permit application to them by
registered or certified mail. This notification is re-
quired by G.S. 113-229(d).

AEC HAZARD NOTICE

This notice is intended to make you, the appli-
cant, aware of the special risks and conditions
associated with development in this area, which is
subject to natural hazards such as storms, erosion
or currents. The rules of the Coastal Resources
Commission require that you receive an AEC
hazard notice and acknowledge that notice in
writing before any permit for development in this
area can be issued.
The Commission's rules on building standards,
oceanfront setbacks and dune alteration are
designed to minimize, but not totally eliminate,
property losses from the hazards. By granting
permits, the Coastal Resources Commission does
not guarantee the safety of the development and
assumes no liability for future damage to the
development.
The best available information, as accepted by
the Coastal Resources Commission, indicates that
the annual ocean erosion rate for the area where
your property is located is 2 feet per year.

This figure was established by careful analysis of
aerial photographs of the coastline taken over the
past 30 to 40 years.
Studies also indicate that the shoreline could
move as much as feet landward in a major
storm.
The flood waters in a major storm are predic-
ted to be about feet deep in this area.
Preferred oceanfront protection measures are
beach nourishment projects and relocation of
threatened structures. Hard erosion protection
structures such as wooden bulkheads, seawalls,
rock and rubble revetments, wooden, metal,
concrete or rock jetties, groins and breakwaters,
concrete-filled sandbags and tire structures are
prohibited. Sandbag bulkheads or groins, beach
nourishment, beach bulldozing, and low intensity
off-shore passive sandtrapping devices may be
permissjble under rrtai on Itl S. 1

The applicant must acknowledge receipt of this information by signing this notice in the space above. Without
the proper signature, the application will not be complete.
SPECIAL NOTE: This hazard notice is required for development in areas subject to sudden and massive storms and
erosion. Permits issued in this area expire on December 31 of the third year following the year in which the permit was
issued. Shortly before work begins on the project site, the Local Permit Officer will determine the vegetation line and
setback distance at that particular site. If the property has seen little change and the proposed development can still
meet the setback requirement the LPO will inform you that you may begin development. It is important that you
check with the LPO before the pennit expires for official approval to continue work after your permit expires. Gener-
ally, if foundation pilings have been placed and substantial progress is continuing, permit renewal may not be necessary.
If substantial progress has not been made the permit must be renewed and a new setback may be applied. IT IS
UNLAWFUL TO CONTINUE WORK AFTER PERMIT EXPIRATION WITHOUT THIS APPROVAL.
